TEMPORARY RESTRATINING ORDER AND ORDER SETTING HEARING FOR

TEMPORARY AND/OR PERMANENT INJUNCTION

1. After considering Plaintiffs' application for temporary restraining order, the pleadings,
the affidavits and the arguments of counsel, the Court finds that there is evidence that
hami is imminent to Plaintiffs, and if the Court does not issue the temporary restraining
order. Petitioner faces immediate and in-eparable injury because crucial evidence will be
discarded, altered or destroyed.

2. An ex parte order, without notice to Defendants was necessary because there is not
enough time to give notice to Defendants, hold a hearing and issue a restraining order
before the irreparable injury, loss, or damage occurs.

3. Therefore, the Court restrains Defendants ExxonMobil Oil Corporation, Bechtel Oil, Gas
and Chemicals, Inc. and Echo Maintenance, L.L.C. from:

a. Damaging, modifying, altering, selling or disposing of in any way the facility or

any of its component parts involved in the death of Yesenia Espinoza.

b. Removing or transporting any of the component parts of the facility involved in

the death of Yesenia Espinoza from their present location witliout leave of this
