Terms and Definitions of Probate Law

Probate: In regards to the proving and establishing the authenticity of a will

Estate: The property of a person

Intestate: In regards to when someone dies without a proper will

Decedent: The person who has died and whos estate is being transferred

Real Property: Real estate, property that is in a fixed location, such as buildings or

homes.

Personal Property: Property that can be moved, examples include jewelry, animals, cars,

and furniture.

Separate Property: Property acquired while a couple is not married. Also property

inherited by one spouse during marriage.

Community Property: Property acquired by a couple while married, not including

property inherited by one spouse.
