The undersignedis directedto statethat this DepartnenthasissuedO.M. of even

numberdated13.04,2010 thatif anemployeeis to be considered
for promotionin a future
DPC and his ACRs prior to the period 2008-09 which would be reckonablefor
assessmentof his fitnessin suchfunue DPC containfinal gradingwhich are below the
benchmarkfor his next promotion,beforesuchACRs are placedbefore the DpC, the
concernedemployeewill be givena copyof the relevantACR for his representation, if
any,within 15 days of suchcommunication.The representation is to be decidedby the
competent authorityasper provisions
in para2 of aforesaid

2. The Hon'ble SupremeCourtin theirjudgementdatedI2.05.2008in Civil Appeat

No. 763lof 2002(Dev Dutt vs Unionof India)hadheldthatthe 'good' enfy in tfreeCR
of the appellantwhich had not beencommunicated to him ana consiaeredin a pastDpC
which found him unfrt for promotion,shouldbe communicated for representation
and if
upgradationis allowedby thecompetentauthority,he shouldbeconsidlredfor promotion
retrospctivelyby the DPC. When the petitionsin SLP (Civil) No. 15770ij009,now
convertedto AppealCivil No. 2872of 2010(Unionof India vs. A.K. Goel& Ors.)were
calledfor hearing,the SupremeCourthastakennoteof the apparentconllict betweenthe
decisionsof the Hon'ble Court in Dev Dutt caseon one hand ana the judgemetnsof
SupremeCourt in SatyaNarain ShuklaVs UOI 2006 (9) SCC 69 and K-M. Mishra vs.
CentralBank of India & Ors. 2008 (9) SCC 120on the other handand by their Order
dated29.03.2010, the Hon'bleCourthasreferredtheseappealsto a LargerBench(copy
