Atty. Joel Agra entered his appearance as counsel for the accused and Prosecutor Janete Garcia for the People.
The prosecution manifested to the honorable court
that the parties in this case already entered into a settlement and that the complainant wants the case to be dismissed.
Prosecutor Garcia called the complainant to the
witness stand. The witness then has sworn to the People of the Philippines truth nothing but the truth to the honorable court. -vs- Lory S. Diaz Prosecutor Garcia asked the complainant if she is the For Slight Physical Injuries same person as Ms. Mabborang, the private (Presiding Judge: Hon. Norman complainant in this case who filed a complaint for Ganac) Slight Physical Injury against the defendant, Ms. Lory OCTOBER 24,2017 Diaz. The complainant answered on the affirmative.
Prosecutor Garcia asked the complainant if she still
have something to say before the honorable court and she replied that she wants the case to be dismissed since both parties have already entered into a settlement.
Prosecutor Garcia then asked the complainant
whether or not somebody coerced and forced her to cause the dismissal of the case and the latter answered on the negative.
Prosecutor Garcia further asked the complainant if
she understands that if this case be dismissed permanently, she can no longer refile the same. The Complainant answered on the positive
Considering the testimony of the complainant,
Prosecutor prayed before the Honorable Court for the immediate dismissal of the complaint.
