RESOLUTION

Cecille Ardoze y Tan and Alice Ardoze y Tan alleged1 that at


about 10:00 oclock in the evening of June 29, 2017, a drunk Ronaldo
Ardoze, complainants brother, caused some ruckus. He caused some
damage to the pedicab of the complainant with a knife. From fear of
further destruction of his property, complainant decided to put a stop
to his rampaging brother. An attack coming from the drunk assailant
connected to complainants arms upon the latters exit from his abode.
Medication was conducted to complainants wounds.

Respondent is liable under Article 266 paragraph 1 of the Revised


Penal Code which provides:

The crime of slight physical injuries shall be punished: By


arresto menor when the offender has inflicted physical injuries
which shall incapacitate the offended party for labor from one
to nine days, or shall require medical attendance during the
same period.

As the respondent was properly and validly arrested and turned


over by the barangay tanod to the responding police officer, herein
inquest prosecutor finds probable cause for the filing of an information
against her.

WHEREFORE, premises considered, finding probable cause it is
respectfully recommended to the Honorable City Prosecutor that an
information be filed against herein respondent for Slight Physical
Injury with the Municipal Trial Court in Cities, Naga City.

SO RESOLVED.
