I am writing to ask you to reverse actions taken by your administration earlier this year to move certain
employees into positions covered by the CSEA collective bargaining agreement and/or into protected
civil service positions.
First, the Memoranda of Agreement that placed the titles of Community Services Representative,
Administrative Officer II and Director of Environmental Engineering into the CSEA Negotiating Unit
should be rescinded.
The Memoranda themselves show that they were no more than a pretext for placing current
employees into protected positions. Each one recites that it is a settlement of a dispute concerning
a particular individual, but that clearly was not the case. The agreement that gave union protection to
Community Services Representatives, for example, involved not a single individual, but rather
transformed at least 26 individuals, from different departments and with different duties, into union-
protected employees.1 Your Office of Labor Relations confirmed that it had no record of any
grievances or complaints on the subject, which belies the contention that any legitimate settlement
occurred, and confirms that the changes were attempts to alter the terms of the collective bargaining
agreement before the upcoming contract negotiations.
In addition, the wholesale transfer of of twelve Deputy County Attorneys into the union-protected
Assistant County Attorney title also should be reversed. This hiring of existing employees into a title
that hasnt been used in decades served no purpose other than to guarantee them future
employment. Accordingly, I request that these individuals be returned to their pre-move positions. You
should be aware that, at this point, I see no reason to retain the Assistant County Attorney position.

Engineering were equally disingenuous.
For these reasons, I trust these personnel moves will be reversed.
