JUDICIAL AFFIDAVIT OF LA GUARDIA S. DE LEON

I La Guardia S. de leon, of legal age 32 years old, single, and living at #7 Maligaya St., Quezon
City, witness for the prosecution in this case, state under oath that:

PRELIMINARY STATEMENT
The person examining me is Atty. Miguel R. Estrada with address at 10 General Avenue, GSIS
Village, Quezon City. The examination is being held at the same address. I am answering his
questions voluntarily, to the best of my knowledge and fully conscious that I do so under oath
and may face criminal liability for false testimony and perjury.

PURPOSE
This affidavit/testimony of witness La Guardia S. De Leon, the security guard of Fortune Grocery a
supermarket located at Uniwide Complex, is being offered to prove the existence of theft committed by
San Juan San Juan and Bernabe Fernandez.
.Q. Please state your name and other personal circumstances for the record.
A. I am La Guadia G. De leon 32 years old, single and with residence at #7
Maligaya St., Quezon City.
Q. Where are you on 19 May 1994, at around 4:30 pm?
A. I am at the work.
Q. Where do you work?
A. I am working at the Fortune Grocery supermarket located at Uniwide Complex.
Q. What is the position that you hold ?
A. I am working as a security officer sir.
Q. What happened on the 19 May 1994, at around 4;30 pm?
A. I sighted San Juan San Juan and Bernabe outside the Fortune Grocery while I was manning
on my post at the open parking area of the supermarket.
Q. Then what happened after sighting them. (San Juan San Juan and Bernabe)?
A. I saw San Juan San Juan who was wearing an identification card with the mark Receiving
Dispatching Unit (RDU) hauling a push cart with cases of detergent of the well known Tide
Brand.
Q. Then what did San Juan San Juan do after hauling the push cart containing the cases of
detergent?
A. San Juan unloaded these cases in an open parking space, where bernabe was waiting.
 Q. Then after unloading the said cases, what did San Juan San Juan do?
A. he returned inside the supermarket, and after five (5) minutes, emerged with more cartons of
Tide Ultra and again unloaded these boxes to the same area in the open parking space.
Q. What do think is the reason, why did he unloaded the said boxes of Tide soaps in the open
parking area?
A. as a security officer, I thought that he wants to steal the said boxes of soaps.
Q. How did you arrive at that conclusion?
A. because htereafter, I saw him left the parking area and haled a taxi.
Q. Did he board the said taxi?
A. Yes, he boarded at the said cab and directed it towards the parking space where bernabe was
waiting.
Q. What did bernabe do?
A. Bernabe then, loaded the cartons of Tide Ultra inside the taxi, then boarded the same vehicle.
Q. Are you sure you saw them?
A. Yes. All these acts.
Q. As a security officer? What did you do to prevent the said acts?
A. I proceeded to stop the taxi as it was leaving the open parking area, I also asked them if they
have the receipt of the said merchandise, however San Juan and Bernabe reacted by fleeing on
foot, I also fired a warning shot to alert my fellow security guards of the incident. They were
both apprehended at the scene, and the stolen merchandise recovered with an aggregate value of
P20,000.00

March 23, 2016. Affiant personally came and appeared with Drivers License No. D04-08-
001234 issued by the Land Transportation Office on December 10, 2015, bearing his photograph and
signature and Passport No. 00123456 issued by the Department of Foreign Affairs on November 8,
2015, known to me as the same person who personally signed the foregoing instrument before
me and avowed under penalty of law to the whole truth of the contents of said instrument.
