RESOLUTION NO.______S.2017

RESOLUTION IMPLEMENTING REPUBLIC ACT NO. 4136 OTHERWISE


KNOWN AS "LAND TRANSPORTATION AND TRAFFIC CODE" IN THE
MUNICIPALITY OF CATMON, CEBU.

WHEREAS, it is a well-entrenched state policy to maintain peace and order,


as well as to protect life, liberty, and property, and the promotion of the general
welfare;
WHEREAS, every year, 1.25 million people around the world die due to road
crashes a global problem that the World Health Organization (WHO) says is
both predictable and preventable;
WHEREAS, according to the Philippine Statistics Authority (PSA), number of
deaths due to road crashes has been increasing from 2006-2015. Based on data from
the PSA, motorcyle-related injuries comprise 56% of the total identified transport
incidents nationwide;
WHEREAS, one of the prevention mechanics imposed by the State to lessen or
as much as possible to avoid these displeasing results, is the regulation on traffic
rules;
WHEREAS, pursuant to sec. 35, Art. I, Chapter IV of R.A 4136, known as the
Land Transportation and Traffic Code, any person driving a motor vehicle on a
highway shall drive the same at a careful and prudent speed, not greater nor less
than is reasonable and proper, having due regard for the traffic, the width of the
highway, and of any other condition then and there existing; and no person shall drive
any motor vehicle upon a highway at such a speed as to endanger the life, limb and
property of any person, nor at a speed greater than will permit him to bring the
vehicle to a stop within the assured clear distance ahead;
WHEREAS, according to Sec. 36 of the same law, there should be Uniformity
in the Speed limit throughout the Philippines, such that no provincial, city or
municipal authority shall enact or enforce any ordinance or resolution specifying
maximum allowable speeds other than those provided in such Act.
WHEREAS, the statute provided for specific speed limits on any motor vehicle
and that it shall not exceed the following:

Passengers
MAXIMUM ALLOWABLE Motor trucks and
Cars and
SPEEDS buses
Motorcycle

1. On open country roads, with no 80 km. per hour 50 km. per hour
"blinds corners" not closely
bordered by habitations.

2. On "through streets" or 40 km. per hour 30 km. per hour


boulevards, clear of traffic, with
no " blind corners," when so
designated.

3. On city and municipal streets, 30 km. per hour 30 km. per hour
with light traffic, when not
designated "through streets".

4. Through crowded streets, 20 km. per hour 20 km. per hour


approaching intersections at
"blind corners," passing school
zones, passing other vehicles
which are stationery, or for
similar dangerous circumstances.

WHEREAS, due to vehicular accidents recorded in the Municipality of


Catmon, it is but proper and befitting to strictly implement the national law. Most
particularly to accident prone areas like roads from barangay Flores to Barangay San
Fernando where there exist three (3) elementary schools namely: Passionist Sister
Schools, Catmon Integrated School, Bagalnga Elementary Schools;
WHEREAS, in accordance with the police report from the Municipality, it
appeared that the barangays having the most number of the traffic related incidents
are coming from the Poblacion are -Barangay San Jose, Barangay Corazon and
Barangay Flores respectively, having 45.45% of the total traffic related incidents in
the whole locality;

WHEREAS, this goes to say that there is a necessity on the strict


implementation on the traffic rules, especially in the observance of the speed limits
laid down by the State to obviate or at least reduce these incidents;
