The Facts

The complainant ,Mr. Serafin Tolingan, is 26 years old, single and residing at
#24 Quirino Hill, Baguio City. On the other hand, the defendant, Angel Design
Clothing Company Inc. (ADCCI), is a clothing line corporation engaged in the
located at PEZA Loakan Road, Baguio City with a main boutique at SM Mall.

The facts of the case are as follows:

On September 8,20114, Angel Design Clothing Company hereby referred as

ADCCI offered a marketing position to the complainant Serafin Tolingan. The
qualifications for the said job are that one must be a college degree holder
and has a corresponding experience in marketing field for at least 2 years.
The plaintiff who only finished 2 years of the supposed four-years course in
Business Administration, however, has an experience in the field of sales and
marketing for 2 years applied for the said job. The defendant despite being
aware of the education background of the complainant accepted Mr. Tolino as
the company urgently needed a sales marketing at that time. The complainant
then signed a 6-month training agreement program.

The complainant then undergone a 6-month training with pay as stipulated in

the contract. He started the training from September 15, 2014 to January
16,2015. After the contract expired, the complainant still continued to work for
the defendant for until March 24, 2017-04-07 even without renewing the
contract, contributing productively to the company. The plaintiff was even
awarded the employee of the year in his two years of service. However, the
dilemma came when the company suddenly decided to impugn the
educational qualification of the plaintiff, claiming that there was a lapse in his
employment. As a consequence, he was notified that he was dismissed and
barred from further performing in his function as an area manager and in
transacting with the company. Unknown to the plaintiff, Poklis who is a friend
of Angel and who is a highly qualified for the job was employed by the
defendant.
