AFFIDAVIT OF DESISTANCE

I, DANILO E. TABANAY, of legal age, Filipino, and a resident of

Suerte, Kidapawan City, after being duly sworn to in accordance with law,
do hereby depose and state:

1. I am the complainant in a criminal complaint for Slight Physical

Injuries against ALIAS NAPNAP PATUBO filed before the
Municipal Trial Court in Cities in Kidapawan City with Criminal
Case Number XII-OU-INV-W176-00169;

2. After going over the factual antecedents that led to the filing of
said case against ALIAS NAPNAP PATUBO I have come to the
conclusion that the case was just the result of misunderstanding
and misapprehension of facts;

3. The truth of the matter is, it was really not ALIAS NAPNAP
PATUBO who caused the injuries I complained of. In fact, she or
any of her companions did not harm me at all during the
demolition we conducted on July 5 and 6, 2017 in Amas Capitol
Compound;

4. I filed the complaint at the time when my mind was confused and
I was pressured by circumstances;

5. By reason of such change of heart, I am no longer interested in the

case I have filed against ALIAS NAPNAP PATUBO nor to testify
against her in connection with the above stated criminal
complaint.
 6. I am executing this affidavit of desistance to inform the Municipal
Trial Court of Kidapawan City for which the case was filed of the
foregoing facts in order that appropriate action can be taken by
the said court for the dismissal of my complaint against ALIAS
NAPNAP PATUBO.
