Negative DNA tests with Guimaras 'relatives' – Grace Poe


The presidential candidate maintains the negative tests will hardly affect the disqualification case
against her, as they are merely secondary to her legal arguments.

Chief justice Ma. Lourdes sereno issued a tro’s on two commission on elections rulings
canceling lawmakers disqualification from the 2016 presidential race.

Poe filed her two petitions against the comelec resolutions on the petition filed by atty. Estrella
Elamparo and a former senator Francisco Tatad, Former University of the East college of law
dean Amado valdez, and De La salle University professor Antonio Contreras.

Aside from discussing the disqualification case filed by the comelec the SC is set to hear on
January 19 the petition to reverse the senate electroral tribunal’s decision allowing the senator to
remain in her post after upholding that she is a natural born Filipino.

A day after she filed her COC Sen,.Grace Poe faces a new disqualification petition before the
commission of election Lawyer Estrella Elamparo filed a petition on October 16 To deny due to
course to or cancel poe’s COC because of the information she wrote in the document

Another disqualification case was lodged against presidential polls from runner Sen.Grace Poe
just a few days of the deadline of filling of COC.This case is filed by former sen.Francisco Tatad
a former ally of her father (Fernando Poe Jr)
The petition seek the disqualification of Poe in supposed accordance with constitution
Art 7,sec 2 states that “ No person may be elected president unless he is a natural born
citizen of the Philippines,a registered voter ,able to read and write,atleast 40 yrs of age
on the day of election,and a resident of the Philippines for atleast 10 years immediately
presiding such election”

Tatad maintained that Poe is not a natural born citizen as she has “unknown parents”
and that she failed to comply with the 10 year residency requirement for a president

A fourth disqualification case against Grace Poe has been filed by Former University of
the East Law Dean Amado Valdez which seeks to block her presidential bid in the 2016
national elections,The first 3 cases against poe cited residency and citizenship issues
against the presidential aspirant.

Poe is also facing a disqualification case before the Senate electroral tribunal which
was filed by defeated senatorial bet Rizalito David who claimed that poe is not qualified
to be a senator .
The senator earlier said the DNA test result s that supposed to be her biological
relatives turned out into a negative . impact on Poe’s case.

Rizalito David vs Mary Grace Poe Llamansares,better known as David V. Poe is a set
case No.001-15

It is a 2015 court case filed before the Senate Electroral Tribunal (SET) that sought to
remove Grace Poe from the Phillipine Senate which would have effectively blocked from
her running for president in the 2016 Election because she was a foundling and
therefore it was impossible to determine whether she was a natural born citizen, a
requirement for both offices.

On November 17 the tribunal voted 5-4 to dismiss disqualification case against the
senator filed by the petitionare Rizalito David.Those who voted in favor of Grace Poe
are the following:

Vicent Sotto III

The rest who voted disqualify Poe are:

Senior Justice Antonio Carpio, Chariman Associated Justice Terisita Leonardo –De
Castro,Associate Justice Arturo Brion and Sen.Nancy Binay

Set chairman and supreme court Senior Associate Justice Antonio Carpio described
the position taken by the 5 Senators as a “Sentimental plea that conviently forgets the
express language of the constitution reserving those high positions,in this case the
position of the senator of the republic exclusively to natural born Filipino citizens”

The commission on Elections en banc on Tuesday ratified comment filled by


Commissioner Rowena Guanzon before the Supreme Court defending the poll body’s
rulling to cancel Sen. Grace Poe’s certificate of Candidacy for president.
The en banc met to discuss how to treat the comment, Whis caused a rift between
Guanzon and Chairman Andres Bautista , Who questioned why it was not shown to
him and other members of the body before it was filled with the SC last week

In an apparent show of solidarity ,the seven member en banc appeared before the
press on Tuesday afternoon ,with commissioner Arhtur Lim tasked to make the
announcement. “ We will not coming out with a resolution ,if not late today ,by tomorrow
morning ,addressing certain concerns and issues,first and foremost of which is that we
have thus far complied with the filling of comment in the disqualification cases now
pending before the Supreme Court “ Lim said

“The en banc will be ratifying and confirming the comment that has been filed in the
cases of Tatad,he said, referring to former senator Kit Tatad , Lawyer Estrella
Elamparo ,La Salle University Proffesor Antonio Contreras,and University of the east
Law dean Amado Valdez who filed separate disqualification cases against grace Poe.

Lim,However.no longer discussed the contents of the resolution.

In an interview following the announcement, comelec Spokesman James Jimenez also


could not say for a certain if the resolution covers the protocol on poll body filling its
own pleadings before the supreme court , as well as how the en banc saw guanzon’s
act of filling last week “I think it will be more prudent to wait for that resolution because
that resolution will deal with that specifically”- according to Jimenez

He added the situation faced by the current en banc is rather novel as they normally
assisted by the office of the solicitor General in matters before the SC.

Jimenez also clarified that the SC did not require the poll body to submit resolution,
which was instead written as a part of comelec’s standards Procedure to make an act
official
