CASE

Indian Oil Corporation limited is a


public sector petroleum company.
Indian oil and its subsidiary
account for a 47% share in the
petroleum market, 40% share in
refinery capacity 67% downstream
sector pipeline capacity in India. On
29 Oct 2009 IOC Jaipur oil depot,
situated in sitapura industrial area
on the outskirts of Jaipur, caught
fire at 7:30 PM .this fire was a
major disaster in terms of deaths,
injury, and loss of business,
property & environment impact.
12 people killed and more than 300
people were injured. Within
minutes, two dozen fire
extinguishers were rushed to the
spot.
5 KM periphery area declared as
Dangerous zone. The surrounding
area had evacuated and power cut
offed. 500,000 people shifted to
safe location. Many, among those
who were evacuated, were the
patients, doctors and staff of a
government hospital and
engineering and medical students
of 10 colleges. The injured had
rushed to three major hospitals of
Jaipur including the SMS hospital.
All the factories and institution
operating from the Sitapura
industrial area had asked to shift
manpower to a different
location.300 army men helped with
rescue. Cold water mixed with
foam had sprayed on the pipeline
of LPG storage tankers located
near the petroleum depot to keep it
cool and unaffected from the heat
generated from the fire. The blaze
continued to rage out of control for
over a weak. Impact of explosion
was as heavy that window of house
even 3 KM away were damaged
and fire was visible from 30 KM
radius. The capacity of the terminal
is 80 lakh liters at that time there
were 18,810 kl, kerosene 2099kl,
high speed diesel 39966 kl. There
were 40 employees at the terminal.
CAUSE OF
ACCIDENT
The fire broke out when petrol was
being transferred from depot to
pipeline. There was a leak in valve
of pipeline, which connected fuel
tank to distribution point. The fire
caused due to short circuit.
6.45 PM A leakage was detected in
IOC depot in Jaipur. For next 40
minutes engineers tried to repair it.
7:30PM: The first container
exploded, causing effect of
equivalent to a mild quake
measuring 2.3 on the Richter scale.
Immediately all 12 tanks catch fire.

SAFETY MEASURE
IGNORED
The committee headed by the
former Hindustan Petroleum
Corporation chairman, M.B. Lal,
which also included seven other
members, went into the causes of
the October 29 fire. And said that it
was gross negligence of
maintenance. The basic or root
cause is an absence of site specific
written operating procedures,
absence of leak stopping devices
from a remote location and
insufficient understanding of
hazards, risks and consequences
.Under section 38 there should be
proper provision to tackle the fire
but there were not proper
equipment to tackle the fire.

IT’S IMPACT ON IOCL


IOC’s total losses due to the fire is
being estimated at Rs 300 crore
out of which Rs 150 crore is the
product loss and another Rs 150
due to infrastructure damage.
According to IOC it will take 15-18
months to re-create the facility in
Jaipur. The company said that it will
be able to meet full demand of fuel
in that area for that they have
made alternate arrangements for
supply to all areas. Fuel products
have been moved in from
Bharatpur and Ajmer depots, the
company is also sourcing products
from other oil marketing
companies.
LEGAL PROVISION
INVOLVED IN THE CASES
There are few provision for punishment if
anybody found guilty.
Section 120B: Punishment of criminal
conspiracy
(1) Whoever is found in criminal
conspiracy to commit an offence
punishable with death.
(2) Imprisonment for life or rigorous
imprisonment for a term of two years
or upwards.
Section 166: Public servant
disobeying law, with intent to cause
injury to any person
Whoever, being a public servant,
knowingly disobeys any direction of the
law as to the way it cause injury to any
person, shall be punished with simple
imprisonment for a term which may
extend to one year, or with fine, or with
both.
Section 304A: Causing death by
negligence whoever causes the
death of any person by doing any rash or
negligent act, shall be punished with
imprisonment of either description for a
term which may extend to two years, or
with fine, or with both.
Section 511: Punishment for
attempting to commit offences
punishable with imprisonment for
life or other imprisonment.
Whoever attempts to commit an
offence punishable by this Code with 1
imprisonment for life or imprisonment,
2 imprisonment of any description
provided for the offence or with such
fine as is provided for the offence, or
with both.
