COUNTER-AFFIDAVIT

I, GOWEN GETTER, 39 years old, married, and a resident of Ampao

Street, Barangay Banago, Bacolod City, Philippines, after having been duly
sworn to in accordance with law, hereby depose and say THAT:

1. I am the respondent in the above-entitled Criminal Case for the

crime of Parricide under Article 246 of the Revised Penal Code;

2. That on February 14, 2018, at around 9:00 P.M., I went to my

parent’s residence at Malasin Street, Barangay Cabug, Bacolod
City, to ask for my mother’s assistance in connection with my
outstanding obligation with ABC Lending Company;

3. That instead, of listening for my plea for her assistance, my mother

berated me to the extent of calling me named names, and that
sensing that I won’t be able to solicit her assistance in connection
with my above-stated problem, I decided to leave my mother’s
house;

4. That while on my way to the door, to leave my mother’s house, to

my surprise, my mother pushed me hard that resulted to my
falling down on the floor;

5. That while lying frustrate and helpless on the floor, my mother
started kicking me and threatened to stab me, thus, when she
attacked me using her knife, I kicked her in order that I won’t be
hit by her thrust and tried to disarm her;

6. That a scuffle between us ensued to the extent that I did not know
that I was able to disarm her and hurt her with the weapon that
she was trying to use on me;

7. That I execute this affidavit to vehemently deny that I

intentionally killed my mother whom I dearly loved, as what I
have done was only to defend myself against her unwarranted
aggression and to preserve my life.
