Schedule 2: Dispatch Protocol/Guidelines

The Parties acknowledge that the current Dispatch Protocol/Guidelines is


subject to revisions or amendmentsfrom time to time, which shall form integral
parts of and bedeemed incorporated in this Agreement.

ANCILLARY SERVICES GUIDELINES

A. NOMINATION OF ANCILLARY SERVICE

Non-firm

1. Submission by the Service Providerof Day-ahead Ancillary Services (AS)


capacity nominations per type of service to NGCP shall be on a per unit
basis not later than 2:00pm of:

a. Weekdays for the next day nomination, except Friday


b. Friday for Saturday, Sundayand Monday
c. Working Day before Holiday until the next working day

2. Submission by NGCP of Notice of Ancillary Services Schedule (NASS) shall


be made not later than 5:00 pm to the Service Provider.

3. Whenever deemed implemented, all day-ahead nomination and approvals


shall be made electronically thru web facility provided by System Operations-
NGCP. In case web facility is not available, fax or email shall be used.

Firm

1. Declaration by the Service Provider of available capacity should be


submitted to NGCP -System Operations day-ahead not later than 2:00pm
based on available generating units and/or the existence of any of the
circumstances set forth in item 1 (Firm) of Section C (Ancillary Services
Scheduling) below:

a. Weekdays for the next day nomination except Friday


b. Friday for Saturday, Sunday and Monday
c. Working Day before Holiday until the next working day

2. Submission by NGCP of Notice of Ancillary Services Schedule (NASS) to the


Service Provider shall be made not later than 5:00 pm.

3. Whenever deemed implemented, all day-ahead declaration of available


capacity and approvals shall be made electronically thru web facility provided
by System Operations-NGCP. In case web facility is not available, fax or
email shall be used.

B. RE-NOMINATION OF ANCILLARY SERVICE

Non-Firm

1. Re-nomination shall be submitted by the Service Provider to NGCP and shall


only be approved due to outage or de-ration of a certain generating plant/s
providing ancillary services.

Such re-nomination shall not be approved if any of the following reasons


exist:

a. Non-compliance to dispatch instructions


b. Change in unit assignment except Regulating Reserve
c. Non-submission of Day-Ahead Nomination for a particular AS

2. Re-nomination may be required by the System Operator for any of the


following reasons:

a. Outage of Transmission Lines or Substation facilities that would


result to Line Constraints or Islanding operation
b. Reduction of generation availability/supply capacity of AS provider
c. Emergency security measures
d. Depleted or insufficient reserves
e. Unavailability or Tripping of a particular restoration highway for the
affected AS provider
f. Unavailability or Tripping of AS provider
g. Generation Deficiency exist
h. Critical Operating Reserve
i. Non-availability of Real time monitoring

3. The AS Provider shall be notified immediately through the issuance of the


revised NASS of any changes or revisions as a result of cancellation ofthe
approved AS Schedule due to any of the reasons as stated in Item 2 of
Section D.

4. The AS Provider shall be required to submit the request for re-nomination


through fax, email or web facilities.

5. The System Operator may opt to require the AS provider to synchronize the
generating unit for validation of the units availability prior to or upon approval
of the request for re-nomination.

6. Approval of the re-nomination for Regulating and Contingency reserves may


be granted only for the next interval as required by the system, provided it is
not traded to the Wholesale Electricity Spot Market (WESM).

7. The Contingency Reserve re-nomination, when approved by the System


Operator for the next interval, shall only be considered compliant if the
generating unit is synchronized to the system prior to or at the start of the
interval.

8. Dispatchable Reserve re-nomination shall be granted at least two (2) hours


for Luzon and Visayas (market-based), while one (1) hour for Mindanao (non

market-based), before the requested interval unless required by the system,


provided the generating unit is subject to its availability test as required by
the System Operator. Non-compliance of Dispatchable Reserve shall mean
cancellation of the whole day schedule.

Firm

1. Re-declaration of available capacity shall be submitted by the Service


Provider to NGCP and shall only be approved due to outage or de-ration of a
certain generating plant/s providing ancillary services and/or any of the
circumstances set forth in item 1 (Firm) of Section C (Ancillary Services
Scheduling) below.

2. Re-declaration of available capacity as required by the System Operator due


to any of the following:

a. Outage of Transmission Lines or Substation facilities that would


result to Line Constraints or Islanding operation
b. Reduction of generation availability/supply capacity of AS provider
c. Emergency security measures
d. Depleted or insufficient reserves
e. Unavailability or Tripping of a particular restoration highway for the
affected AS provider
f. Unavailability or Tripping of AS provider
g. Generation Deficiency exist
h. Critical Operating Reserve
i. Non-availability of Real time monitoring

3. The AS Provider shall be notified immediately through the issuance of the

D.

4. The AS Provider shall be required to submit the request for re-declaration of

of the request for re-declaration of available capacity.

6. Approval of the re-declaration of available capacity may be granted only for


the next interval as required by the system provided it is not traded in the
WESM.

7. In case of non-compliance of dispatch instructionsfor a given


interval,payment for such affected interval for RR and CR Ancillary Service
Feepayments for the subject billing period shall be subject to Clause 5.2
(Penalty).

8. In case of a tripping of a generator unit scheduled to provide ancillary


services (RR/CR) occurs, replacement of another available unit should be

performed at the soonest possible time to deliver the Firm Contracted


Capacity.

C. ANCILLARY SERVICES SCHEDULING

Non-Firm

1. The following are considered in the preparation of Day-Ahead Ancillary


Services Schedule (DAASS):
a. Daily submission of AS Providers operational data (i.e., unit
capability, reservoir elevation, fuel inventory, etc.)
b. Prolonged unavailability of SCADA system on a per unit basis
c. Reactive Power Support requirement of the system
d. Available restoration highways
e. Current system condition
f. Required level of reserve and nomination of the AS providers per
type of AS
g. Technical consideration (i.e., operating mode such as Free-Governor
and Automatic Generation Control (AGC) in order of priority) shall be
prioritized over commercial consideration (Merit Order Table)
h. Other consideration such as the Ancillary Services Procurement
Agreement (ASPA) and AS accreditation effectivity and expiration
dates, among others

2. The acceptance and scheduling of AS capacity nominations of a single


provider shall be made at NGCPs prerogative under the following order of
priority:
a. Regulating Reserve (RR)
b. Contingency Reserve (CR)
c. Dispatchable Reserve (DR)

3. The required level of Reserve for RR shall be based on the projected


demand.

4. The approval of the nomination of AS shall be based on the capacity and on


a per-unit per type of Ancillary Services.

5. In cases where the nomination is more than the required level, the operating
mode such as Free-Governor, AGC and Manual Control, and nominated
price (in the order of priority) shall be considered.

6. Least scheduled capacity of Regulating Reserve and Contingency Reserve


provider shall not be less than 20 MW for Luzon, 5 MW for Visayas, and 7
MW for Mindanao, on a per unit basis depending on the system condition.

7. Only when the Firm Contracted Capacity is not sufficient will the nominations
from Non-Firm Contracted Capacity be considered. The scheduling shall be
based on the technical considerations and least cost.

Firm

1. The Firm Contracted Capacity shall be scheduled first by NGCP before the
Non-Firm Contracted Capacity.The Firm Contracted Capacity shall be
scheduled at all times when declared by the Service Provider.

D. ANCILLARY SERVICES DISPATCH IMPLEMENTATION

1. In cases where the response of AS provider is delayed due to plants fault,


payment shall be subject to Clause 5.2 (Penalty) of this Agreementfor the
affected interval.

2. The following events could trigger the re-dispatch and/or cancellation of


approved AS schedule:
a. Outage of Transmission Lines or Substation facilities that would
result to Line Constraints or Islanding operation.
b. Reduction of generation availability/supply capacity of provider
c. Emergency security measures
d. Depleted or insufficient reserves
e. Forecast error Intra-hour Variations in Demand
f. Unavailability or Tripping of AS provider during the interval
g. Critical Operating Reserve
h. Non-submission of nomination and/or request for re-nomination
i. Non-compliance to dispatch instructions
j. Non-compliance to required scheduled nomination
k. Non-availability of real time monitoring except the current RR prior to
the incident provided it would operate on free-governor mode for all
throughout the interval/s.
l. Non-availability of the unit prior to or at the start of the interval

3. The following events will mean automatic cancellation of approved AS


schedule except Regulating Reserve Services:
a. Market Intervention
b. Generation Deficiency exists
c. Implementation of Manual Load Dropping
d. Unavailability or Tripping of a particular restoration highway for the
affected AS provider
e. Total System Failure except Black-start Service schedule of the
provider.
f. Force majeure

NGCP shall inform the Service Provider of the automatic cancellation of the
approved AS Schedule promptly when the cancellation occurred.

E. REGULATING RESERVE SERVICES

1. Whenever the Regulating Reserve provider is operating on free-governor or


AGC mode, the AS provider shall ensure that the unit shall be made
available from the start until the end of the interval.

2. Regulating Reserve provider when in free-governor operation, shall not


override the Free Governor Control mode of operation.

3. In case of failure of AGC function, the current Regulating Reserve provider


shall automatically operate on a free-governor mode for both certified as
primary and secondary response.

4. Failure of Regulating Reserve provider to provide service within the interval


shall be declared non-compliant and payment shall be subject to Clause 5.2
(Penalty) and scheduled capacity for the succeeding intervalsshall be
cancelled.

5. If AS Provider failed to comply with the dispatch instruction, the payment


shall be subject to Clause 5.2 (Penalty) and scheduled capacity for the
succeeding intervals shall be deemed cancelled.

6. Any request for the change of unit assignment for Regulating Reserve shall
be subjected to the assessment by the System Operator prior to approval.
Non submission of request for re-nomination shall mean non-confirmation of
the request for change in unit assignment.

7. Whenever the Regulating Reserve is depleted as a result of what is stated in


Item 2 of Section D of the AS implementation or as required by the system,
the Contingency and/or Dispatchable reserves shall be dispatched.

F. CONTINGENCY RESERVE SERVICES

1. The System Operator shall make sure that Contingency Reserve provider is
synchronized to the grid as generator (w/ at least 5MW load for market
based) and the AS provider shall respond automatically and/or immediately
follow instruction when called upon without delay.

2. The following conditions shall trigger the utilization of Contingency


Reserves:
a. Generator tripping or a loss of single-circuit interconnection in the
grid.
b. Anticipated Depletion or depleted regulating reserve e.g. forecast
deviation, intra-hour variations in system demand, reduction in supply
capacity and/or high system demand.
c. And/or the Grid frequency breached below the 59.7Hz level.

3. Whenever called upon, the Contingency Reserve provider must sustain the
dispatched capacity as long as it is required by the System Operator and in
accordance to the Philippine Grid Code, unless ordered otherwise.

4. Whenever the Contingency Reserve provider is to operate in free-governor


mode (primary response with a maximum dead band setting of -0.30Hz.
Dead band or neutral zone is an area of a signal range wherein no
response/action occurs), System Operator shall ensure that the unit is
available from the start until the end of the scheduled interval.

5. Whenever the Contingency Reserve provider is to operate in Automatic


Generation Control (secondary response), System Operator shall ensure
that the unit is available from the start and until the end of the scheduled
interval.

6. Whenever free-governor or AGC mode is not available, System Operator


may opt to require the Contingency Reserve provider to operate on manual
mode as required by the system. System Operator shall ensure that the unit
is available at the start and until the end of the scheduled interval.

7. Failure of Contingency Reserve provider to provide service within the interval


shall be declared non-compliant and payment shall be subject to Clause 5.2
(Penalty)and scheduled capacity for succeeding intervals shall becancelled.

8. If AS Provider failed to comply with the dispatch instruction of System


Operator, the payment shall be subject to Clause 5.2 (Penalty)and
scheduled capacity for the succeeding intervalsshall be deemed cancelled.

9. The System Operator shall require the AS provider to synchronize the unit
upon submission of request for re-nomination to ensure the units availability.
Failure to comply shall mean cancellation of request for re-nomination.
System Operator shall ensure that the scheduled AS providers generator
breaker must be closed on or before the start and until the end of the
scheduled interval.

10. Whenever the Contingency Reserve is depleted as a result of what is stated


in Item 2 of Section D of the AS implementation or as required by the
system, the Dispatchable Reserve shall be dispatched without delay.

G. DISPATCHABLE RESERVE SERVICES

1. System Operator shall instruct the AS provider to synchronize the unit/s


scheduled as Dispatchable Reserve to replenish the depleted Contingency
Reserve. The AS provider shall immediately follow instruction when called
upon without delay.

2. The System Operator shall require the Dispatchable Reserve provider to be


on-line anytime as required by the system.

3. If in case the approved contingency reserve capacity is not sufficient to meet


the requirement, the System Operator shall issue dispatch instructions to all
approved Dispatchable Reserve provider to be on-line prior to or at the start
of the scheduled interval.

4. Failure of Dispatchable Reserve provider to synchronize within the required


time as provided in the ASPP provide service within the interval shall be
declared non-compliant and henceforth cancellation of the whole day
schedule.

5. If AS Provider failed to comply with the dispatch instruction by the System


Operator, the scheduled capacity shall be deemed cancelled for the whole
day schedule.

Schedule 3: Testing Procedures

REGULATING RESERVE SERVICE CERTIFICATION TEST FOR PLANT


WITHOUT AUTOMATIC GENERATION CONTROL

RESPONSIBLE PERSON: Head Engineer, ASS

INSTRUCTIONS

1.0 This list of instructions is primarily intended as a guide in the conduct of


Regulating Reserve Service test of generating unit for Regulating Reserve
Certification without AGC.

2.0 Upon arrival at the plant control room, inform the following personnel that
the test is about to be started:

2.1 Plant shift superintendent and control engineers on duty.


2.2 RCC Sr. Superintendent and ACC Superintendent on duty.

3.0 Set-up the PQ Analyzer and other related equipment (if needed) in
coordination with the plant technicians (electrical and instrumentation &
control) and let the latter connect said test equipment to the unit control
switchboards.

4.0 Make sure that the following test forms are already at hand for manual
recording of test data (generator MW and Frequency):

4.1 FM-SO-13A: Plant Data for Ancillary Services.


4.2 FM-SO-13B: Regulating Reserve Test Report.

5.0 Check that the communication protocol is functioning by calling all the
concerned personnel at their respective stations.

6.0 After getting clearance from RCC, instruct the Plant Control Engineer to
adjust the unit output to 50% of regulating range (minimum to maximum
capacity). This shall be the prescribed loading to be considered for the test.
Take note of the units frequency deadband (up to 0.15 Hz).

7.0 Conduct the tests itemized as follows:

7.1 Request RCC to adjust the system frequency to 59.85 Hz or below


and have it maintain on said level to determine the maximum
regulating response of the unit.

7.2 Observe the response of the unit and record the incremental rate
and data as indicated on the test instrument. This step shall be
done until the unit returns to its initial state, and download the data
to analyze its response.

7.3 Request RCC to adjust system frequency to 60.15 Hzor above. If


possible, request RCC to maintain the system frequency on said
level to determine the maximum regulating response of the unit.

7.4 Observe the response of the unit and record the decremental rate
and data as indicated on the test instrument. This step shall be
done until the unit returns to its initial state, and download the data
to analyze its response.

8.0 If the test process has been successfully completed, the PNPD-ASS head
or his representative shall declare end of the test. Otherwise, let the Plant
Control Engineer/Shift Superintendent-on-duty repeat the process
accordingly but only up to maximum allotted time for the particular test.

9.0 Let all the authorized report forms signatories affix their signature on the
duly-filled test reports.

10.0 Conduct post-test briefing or conference with all the concerned parties
present during the test.

REGULATING RESERVE SERVICE CERTIFICATION TEST FOR PLANT WITH


AUTOMATIC GENERATION CONTROL

RESPONSIBLE PERSON: Head Engineer, ASS

INSTRUCTIONS

1.0 This list of instructions is primarily intended as guide in the conduct of


Regulating Reserve Service test of the generating unit for Regulating
Reserve Certification with AGC.

2.0 Upon arrival at the plant control room, inform the following personnel that
the test is about to be started:

2.1 Plant shift superintendent and control engineers on duty.


2.2 RCC Sr. Superintendent and SED/AEMS personnel on duty.

3.0 Set-up the PQ Analyzer and other related equipment (if needed) in
coordination with the plant technicians (electrical and instrumentation &
control) and let the latter connect said test equipment to the unit control
switchboards.

4.0 Check that the communication protocol is functioning by calling all the
concerned personnel at their respective stations.

5.0 Record the status and operating parameters, e.g., load and system
frequency before the start of the test.

6.0 After getting clearance from RCC, instruct the Plant Control Engineer to
adjust the units output to approximately the midpoint of the regulation
range. This shall be the initial state to be considered for the test.

7.0 Instruct the Plant Control Engineer to switch the unit controller to Automatic
Generation Control operation mode (remote); taking into consideration the
required operating level for AGC operation is met.

8.0 Upon completion of all the Real Time preparation on the plant site,
SED/AEMS personnel-on-duty take over the test for AGC and setting of
the control mode to Economic and participation to Full through SCADA.

9.0 SED/AEMS to conduct the tests and revalidate AGC setting of the
generating unit by sending pulse thru AGC control signals.

10.0 If the test process has been successfully completed by the SED/AEMS, the
PNPD-ASS head or his representative shall declare end of the test.
Otherwise, let the Plant Control Engineer/Shift Superintendent-on-duty
repeat the process accordingly but only up to maximum allotted time for
the particular test.

11.0 Conduct post-test briefing or conference with all the concerned parties
present during the test.

CONTINGENCY RESERVE SERVICE CERTIFICATION TEST

RESPONSIBLE PERSON: Head Engineer, ASS

INSTRUCTIONS

1.0 This list of instructions is primarily intended as guide in the conduct of


Contingency Reserve Service test of generating unit for Contingency
Reserve Certification (primary or secondary response).

2.0 Upon arrival at the plant control room, inform the following personnel that
the test is about to be started:

2.1 Plant shift superintendent and control engineers on duty.


2.2 RCC Sr. Superintendent and ACC Superintendent on duty.

3.0 Set-up the PQ Analyzer and other related equipment (if needed) in
coordination with the plant technicians (electrical and instrumentation &
control) and let the latter connect said test equipment to the unit control
switchboards.

4.0 Make sure that the following test forms are already at hand for manual
recording of test data (generator MW and Frequency):

4.1 FM-SO-13A: Plant Data for Ancillary Services.


4.2 FM-SO-13C: Contingency Reserve Test Report.

5.0 Check that the communication protocol is functioning by calling all the
concerned personnel at their respective stations.

6.0 To verify the primary response of the unit, instruct the Plant Control
Engineer to operate it in Free-Governor Mode and adjust the output to its
minimum operating capacity. Take note of the units frequency deadband
(up to -0.3 Hz).

7.0 Request RCC to adjust the system frequency above the deadband setting
of the generating unit.

8.0 Observe the response of the unit under test and record the data indicated
by the test instrument. Download the data to the PC and analyze its
results.

9.0 To verify the secondary response of the unit using the Manual Adjustment,
instruct the Plant Control Engineer to increase the generation output of the
unit based on its declared ramp rate until it reaches its maximum rated
capacity and sustain it for at least thirty (30) minutes. Observe/record the
result of the test (i.e., MW output, ramp rate, and system frequency).

10.0 If the test process has been successfully completed, the PNPD-ASS head
or his representative shall declare end of the test. Otherwise, let the Plant
Control Engineer/Shift Superintendent-on-duty repeat the process
accordingly but only up to maximum allotted time for the particular test.

11.0 Let all the authorized report forms signatories affix their signature on the
duly-filled test reports.

12.0 Conduct post-test briefing or conference with all the concerned parties
present during the test.

DISPATCHABLE RESERVE SERVICE CERTIFICATION TEST

RESPONSIBLE PERSON: Head Engineer, ASS

INSTRUCTIONS

1.0 This list of instructions is primarily intended as guide in the conduct of


Dispatchable Reserve Service test of generating unit for Dispatchable
Reserve Certification.

2.0 Upon arrival at the plant control room, inform the following personnel that
the test is about to be started:

2.1 Plant shift superintendent and control engineers on duty.


2.2 RCC Sr. Superintendent and ACC Superintendent on duty.

3.0 Set-up the PQ Analyzer and other related equipment (if needed) in
coordination with the plant technicians (electrical and instrumentation &
control) and let the latter connect said test equipment to the unit control
switchboards.

4.0 Make sure that the following test forms are already at hand for manual
recording of test data:

4.1 FM-SO-13A: Plant Data for Ancillary Services.


4.2 FM-SO-13G: Dispatchable Reserve Test Report.

5.0 Check that the communication protocol is functioning by calling all the
concerned personnel at their respective stations.

6.0 After getting clearance from RCC, instruct the Plant Control Engineer to
implement the start-up procedure for the unit.

6.1 For plants consisting of sector/block whereby such sector/block


consists of a number of generating units, instruct Plant Control
Engineer to simultaneously start all the respective generating units
per sector/block to determine its total maximum generation output.

6.2 For plants consisting of large generating units, instruct the Plant
Control Engineer to start each unit, one at a time upon instruction of
RCC.

7.0 Record the data of the start up and synchronization time of the unit under
test. Once synchronized, instruct the Plant Control Engineer to increase
the generation output until it reaches its maximum capacity and sustain it
for at least two (2) hours.

8.0 If the test process has been successfully completed, the PNPD-ASS head
or his representative shall declare end of the test. Otherwise, let the Plant
Control Engineer/Shift Superintendent-on-duty repeat the process
accordingly but only up to maximum allotted time for the particular test.

9.0 Let all the authorized report forms signatories affix their signature on the
duly-filled test reports.

10.0 Conduct post-test briefing or conference with all the concerned parties
present during the test.

Schedule 4: Applicable Rates

Firm Contracted Capacity:

Regulating Reserve: Php2.25/kW/Hr


Contingency Reserve: Php1.50/kW/Hr

Non-Firm Contracted Capacity:

Incidental Energy

Cost of Incidental Energy (IE) shall be computed using the formula below:

G = Summation of energy generated or dispatched in a particular


interval hour due to Non-Firm Contracted Capacity, in kWh

CP = Capacity payment through WESM and shall be computed


based on the Weighted average of capacity scheduled and
nominated price

VOM = Variable Operation and Maintenance Cost (Phpxxxx/kWh)

Actual Fuel and Lube Cost = Monthly Fuel and Lube Oil
Consumption rate in P/kWh due to dispatched energy (G).
The monthly fuel and lube oil consumption rate shall be the
actual consumption rate if less than the approved
consumption rate of ERC otherwise it shall be the approved
consumption rate by ERC.

Actual Fuel Cost = Monthly Fuel Consumption rate in P/kWh due to


dispatched energy (G).

REVWESM = Summation of WESM revenue in a particular interval hour


based on Final Ex-post market clearing price of the AS
Providers trading Node arising from G above.

Capacity payment for Non-Firm rates shall be the weighted average


of capacity scheduled and its corresponding nominated price.

Where, IE shall be paid by NGCP to Service Provider if it is greater than zero;

Schedule 5: Testing, Monitoring and Verification of Ancillary Services

5.1 The Generation Facility shall be tested, to ensure its continuing capability to
provide the Ancillary Services specified in Schedule 1 of this Agreement, in
accordance with the requirements and procedures set out in Section 6.10 of
the Grid Code and Schedule 3 of this Agreement.

5.2 The Service Provider shall submit to NGCP, within one (1) month from the
effectivity of this Agreement as provided under Section 2.1 herein, its
preferred schedule for the testing of the Generation Facility, which shall not
be more than twice within a calendar year. NGCP shall then evaluate the
submitted schedule based on its availability and in consideration to the
system condition. The submitted schedule shall be mutually accepted by
both NGCP and the service provider. Preferred schedule of testing shall be
during weekdays.

5.3 Pursuant to Section 6.10.1.4 of the Grid Code, NGCP may at anytime issue
instructions requiring tests to be carried out on the Generation Facility. All
such tests shall be of sufficient duration and shall be conducted not more
than twice within a calendar year except when there are reasonable grounds
to justify the necessity for further tests.

5.4 All relevant and incidental costs incurred in relation to the testing and
certification activities in relation to Section 5.3 above shall be approved and
agreed upon by the Parties in writing within a reasonable time prior to the
actual conduct of said activities, andshall be for the Service Providers own
account.

5.5 NGCP is not obligated to pay for the capacity of a specific unit of the
Generation Facility during the period of testing pursuant to Section 5.3
above. Any incidental energy that may be injected to the Grid during
suchtesting and certification activities in respect of such unitsshall be
recovered from the WESM.

5.6 Subject to the procedures set out in the ASPP, NGCP shall regularly monitor
the Generation Facilitys performance to determine its capability of providing
the Ancillary Services set out in Schedule 1 hereof.

5.7 NGCP may, at any time, and in accordance with the ASPP, verify whether
the provision of an Ancillary Service is in accordance with this Agreement.
At NGCPs request, the Service Provider shall provide and not unreasonably
withhold, the results of any testing conducted which may have a Material
Effect on the capability of the Generation Facility to meet its required
performance level/s.

Schedule 6: Annual Performance Evaluation

The Annual Performance Evaluationwhichis required by NGCP as a basis of


monitoring and evaluating the performance of an Ancillary Service (AS) Provider for
its provision of Ancillary Services shall be the following:

6.1 The total number of Hours Complied by an AS Provider shall be at least 98%
of the total number of Scheduled Hours in a year.

6.2 Once the Reserve Market becomes operational, the Reserve Effectiveness
Factor (REF) may be used by NGCP to gauge the performance of an AS
Provider for its provision of the contracted Ancillary Services

For the purpose of this section,


(a) Hours Complied means an hour where the Service Provider was able to
provide the scheduled AS capacity following the current Dispatch Protocol,
dispatch instruction from System Operator pursuant to the approved NASS, and
the Ancillary Services Standard Technical Requirements.
(b) Scheduled Hours means each hour when the Service Provider was scheduled
to provide AS pursuant to the approved NASS.

Schedule 7 Hydrological Constraints (as applicable for Firm AS for Hydro


plants)

The Service Provider may be exempted from providing the Firm Contracted
Capacity during Hydrological Constraint periods.

Hyrdrological Constraint, for the purposes of this agreement, is defined as instances


when the following conditions occur:

a. The actual water elevation of the _____Reservoir (in masl) is below the rule
curve set by NIA, as outlined in the Water Rule Curve below;
b. The Service Provider notifies NGCP in writing before 2 pm at least one business
day before of their intent to cancel the Firm Contracted Capacity and submits to
NGCP actual water elevation data.

Hydrological Constraint Guidelines


c. Provided that, the following rules and guidelines shall apply during Hydrological
Constraint periods:
i. The Service Provider may only cancel the Firm Contracted Capacity for 24-
hour intervals, starting from 0100h to 2400h of each day. During these sets
of 24 hour intervals, the Service Provider agrees to subject their water
releases to clauses iii, iv, v and vi below.
ii. The Service Provider shall promptly submit to NGCP a list of the water
requirements and volumes of third parties such as the NIA, including the
volume and dates of such water release requirements, including any
updates or revisions.
iii. During the days when the Firm Contract Capacity is cancelled, the Service
Provider shall limit water releases or water use to such water volumes as
required by the NIA, NWRB, System Operator or other third parties whose
orders are beyond the Service Providers control or influence,
iv. That such water releases defined in (iii) may result in electricity generation
which may be sold at the WESM for the Service Providers account,
v. The Service Provider shall provide NGCP a reconciliation within 3 business
days proving that the electricity generations water volume during the
Hydrological Constraint period was equal to the water requirements
ordered by such third parties.
vi. Firm Contracted capacity shall be prioritized over Non-Firm Capacity,
and the Service Provider may not nominate Non-Firm Capacity for any
type of ancillary service when Firm Contracted Capacity is cancelled during
Hydrological Constraint periods,
vii. Failure or breach by the Service Provider of the conditions set forth in
clauses (3) i,iii,iv,v or vi may result in NGCP nullifying the Hydrological
Constraint period and all terms of the Agreement shall retroactively apply
for all intervals as if the Hydrological Constraint period had not existed,
including the provisions under clause 5.2 (Penalty).

Schedule 8 Outage Allowance (as applicable for Firm AS for Thermal plants)

The Service Provider shall be allowed a number of Outage Hours per year, the
aggregate of the Outage Hours shall be called the Outage Allowance. During the
Outage Hours, the Service Provider shall be deemed unavailable; NGCP shall not
schedule the Service Provider for the Firm Contracted Capacity, resulting in non-
payment during such Outage Allowance.

For the purposes of this agreement, an Outage Hour will be defined as a period
where the Service Provider, on a day-ahead basis, informs NGCP that it is unable to
provide the Firm Contracted Capacity, due to outage or maintenance.

The Service Provider shall be allowed an Outage Allowance per year under the

Should the timing of the Service Providers scheduled Major Outage be delayed, the
Service Provider may elect to switch the allowed Outage Days for the designated
Major Outage year with the allowed Outage Days of a Normal Outage year.

Outage Allowance for may be consumed only for the specified period, and shall not
be transferrable to another year.
