COMPLAINT AFFIDAVIT

I, ERWIN A. SALVA, of legal age, married, Filipino and a resident of

Barangay II, Tanjay City, under oath, hereby aver the following facts that:

1. I am a confidential agent of Criminal Investigation and Detection

Group, PNP Province of Negros Oriental, Negros Island Region,
Dumaguete City, hereto attached as Annex A and forming part of
this complaint affidavit is a certificate of commendation issued by
Criminal Investigation and Detection Group Region 18 Criminal
Investigation and Dectection Group;

2. On November 10, 2016, I was very much surprised receiving a

subpoena/order/letter message from Barangay Captain REYNALDA
G. CUECO of Barangay Novallas, Tanjay City, Negros Oriental,
demanding my presence on November 11, 2016 at the Barangay Hall
of Barangay Novallas, for a conference regarding an alleged
Philippine Drug Enforcement Agency (PDEA) Drug List, copy of said
subpoena/order/letter is hereto attached as Annex B to form part of
this complaint affidavit;

3. The conference was intended for alleged personalities involved in

illegal drugs within the jurisdiction of Barangay Captain
REYNALDA G. CUECO of Barangay Novallas, Tanjay City;

4. Barangay Captain REYNALDA G. CUECO made it appear, on her

own personal volition, that the Philippine Drug Enforcement Agency
(PDEA) is going and will conduct a conference on PDEA Drug List at
their Barangay Hall on November 11, 2016 at 9:00 oclock in the
morning;

5. Barangay Captain REYNALDA G. CUECO falsely, without any

basis in fact or in law, sent demand/invitation to me that a conference
on PDEA Drug List will be conducted at their Barangay Hall on
November 11, 2016 at 9:00 oclock in the morning, which PDEA
Provincial Office, Negros Oriental, disproved through a certification
issued dated November 21, 2016 copy hereto attached as Annex C
forming part of this complaint affidavit;

6. Being a resident of Barangay II, Tanjay City, I am not a constituent of

Barangay Novallas nor am I involve in any illegal drugs and such
letter invitation/subpoena addressed to me by the Barangay Captain
Reynalda G. Cueco, shows with all false assumption of facts that I am
an illegal drugs personality in her barangay for which I am not a
constituent nor a resident thereof;
 7. That the falsity of the actuations or actions of Barangay Captain
Reynalda G. Cueco sending such subpoena/order/invitation to herein
complainant thru her Barangay Tanods, alleging therein falsely that
PDEA Negros Oriental is to conduct a conference on PDEA Drug
Lists at Barangay Novallas, City of Tanjay, is a clear ABUSE OF
AUTHORITY, GRAVE MISCONDUCT OF OFFICE as a
Barangay Captain, propounding FALSE information, MALIGNING
herein complainant without any basis, NEGLIGENCE in
disseminating information to the damage and prejudice of herein
complainant, conduct unbecoming of a barangay official, which the
Honorable Body should take cognizance and take the necessary
administrative sanctions equitable under the premises.

8. Complainant respectfully prays that this COMPLAINT be given due

course and an ADMINISTRATIVE INVESTIGATION be conducted
by the Honorable Body and such administrative sanctions be enforce
against the erring Barangay Captain REYNALDA G. CUECO.

ON OATH, I hereby declare that I am the complainant in the Affidavit

of Complaint; That the contents thereof are understood by me and that the
same are true to my personal knowledge and based on authentic records.

That I hereby certify that:

a. I have not filed or commenced any other action or proceedings

involving the same issue in the Supreme Court, the Court of Appeals,
Regional Trial Court or any other tribunal or agency;
 b. To the best of my knowledge, no such action or proceeding is pending
in the Supreme Court, the Court of Appeals, Regional Trial Court or any
other tribunal or agency;

c. Should I later on learn that a similar action or proceeding has been

filed or pending in the Supreme Court, the Court of Appeals, Regional Trial
Court or any other tribunal or agency, that I undertake to report that fact
within five (5) days there from to this Honorable Sangguniang Panlungsod.
