3.6 In the event offailure ofthe tenderer to pay cash security deposit within l0 days (unless extended i1
writing by the the Ex. Engineer) from the date ofreceipt ofnotice (Sent by Registered Post) ofacceptance
ofhis tender, the amormt ofeamest money shall by forfeited to Govt. and the acceptance ofhis tender;
shall be considered as withdrawn. Except that in the event of the notice ofacceptance ofhis tendernot
being issued within 120 days ofthe date dfopening oftenders, the tenderer shall have the c]ption (to be
intirnated in good time before the expiry of 120 days period ) ofwithdrawing his tender, inl which case
the eamest money should be refunded in full. All the tenders shall be kept open for 120 ddys frbm the
date ofthe tenders.
3 '7 Eamest money ofthe rmsuccessfl tenderers will be refinded on their application only, after an intimation
ofrej ection oftheir tender is sent to them or on the expiry ofthe validity period whicheverl is earlier.

has quoted his rates with due consideration to all these factbrs.
9. The right is reserved to revise or amend the contract documents, prior to the date noticed for the
receipt of tenders or extended date. Such deviations,amendments or extensions, of any, shall be
communicated i4 the form of corrigendum by letter or / and by notice in Newspapers as may be
considered suitable.
10. The tenderer shall in the letter, forwarding the tender, state any points he may wish to make in addition
to all points prescribed to be stated under the specifications and conditions ofthis contact. Zilla parishad
reserves the right to reject any tender, iftho same becomes a conditional tender therebv.

Clause 2 : The time allowed for carrying out the work as entered in the tender shall Compensation fpr delay

Action when whole of Clause 3 : In any cases in which under any clause of this mntract conracbr
security deposit is forfeited shall have tendered himselfliable to pay compensation amou: whole of
his security deposit whether paid one sum or deducted by ir or in the
case ofabandonment ofthework owing to serious illness or death mntractor
or any other cpuse the Executive Engineer on behalf of the of
Maharashha shall have power to adopt any of the following as hemay
deem best suited to the interest of Government.
(a) To rescind the contact (forwhich recession notice in writing to thp conbactor
under the hand ofExecutive Engineer shall be conclusive evidence) and in that
case the Security deposit ofthe contractor shall stand forfeited and b9 absolutely
at the disposal of Government.
(b) To carry out the work or any part of the work departrnentally debiting the
contactor with the cost ofthe work, expenditure incurred on tools and plant,

establishment employed for getting the unexecuted part ofthe complete
and crediting him with the value of the work done deparhnen!,ally in]all respe.cts
in the same manner and at t}te same rates-as if it had been out by the

as to the cost and other allied expenses so incurred and as to the ofthe
work so done depart4entally shall be final and conclusive against contactor.
(c) To order that the work ofthe conhactor be measured up and take such
part there ofas shall be unexecuted out ofhis hands, and to give to another
contractor to complete, in which case all expenses incurred to at

Works to be executed Clause 13 : The confactor shall execute the whole and every part of the work
in accordance with in the most zubstantial and worknanlike manner, and both regards rnaterial and
specifications, drawings, every otherrespect in sfict accordance with specifications. The contactor shall

writing relative to the work signed by the Engineer-in -charge and lodged in his
