BP 5117-- Interdistrict Attendance

Background
The Education Code provides a number of options under which a student may attend school in a district
other than the district where he/she resides. Under the option exercised in the SBUSD, a student may
attend school in a different district when both the district of residence and the district of proposed
attendance agree. This is called an "interdistrict attendance permit" pursuant to Education Code 46600-
46611.
Education Code 46600 requires that the interdistrict attendance agreement specify the terms and
conditions under which individual permits may be granted or denied. Districts shall also include in the BP
their agreed-upon standards for revocation of students' interdistrict attendance. Examples of conditions
that may result in revocation include falsification of information stated on the permit application,
unsatisfactory attendance, continual disruption, or poor academic achievement.

The SBUSDs practice of taking interdistrict transfers has varied over the years, with decisions on which
students to allow into the district changing based on current events, programmatic decisions, state funding
models, enrollment projections and other considerations. With the pending transition into Basic Aid
funding status, the SBUSD is now proposing a change to BP 5117.

Proposed Changes to BP 5117
Of late, the SBUSD has been an open door to interdistrict transfer requests. Now that funding will no
longer be based on ADA, it is prudent to limit entry for students from outside districts, with the following
exceptions:

1. Students who are children of district employees.

2. Students who are children of employees of Santa Barbara City College.

3. To allow the students to complete a school year when their family has moved out of the district
during that school year.

4. When the parent/guardian provides written evidence that the family will be moving into the district
within the first month of the school year.

5. To allow the student to remain with a class promoting that year from an elementary school (entering
6th grade) or graduating high school (entering 11th or 12th grade) in the SBUSD. (EC 46600(a)(4))

6. When the student has a sibling who qualified under #5 above, and is a student in the same school as
the student meeting the criteria in #5.

7. A student who will suffer or whose immediate family member(s) will suffer an extraordinary
hardship due to a denial of their interdistrict transfer request may apply for an exemption.
Extraordinary hardship is defined as a documented severe and exceptional financial, educational,
safety, or health impact on the student or an immediate family member of the student. An exemption
for extraordinary hardship will be granted only in very rare and unique situations where there is a
profound negative impact upon a student or immediate family member that cannot be reasonably
mitigated by other means. The Superintendent or designee may require evidence that he or she deems
necessary to verify a claim of extraordinary hardship. Absent such dire circumstances, interdistrict
transfers will not be granted (1) because of special characteristics of a particular school, (2) due to
child care considerations, (3) because of employment within the district, (4) as a result of parental
separation or divorce, or (5) on account of transportation issues. An extraordinary hardship exemption
shall not be granted if permitting the attendance will adversely impact district class size or otherwise
result in unacceptable cost to the district.

Changes to Board Policy 5117 will go into effect immediately upon board approval. The impact of this
decision will be most felt beginning in December, 2017 when the transfer application process opens for
the 2018-2019 school year. A communication plan is being developed to ensure that all stakeholders
impacted by this change will be notified in a timely manner.
