ANTE-NUPTIAL AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement is made and entered into by and between:

John Calvo, of legal age, Filipino and a resident of Brgy. Zone 1, Digos
City, Davao del Sur, and -

Rhea Olaivar, likewise of legal age, Filipino and a resident of Brgy.


Zone 1, Digos City, Davao del Sur,

- witnesseth -

WHEREAS, the parties hereto were married in civil rites on January 6,


2017 in Digos city, Davao del Sur.

WHEREAS, the parties hereto have properties of their own acquired


before their marriage to each other and, because of the origin of the said
properties, the parties hereto desire that their respective properties remain
as his and her own solely.

WHEREAS, the particular property referred to herein is that property


described as a portion of that parcel of land covered by Transfer Certificate
of Title No. 4252-1243 of the Registry of Deeds for Digos City containing an
area of SIXTY FIVE (65) SQUARE METERS, more or less, which the parties
hereto acquired by way of sale from the exclusive paraphernal funds of
RINA M. BABIA;

WHEREAS, for the foregoing reasons, the parties hereto desire to fix
and determine the respective rights and claims of each in and to the estate
and property of each other, and to accept the provisions of this Agreement
in lieu of and in full discharge, settlement and satisfaction of all such rights
and claims, and the parties hereto do hereby agree under this Ante-Nuptial
Agreement that the property relations between them as husband and wife
during their marriage shall be a regime of SEPARATION OF PROPERTY under
the New Civil Code of the Philippines, as amended by Executive Order No.
209, otherwise known as the Family Code;

WHEREAS, pursuant to the said Regime of Separation of Property, the


parties hereto do hereby agree that:

1. Each spouse shall own, possess, dispose of, administer and enjoy
their individual rights over their respective and separate estate or property

with need of consent from either spouse, and to each shall belong the
fruits, natural, industrial or civil, due or received during their marriage from
their respective and separate properties, provided, however, that the
earnings of each spouse from their respective profession or industry shall
be considered conjugal property of the marriage;

2. All properties received by way of donation or inheritance,


including all the fruits or interest derived therefrom, shall constitute the
separate and individual properties of each spouse;

NOW, THEREFORE, for and in consideration of the foregoing and the


solemnization of the marriage of herein parties, and of the covenants
herein contained, the parties hereto do hereby sign, execute and
acknowledge this ANTE-NUPTIAL AGREEMENT, this 1st day of January at
Digos City.
