Dear Mayor Selby and Chief Roberts:

This letter is a formal request for the Olympia Police Department to once again take an active role in the
removal of the trespassers on the rail line into the Port of Olympia, as requested by the owner of the
property, Union Pacific Railroad. Over the last several days, trespassers have occupied this active rail line
and ignored requests by railroad employees to leave the site.

The Olympia & Belmore Railroad provides rail freight services over this line to customers located in the
Port and in Tumwater who are in jeopardy of being forced to idle their plants due to the inability of the
railroad to serve their facilities. The people who are blocking the line are supposedly protesting various
concerns, but they are knowingly trespassing on private property. This is resulting in:

An unsafe environment: These trespassers are once again endangering railroad employees
attempting to provide freight services to companies located within the Port of Olympia and in
Tumwater by interfering with normal railroad operations. Additionally, these trespassers are
exposing themselves to possible injury by occupying active railroad property.

Growing financial hardship: As a result of the inability of the Olympia & Belmore Railroad to
provide required freight services to its customers in the Port of Olympia and in Tumwater, a
number of customers have indicated that their facilities will need to be idled within a few days if
service is not restored. The impacted rail customers that have nothing to do with the concerns of
the protesters could be forced to send employees home during the inactivity.

Restraint of interstate commerce: By preventing rail access to the Port of Olympia and to rail
customers located outside of the Port, the trespassers are depriving the companies at the Port use
of rail freight services. Under its federal common carrier obligations, Olympia & Belmore
Railroad is required to provide rail freight services to these customers and is now unable to do so.

For these reasons, I respectfully request the City and its police force fulfill the request by Union Pacific
Railroad for assistance in removing the illegal trespassers off of the rail line to the Port of Olympia. While
I respect the right of any citizen to conduct a peaceful and legal protest, doing so on an active rail line is
completely inappropriate and cannot be ignored.
