YourComplainantisanOfficerwiththeOwatonnaPoliceDepartment.Investigationhasrevealedthaton
September4,2017,atapproximately10:07p.m.,officersweredispatchedto520AdamsAvenueNWin
Owatonna,MN,SteeleCounty,forafightintheparkinglot.

AsOfficerMichaelwasenroutetoCashWise,shenoticedthecallnotesstatedsomeoneinablack
Cadillacwasfollowingthesuspectvehicle.UponarrivaltoCashWise,OfficerMichaelstartedtogeta
statementfromanemployee.OfficerMichaelhadtoendtheinterviewabruptlyforadisturbancecallthat
wasclosetoherlocation.OfficerMichaelarrivedat520AdamsAvenueNWandobservedtwoSUVs,one
bearingMNlicenseplate900-TJGparkedintheparkinglot,andtheotherbearingMNlicenseplate015-
WAZparkeddirectlybehindit.OfficerMichaelobservedmultiplepeoplestandingoutsideandboxesof
foodlayingonthegroundbehindtheSUVbearingMNlicenseplate900-TJG.

KeithDouglasHaskell(DOB:05/10/1962)advisedherthatA.R.(DOB:08/06/2000)andhisfriendJ.J.G.
(DOB:01/11/2001)hadshopliftedfoodfromCashWise.J.J.G.smother,OdiliaNMNGarza(DOB:
04/07/1979),statedHaskellpreviouslyhadhersonpinnedagainstthecar.OfficerMichaellearnedthatthe
shoplifteditemswere:

*OneboxofCinnamonToastCrunch,valuedat$2.97
*OneboxofScoobyDoofruitsnacks,valuedat$2.17
*OneboxofGushers,valuedat$2.17and
*Oneboxoffruitrollups,valuedat$2.17.

OfficerMichaelspokewithA.R.,whostatedhewasinsideCashWisewithhiscousin,J.J.G.A.R.statedhe
didnotstealanything.A.R.statedheboughtasodathenwenttothecar.A.R.statedJ.J.G.cameoutafter
hedid.A.R.statedhedoesntknowifJ.J.G.stoleanything.A.R.statedhewenttopulloutoftheparkinglot
andavehiclecameupreallyfastbehindhim.A.R.statedhewasjustdrivingtogetoutofthere.A.R.stated
theothervehiclewasonhisvehiclethewholetime.A.R.statedhedoesntliveintheapartmentsbutdidnt
wantHaskelltoknowwherehelived,sohepulledinthere.A.R.statedHaskellgotoutofthecarandcame
uptothewindow.A.R.statedheaskedHaskellwhathewanted.A.R.statedHaskelltriedopeningthedoor
andwasyellingaboutthemtakingcerealorsomething.A.R.statedJ.J.G.said,Here.Takeit,takeit,and
wasthrowingitoutthewindowtohim.A.R.statedHaskellpulledJ.J.G.outofthefrontpassengerseatand
toldhimhewasplacinghimundercitizensarrest.A.R.statedHaskellpushedhimupagainstthevehicle.
A.R.statedHaskellhitJ.J.G.andpeppersprayedhim.A.R.statedJ.J.G.ranoff,thenHaskellcameoverto
hissideofthevehicle.A.R.statedHaskellthreatenedhimwiththislongstick.A.R.statedHaskellhelditout
andtoldhimtogetoutofthecar.A.R.statedhecalledhismomashewassittinginthecar,andHaskell
toldhimifhewasntcallingthepolicethathedidntneedtobeonhisphone.A.R.statedHaskelltoldhim
hewasapoliceofficer.A.R.statedHaskelltoldhimtogivehimmykeys.A.R.statedHaskellwastryingto
puthisarmbehindhisback,sohegavehimhiskeys.A.R.statedHaskelltriedtograbhisphonefromhim.
A.R.statedHaskelltoldhimifhedidntgetouthewasgoingtogetpeppersprayed.A.R.statedHaskell
pushedhimupagainstthecarandheldhisarmout.A.R.statedthatiswhenhismomshowedup.

OfficerMichaelspokewithGarza,whostatedshegotacallfromA.R.GarzastatedA.R.wasyelling,
Mom!Mom!Helpme!GarzastatedshedidntknowexactlywhereA.R.wassoshewasrunningaround.
GarzastatedwhenshefoundA.R.,Haskellhadhimagainstthecarwithhishandup.GarzastatedHaskell
toldherhecalledthepolice,sotheywaited.GarzastatedshesmelledalcoholonHaskellsbreath.

OfficerVogelarrivedonsceneandobservedOfficerMichaelalreadyonscenespeakingwithseveral
individuals.OfficerVogelobservedablackbaton,whichwasextended,onthedriverssidefloorofthe

vehiclebearingMNlicenseplate015-WAZbetweenthedriversseatanddriversdoor.OfficerVogel
Steele County, MN
observedanorangecanofpeppersprayinthecentercounselofthevehicle.OfficerVogelcollectedthe
batonandpeppersprayasevidence.

OfficerVogelspokewithHaskell,whostatedthatheandhisdaughterwerewalkingintoCashWiseas
A.R.andJ.J.G.werewalkingout.Haskellstatedastheywerewalkingout,A.R.lookedatJ.J.G.and
noddedandtookaboxofcerealandfruitsnacksoutthedoorandtheyran.Haskellstatedheandhis
daughterwalkeduptoanemployeeandaskedifA.R.andJ.J.G.paidforthoseitems,andtheemployee
saidtheydidnot.Haskellstatedhewentoutsidetogetalicenseplatenumber,andassoonasA.R.and
J.J.G.sawhim,theyleftwithoutanylightson.Haskellstatedhegotinhisvehicleandfollowedthemhere.
HaskellstatedJ.J.G.gotoutofthevehicleandaskedwhyhewasfollowinghim.Haskellstatedhetold
J.J.G.hesawhimshopliftatCashWiseandthecopswerealreadyontheirway.HaskellstatedthatJ.J.G.
said,YeahIdid.HaskellstatedJ.J.G.gotoutandgavehimthecereal.HaskellstatedheaskedJ.J.G.
wherethefruitsnackswere,andhesaidhedidnttakeanyfruitsnacks.HaskellstatedheaskedJ.J.G.if
hehadareceiptforthefruitsnacks.HaskellstatedJ.J.G.wastellingA.R.tocallhismom.Haskellstated
J.J.G.tookoffrunningbecausehecameathimandhepeppersprayedhim.Haskellstatedhewentoverto
A.R.andaskedforanID.HaskellstatedA.R.asked,Why?andhesaidbecausehewitnessedhim
shopliftingandpolicewerealreadyontheirwayandhewantedtoknowifhehadanIDordriverslicense.
HaskellstatedA.R.saidhedoesnthaveadriverslicense.Haskellstatedhegotoutofthevehicleonly
whenJ.J.G.did.HaskellstatedA.R.gotonthephonewithhismom.Haskellstatedpeoplewereyelling
fromtheapartmentslocatedat585AdamsAvenueandweresayingtheysawthewholething.Haskell
statedhegrabbedA.R.sarmbecausehewastryingtogetoutandbeathim.HaskellstatedhehadA.R.s
armoutlikeastraightarmbar.HaskellstatedA.R.wasgettingoutofthecarandtalkingtohismomonthe
phone,saying,Everyonegetoverhere.HaskellstatedhetoldA.R.thepolicewerealreadyontheirway.
HaskellstatedheletgoofA.R.whenhewasstillinthecar.HaskellstatedA.R.gotoutofthecar.Haskell
statedhepeppersprayedJ.J.G.becauseheswungathim.HaskellstatedheclearlytoldJ.J.G.andA.R.
hewasplacingthemundercitizensarrestforshopliftingbecausetheydiditrightinfrontofhim.Haskell
statedhetoldA.R.thatifhewasnotonthephonewiththepolicetohangupbecausehedidntneedtobe
talkingtoanyoneelse.HaskellstatedJ.J.G.cameandchallengedhimandthatiswhyhepeppersprayed
him,andA.R.wasonthephonewithhismom.Haskellstated,Ididhavemybatonout.Imnotgoingtosay
Ididnt.

OfficerVogelspokewithBruceAllenHackensmith(DOB:10/26/1971),whostatedthatheandReynolds
wereinacornerapartmenton585AdamsAvenuewhenA.R.pulledup.HackensmithstatedHaskellcame
flyingupbehindthemsquealinghistires.Hackensmithstatedfromwhathecouldseefromhisapartment,
HaskellgotoutofhisvehicleandidentifiedhimselfasapoliceofficerandstartedpullingJ.J.G.outofthe
vehicle.HackensmithstatedhewasyellingatHaskellthatifhewasacoptoturnhislightsonandget
anotherofficerthere.Hackensmithstated,Hekeptsayingthathewasacopandthathearrestedhim
before,AndImlike,noway.Idontbuythis.

OfficerVogelspokewithRochelleKristineReynolds(DOB:09/30/1982),whostatedHaskellclimbedover
thedriverssidetryingtograbthedriverout.ReynoldsstatedHaskellgrabbedsomethinglikeacrowbar
fromhisvehicleandthenputitbackinhisbackseat.ReynoldslaterstateditwasabatonthatHaskellhad
inhishand.

OfficerVogelspokewithA.R.,whostatedJ.J.G.didswingatHaskellbecauseHaskellpulledhimoutofthe
caraggressivelyandshouldercheckedhim.A.R.statedHaskellopenedthepassengerdoor.A.R.stated
Haskellwasthrowingoutallthestufffromthecar.A.R.statedthenHaskellcameovertomysideandtried
openingthedoor.A.R.statedHaskellsaidhewasacop.A.R.statedHaskellthentoldhimtogethiskeys
outoftheignition.A.R.statedhetookhiskeysoutandHaskelltoldhimtogivethemtohim.A.R.stated

chairwhenheheardsomeyelling.HickmanstatedhethoughtitwastheTVsoheturneditoff.Hickman
statedhestillheardtheyellingsohegotoutandlookedouthiswindow.Hickmanstatedhethought
someonewasmessingwithhiscarbecauseitwasnexttowheretheywereparked.Hickmanstatedhegot
outsideandrealizedtheywerenotmessingwithhiscar.HickmanstatedthatHaskellwentovertothe
passengersideofthecarandwaspointingandyellingandscreaming.Hickmanstatedthatiswhenhe
calledthepolice.

OfficerVogelspokewithJ.J.G.,whostatedhedidsomethingstupid.J.J.G.statedhegrabbedthecereal
andfruitsnacks.J.J.G.statedhegrabbedthreethings.J.J.G.statedHaskellstartedfollowingthemand
pulledupbehindthem.J.J.G.statedHaskellstartedyelling,Putyourhandsup.Impolice.Impolice.
J.J.G.statedHaskelljustcameuptothepassengerdoorandopeneditandstartedgrabbinghimforno
reason.J.J.G.statedhewasgivingHaskellthecerealandthefruitsnacksbackbecausehedidntwantto
getintrouble.J.J.G.statedHaskelljuststartedsprayingmaceeverywhere.J.J.G.statedHaskellgrabbed
hisarmandtriedtopullhimout.J.J.G.statedhetoldHaskelltojusttakethestuffbecausehedidntwant
anytrouble.J.J.G.statedhepushedHaskellandran.J.J.G.stated,Ijustran.J.J.G.statedHaskelltold
himhewasunderarrestandtriedputtingmyhandsbehindmyback.J.J.G.statedheknewHaskellwasnt
policebecausehesmelledofalcoholandpolicedontdrivelikethat.
