The glorious tradition of debates, discussions and deliberations


in the parliament has witnessed a decay that doesnt augur well
for the largest democracy of the world. Examine.
Parliament is not just a legislative body but also a place for raising views
and opinions both of majority and the minorities. Its discussions and
debates help in bringing the best possible solution within the realm of
the Constitutional values.

However, in the recent years the value of debates and discussions


seems to have been undermined.

1. Bypassing of parliamentary standing committees:


In 2016, only 6 out of 31 bills were referred to standing committees.
This shows that they have been sidelined which impairs any meaningful
debates.

2. Use of ordinance route:


The use of ordinances has led to bypassing of parliamentary procedures
in passing bills and legislations. The enemy property ordinance was
reissued 5 times for instance.

3. Declaring bills as money bills:


The declaration of Aadhar bill as money bill depicts the bypassing of the
upper house in getting such important legislations passed by the
government due to its minority position in Rajya Sabha.

4. Judicial activism:
The National anthem ruling and imposition of cess on diesel cars by SC
has led to judiciary taking the role that had to be performed by the
legislature.
5. Whips by parties:
The issuance of whips by different political parties and the lack of
internal democracy has led to lowering of debates and discussions in
the parliament. The anti-defection law also curtails free speech of the
legislators of the parties.

Debates and discussions were the guides in framing constitution. They


therefore are needed to ensure that executive action and legislature
checks go hand in hand.
