Before me the undersigned authority personally appeared JOHN D. SAWICKI, who being

duly sworn, deposes and says that:

1. My name is JOHN D. SAWICKI, and I am President of Forensic Data Corp.

(hereinafter "FDC"), a Florida Corporation. I am a forensic computer scientist with expertise in

the areas of cell tower analysis, computer forensics and electronic discovery.

2. I have a Master of Science degree in digital forensics and a graduate certificate in

computer forensics from the University of Central Florida. I have a Juris Doctor degree from

Florida State University and a Bachelor of Arts degree in management - human resources, from

George Fox University. I have completed more than 500 hours of training in computer and cell

phone forensics.

3. I am an attorney licensed in Florida and Oregon. Prior to founding Forensic Data

Corporation, I was a labor and employment attorney from 2007 to 2013.

4. Prior to attending law school, I spent nine years with the Douglas County (OR)

Sheriffs Office from 1995 to 2004.

5. I have analyzed cell tower records in approximately 250 cases. I've conducted

computer and cell phone forensics examinations more than 200 times. I've been recognized as an

expert in the areas of cell tower analysis and computer and cell phone forensics , and provided

expert testimony in trials and adversarial hearings approximately 35 times in Florida, Georgia and

Michigan.

6. On November 29, 2017, I conducted a forensic examination of a cell phone

belonging to Senator Jack Latvala at the offices of attorney Steven Andrews.

7. Senator Latvala gave me a turquoise iPhone SC (Serial #F78LVGRHFFHL) and

showed me a thread containing messages with another user identified as "Rachel." I used the

phone's touch display to view the contact details for user "Rachel," and noted that the phone

number was "(850) 228-8505."

8. I noted that while the messages stored in the phone were stamped with the time and

day of the week, no information identifying the date, month or year the messages were sent or

received was visible on the phone's display. I'm aware that even though that information wasn't

visible on the display, that it could be recovered via forensic analysis.

9. I connected Senator Latvala' s iPhone to my notebook computer and extracted the

phone's data using Cellebrite Physical Analyzer ver. 6.0.1.10.

10. I conducted a search of the chats for the phone number "(850) 228-8505". I found

approximately 140 messages between Senator Latvala's phone and "(850) 228-8505." I noted that

the Cellebrite forensic software correlated the phone number "(850) 228-8505" with the contact

information for "Rachel Perrin Hughes" and automatically labeled the conversations with her

name.

11. I generated a report of the message thread containing the messages between

Sentator Latvala' s phone and "(850) 228-8505," purportedly belonging to Rachel Perrin Hughes.

A copy of that report is attached hereto and incorporated herein as "Exhibit A."

12. I reviewed the report of the message thread and compared it to the messages stored

in Senator Latvala's phone by using the phone's touchscreen display to scroll through the stored

messages. The messages contained within the report are consistent with the messages stored

within Senator Latvala' s phone.
