Eric Bueno Serial # 00037 Your affiant presents the following facts in establishing probable cause for the arrest ofthe suspeat for the listed offense: On September 8, 2017, at approximately 7:29 am, the Denver 911 Call Center received a call from a frantic female caller, later identified as QIN, cob: @NP983. Mrs. HNN said her 16- year-old daughter had just delivered a baby. IMrs. QUIEN said the baby was on the ground in the back yard of their residence and the baby looked dead, Denver Health Paramedics along with Denver Police Officer Jared Feher, 05028 responded to SSQIPN. Biscay Street, City and County of Denver and contacted Mrs. SB and her daughter, Alaya Dotson, dob: 08/25/2001. Mrs. (8 husband, aap ‘GEEBB wes also at the location. The baby was transported by ambulance (o Children’s Hospital in Aurora, Colorado and Alaya Dotson was transported to University Hospital, Detectives Bruce Gibbs, 95047 and Eric Bueno, 00037 were advised of the incident and assigned the investigation. Detective Gibbs responded to the scene while Detective Bueno responded to Children’s Hospital in Aurora, Colorado. At approximately 8:54 a.m., Detective Bueno arrived at Children’s hospital and contacted the staff in the emergency room. Detective Bueno teamed that at approximately 8:06 am., the ambulance ‘transporting the baby arrived at Children’s Hospital. Dr. Elizabeth Moran M.D. (Resident Physician) began treating the baby and ultimately removed a rock (approximately 1 inch in diameter by % inch in height) from the baby's lodged in the baby's throat. At approximately 8:16 am., the attending. physician, Dr. Tim Givens M.D. pronounced the baby deceased. Mrs. Ql and Mr. G08 were transported to Denver Police Headquarters by Denver Police Officers where they were interviewed by the assigned detectives. At 11:06 a.m., Detective Bueno interviewed Mrs. SHIR who said she knew her daughter, Alaya Dotson was sexually active and believed she has sex with her ex-boyfriend two times in 2016, possibly September. Mrs, (ENNNB said in June of 2017, others had asked if Alaya was pregnant due to the size and shape of her belly. Mrs. ‘MN asked Alaya if she was pregnant but she said no and had normal periods every month. During the early morning hours of 09/08/2017 at about 6:00 a.m., Mrs. QI said she woke, realized Alaya had called her earlier that morning. Mrs. ‘MENNIM checked on Alaya, and found her in the bathroom complaining of cramping, Mrs. SNM gave Alaya Advil and heard her run the water to take a bath. At about 6:40 a.m., Mrs. {NINN woke her other children to get ready for school. Mrs. (NEB again checked on Alaya and found her laying on the floor in her bedroom, Mrs. (@lmm said she went to her room and laid down while the kids were getting ready. Sometime later, Mrs. SBN got up and went downstairs and realized Alaya was sitting outside on the patio in the backyard with a blanket wrapped around her. Mrs. (NNN briefly spoke to Alaya and went back inside to make her some soup. When Mrs. (NNN went back outside with the soup, she found Alaya laying down on the patio and noticed the she no longer had the blanket wrapped around her. According to Mrs. QHINMID, she told Alaya to get up from the ground and sit down on the chair. When Alaya stood up she noticed a lot of blood on Alaya’s shirt. Mrs. QRH then went toward the blanket because sheNoticed blood on the blanket but Alaya picked it up first and said she needed to wash it. Mrs. Sm ‘then went and grabbed the blanket from Alaya and the baby fell to the ground. Mrs. Samm said she was in shock and asked Alaya what was going on. Mrs. glum said Alaya picked up the baby by her arm and said she’s dead. Mrs, damm said Alaya began walking away and then walked back toward the patio and dropped the baby on the ground. Mrs. Q@JNNRB said she ran into the house and told Mr. about the baby and then called 911. At approximately 2:15 p.m., Detective Gibbs, Detective Bueno, and Mrs. NNN responded to University Hospital to meet with Alaya Dotson, dob: 08/25/2001 at University Hospital, At approximately 3:14 pm. Detective Bueno advised Alaya Dotson of her Mirands Righis in the presence of Mrs. QI) Mrs. Q@lNEand Alaya talked privately about her rights and the situation. Alaya Dotson understood her rights and voluntarily waived them and agreed to make a voluntary statement. Mrs, 409 also understood Alaya’s right end agreed with her decision to make a statement. Alaya explained she has sexual intercourse with her ex-boyfriend on two occasions. Alaya said the last time she had sexual intercourse was in November 2016. Alaya recalled her mom asking if she was Pregnant in June of 2017 and she noticed her stomach felt firm. Alaya said she continued to have a regular period and she did not know or believe she was pregnant. When asked specifically about the events leading up to delivering the baby, Alaya said she got off work at about 10:30 and went to sleep around 12:30 a.m, or 1:00 a.m. on 09/08/2017/ At about 3:00 or 4:00 a.m., Alaya woke up and her stomach hurt. Alaya said she got up and eventually went and took a bath, At one point, Alaya said she felt as though she had to poop but she couldn't. Alaya then said she sneezed and coughed at the same time and she noticed a head coming out of her vagina. The baby eventually came out and she was just holding her in her arms. Alaya then went to her bedroom and was lying on the floor with the baby tight next to her, Alaya said the baby's arms were moving back and forth but she was not crying, Alaya said her mom was telling the other kids to get ready for school and she went downstairs. Alaya said she sat outside on the cement patio with a blanket wrapped around her as she held the baby in her arms. Alaya said her mom came outside and startled her and the baby fell out of her arms and onto the ground. ‘When Alaya's mom went back inside the house, she decided to pick up a rock that was on the ground ‘and-put it inside the baby's mouth. Alaya then said she pushed the rock down the baby’s throat with hher thumb. Then Alaya wrapped the baby in the blanket and set her down on the ground. Shortly after, Alaya said her mom came back outside and so she picked up the blanket and the baby.
