SUBJECT : THIS PERTAINS TO A LETTER OF COMPLAINT SUBMITTED IN THE


OFFICE OF THE BUKIDNON ENVIRONMENT AND NATURAL RESOURCES REGARDING
THE ON GOING ILLEGAL MINING LOCATED AT PUROK 9, BARANGAY 1, MALAYBALAY
CITY, BUKIDNON.

PRELIMINARIES:

The Office of Bukidnon Environment and Natural Resources (BENRO) has


received a complaint letter submitted by the Punong Barangay Hon. Cromwell Kiril D.
Dinlayan of Barangay one, Malaybalay City this province dated March 3, 2016. This
pertains to the alleged illegal mining that occurred in which the parties involved were
private persons who, accordingly, were from Valencia City. According to one of the
barangay kagawad Datu Arthur O. Melendez, who was present during the conduct of the
investigation, the latter said that the alleged illegal mining operation, which was conducted
by the members of tribal community headed by a Certain Datu Ganancia, IP mandatory
representative of Barangay Indalasa, Malaybalay City, Bukidnon, in which under the
Philippine mining law, it prohibits such operation.

FINDINGS AND OBSERVATIONS:

Based on the complaint letter submitted by the office of the barangay Chairman of
barangay one; that during the conduct of the investigation, it was shown that the allegation
of illegal mining in the above mentioned area was all true
.

RECOMMENDATION:

1. The BENRO, recommended that this matter should be forwarded/handed to


the office of the Provincial Governor, Hon. Jose Ma. R. Zubiri, Jr., for final
decision.
