The Constitution of The Unified Territories of the
Humanitarian Republic of Something
The following document was drafted and approved by the now sovereign peoples of the Unified Territories of the Humanitarian Republic of Something as both an outline of government and a declaration of independance. In order to better amuse its founders and citizens with the trappings of statesmanship and to promote understanding, cooperation, creativity, and humour.
Article 1 - The Purpose of it all
1) The Republic exists to fulfil the following purposes a) To provide a source of entertainment for its citizens through the very nature of the project and through the community it builds. b) To create a micronational society where its citizens can interact with the government and affect the course of the nation. c) To build a community of fun, creative, enjoyable, and slightly silly people. d) To promote equality, inclusivity, cooperation, creativity, ingenuity, knowledge, and humour.
Article 2 - The Workings and Role of the Government
1) The Grand Council a) The Grand Council is the legislative body of the Republic. The laws passed by the Grand Council are enforced before and above all laws passed by lower, localised councils and constitutions. b) Grand Councilors are elected by the territory of which they are a citizen of and represent. Upon election they receive the title of Lord/Lady Councilor until the end of their term or removal from office. c) No more than Two Counselors per territory are to be seated at the Grand Council during any one term. d) No candidate will be barred from being elected to the Grand Council based on Age, Creed, Gender Identity, Ethnicity, or Sexuality. However all candidates must be elected knowingly by the citizens which the represent. e) Each Councilor serves a four year term after which the whole of the council is vacated and seats are put to election. A councilor may additionally run for reelection and serve one additional term in office. No Councilor may serve more than twice unless circumstances make it impossible to elect another. f) No Councilor may serve as an official of any other micronation during their term. g) In the event that a Councilor is no longer able to fulfil their duties whether due to personal issues or removal of office, a temporary councilor is to be elected by the Grand Council to take over the responsibilities of the office until an election can be held to properly replace the seat. h) A Councilor elected to the Grand Council due to the removal or resignation of another Councilor is to serve the remainder of the former councilors term. This period in office does not count against the new Councilors term limit if the newly elected councilor serves less than half the original term. i) One Councilor is to be selected from among the currently seated Grand Council at random to serve as Archon of the Grand Council. The Archon is to mediate and moderate discussion, activity, and voting. Further details on the Archon to follow in Section 2b j) Powers of the Grand Council i) Coin Money ii) Pass and Amend Laws iii) Regulate the ownership of weapons iv) Approve and regulate the national budget v) Other powers may be assumed by the Council as the need arises k) When the Grand Council is called to a vote, it is customary and legally required to serve tea prior to voting. 2) The Archon a) The Archon is selected at random by a web-browser RNG from the current councilors seated. They will maintain their position as Councilor and the responsibilities that come with the office as well as the responsibilities of the Archon. b) The Archon is to moderate all discussion and activity within the Grand Council, call motions to vote, and maintain a log of all motions proposed and passed. c) If a deadlock occurs during a vote within the Grand Council the Archon receives one additional vote to break the tie 3) The Triumvirate a) The Triumvirate is the elected head-of-state made up of three Triumvir elected by the citizens of the Republic. b) Upon being elected to the Triumvirate each Triumvir ceases to represent their home territory in favor of representing the whole of the Republic. The Style of Office for both current and former Triumvir is His/Her/Your Excellency or Lord/Lady Triumvir. c) The powers of the Triumvirate are as follows i) Each Triumvir receives a single vote to be used in passing laws in the Grand Council ii) The Triumvirate appoints Ministers who are then approved by the Grand Council through basic majority. iii) The Triumvirate may create or disband a ministry as their necessity arises d) Candidates for the position of Triumvir must meet the following requirements in order to serve office i) Each Triumvir must have been a registered citizen of the Republic for 1 year prior to election. This prerequisite does not take action if no citizens meet the criteria. ii) A Triumvir may not be serving as an official in any other micronation e) Triumvir of the Triumvirate serve for a term of Five years with the possibility of reelection for one additional term f) The Triumvirate may propose a declaration of war to the Grand Council which must be passed with a 3/4 +1 Majority g) All executive actions taken by the Triumvirate are to be made with the support of at least two of the three Triumvir, and the entire Triumvirate must be aware of all actions taken. 4) Emergency Powers a) In times of crisis due to war, pandemics, natural disasters, or other situations that threaten the stability and safety of the citizens Emergency Executive Power may be bestowed upon an elected member of society. b) The powers of this elected official shall be as follows. i) Commander in Chief of all military ii) Executive orders that may take effect without vote of the Council so long as it is done in clear benefit of the Republic c) Once the crisis has ended executive power must be returned to the Triumvirate if their term has yet to conclude or given to a newly elected triumvirate if the term has expired. 5) The Areopagus a) The Areopagus is an council made up of the previously elected Triumvir and acts as an advisory council to the current Triumvirate. b) The Areopagus serves at the pleasure of the Triumvirate and holds no executive, legislative, or judicial power. c) Triumvir who are removed from office due to crimes against the Republic or its people, or otherwise dishonorably stepped down are not to be made members of the Areopagus. i) Actions deemed irresponsible, dangerous, or otherwise threaten National security or the safety of the citizens are all reasons for removal of office d) The Areopagus during times in which emergency executive power holds the authority to remove the official from his position and restore or demand the reelection of a new triumvirate. e) If a period occurs where there is no currently seated Triumvirate, and and election has not been held three members of the Areopagus are too be selected by random lots to hold executive powers until a new Triumvirate can be selected. 6) The Supreme Court a) The Supreme court of the Republic is to be the highest judicial authority and is to be made up of Justices elected by the citizens of the Republic. b) There are to be no less than three Supreme Justices at any one time c) lower local provincial courts must adhere to all rulings decreed by the Supreme Court. In the event a local ruling or law conflicts with greater Republic law or Supreme Court Ruling, the latter rules out over the former. 7) Elections and Voting a) The Citizens are to elect both Councillors to the Grand Council and prefects to the Triumvirate. These elections are performed using Single-Transferable-Voting explained as follows i) Each Citizen will receive a ballot of viable candidates for the office in question ii) Each Citizen is to select the candidates they wish to hold the office by numbering them in order of preference. (1) Number 1 for first choice, number 2 for second and so on, until each desired candidate is numbered. (2) Citizens are not required to order all available candidates if the do not want to, though a more thorough ballot ensures a more accurate election. (3) Ballots are counted in random order to assure a more fair vote transfer process iii) A quota is determined representing the number of votes a candidate requires to gain the office being elected. The Quota is determined using the following equation (1) Votes needed to win = [valid votes cast/(seats needed to fill +1)] +1 iv) When a candidate reached this quota they are granted the office they were elected to. Any excess votes for the candidate above the quota are transferred to the other viable candidates based on the voters next preferred candidate after those candidates that have already won an office. v) If none of the candidates, or too few of the candidates meet the quota, the candidate with the least amount of votes is eliminated and those votes are transferred to each voter's next preferred choice vi) This process continues until all positions are filled in the case of the Grand Council two councilors are selected, in the case of the Triumvirate, three prefects elected. b) On Law Making i) The Grand Council proposes and passes laws ii) Each law begins as a motion proposed by a member of the Grand Council, in order for the motion to be called to vote it must be seconded by another Councillor. iii) Each motion is to be determined as either a minor or major law. If in a 1/3 +1 vote the council rules a motion to be major, then the laws regarding the passing of major laws is put into place. Amendments to the constitution are always major (1) Minor laws must win a simple majority, 1/2 + 1 Grand Council votes (2) Major laws must win by 2/3 majority +1 Grand Council votes iv) Ministerial appointments must pass simple majority v) In all circumstances an abstained vote including those votes due to absense to not count against the majority. Meaning a majority is dependant on votes cast not the total seats. vi) In regards to Major Laws the entire council must either cast a vote or willingly abstain, absences will not count as abstentions. c) On Removing and Official from Office i) Any government official within the Republic may be removed from office under the following circumstances ii) A Triumvir of the Triumvirate may be removed following a 3/4 +1 majority vote in the Grand Council and substantial evidence that the Triumvir in question was acting in violation of the constitution or against the wellbeing of the Republic or its citizens. iii) A Grand Councilor may be removed from office following a petition from that councilors given constituents with a number of signatures equal to 1/5 that territorys population. The Grand Council must then call a vote to remove the councilor from office which must pass at 2/3 + 1 majority iv) A minister may be removed from office if the Grand Council rules them unfit or unable to fulfil the offices duties. This must pass with a 1/2 +1 majority vote. v) In any event an official is removed from office an election must be held within one month of the removal to ensure the continued working of the government. (1) Those new officials elected to fill vacant offices mid-term are to serve the remainder of the original term before reelection. This term does not count against the new officials term limit if they serve less than 1/2 of the original term.
Article 3 - The Rights of the Citizens
1) The Rights of Citizens a) Above all, and as a standard for all laws within the Republic, all citizens have the right to pursue their own interests, so long as that interest is not detrimental to the Republic at large, or bring physical, mental, emotional, or economic harm to another. b) All Citizens will have the following freedoms i) Freedom of Speech; No citizen shall be censored in speech, writing, audio-visual media or internet media insofar as their message does not contain libelous statements, direct threats, or direct calls to action to bring physical, emotional, economic or social harm to an individual, ethnic group, social class or group of individuals. ii) Freedom of Assembly; No citizen shall be banned from Assembling peacefully in a public space. Acts or threats of physical violence, as well as hindering other citizens lives and rights will forfeit the assembled groups right to assembly at that time. iii) Freedom of Religious Practice; No citizen shall be discriminated against based on personal religious belief or philosophy. The Republic is a secular society, and its laws and constitution are held above any rule or law dictated by a persons faith of belief. iv) Freedom of Movement; No citizen shall be restricted in movement in and out of the Republic. Owners of personal property hold the right to restrict entry into their property. (1) Im calling this the No you cant just walk into my house clause (2) In the case of quarantine against disease the right to freedom of movement may be restricted by national government following a consensus from an independent health organisation c) All citizens will receive basic human rights as recognized by the United Nations d) All citizens are equal in the eyes of law regardless of Age, Gender Identity, Religion, Sexuality, Ethnicity, Species, External Features, Internal Features, or Planet of Origin. No one person or ground of people shall be put above another e) No law or amendment to the constitution shall infringe on the basic rights listed above no matter the circumstance or crisis the Republic finds itself in 2) Citizenship and Territories a) All who wish to become citizens of the republic must be willing to respect the laws of the Republic and the basic rights of their fellow citizens. Each new citizen must register as a citizen of an established territory of the Republic. i) Citizens are not required to immigrate to Republic territory but may only be registered to one territory for purposes of elections. ii) Citizens may at their own will pledge their territory to the Republic in order to help the nation expand to the far reaches of earth and space. iii) Approval of Citizenship must come from both the Ministry of Immigration on the National level, and the approval of the localised territorial government. b) Citizens of a given territory have the right to the creation and maintenance of localised government and minor councils so long as the laws of the whole Republic and the Constitution are respected and honoured. c) To remain a citizen of the Republic one must participate in the Republic Census. This can simply be an acknowledgement of continued citizenship and does not require the offering up of personal information. d) The territories currently claimed and pledged to the Republic are as follows i) Ned Territory, located in southern California ii) Spaghetti Cove Territory, located in Massachusetts iii) Skeleton Fortress Territory in Australia. e) New territories may be established with approval from the Grand Council and a petition from the citizens wishing to establish the new territory. A number of signatures will be required to demonstrate a decent population, the exact number required will be determined based on the current population of the Republic as a whole and the number of currently established territories. 3) Additional Laws and Regulations a) Vaccinations are mandatory within the Republic. All citizens including children must be vaccinated against all serious diseases as dictated by the national government. i) Those who suffer from severe reactions to vaccinations as determined by medical professionals are considered exceptions to this law. ii) Refusal to vaccinate may result in restriction of movement or quarantine to protect the citizens. 4) Trial and Punishment a) All Citizens have the right to a fair trial before their peers as well as the right to an attorney if they cannot afford one themselves. b) All who commit crimes against citizens of the Republic are to be tried by the nation within which the crime was committed. The trial will be as fair and equal as though it had been committed by a citizen of the Republic. c) All sentences and punishments for criminal acts are to be proportionate to the crime committed and may not exceed the severity of the crime itself d) The death penalty is forbidden. No one holds the right to take another life, not citizens, not the state.
