MINUTES OF THE REPRESENTATIVES MEETING HELD ON

MONDAY, 11th NOVEMBER 2013

A joint meeting of all the members of KP Bar Council and representatives of all
the Bar Associations of the province was held under the Chairman Ship of Syed Amjad
Shah Advocate Supreme Court Vice Chairman KP Bar Council on 11-11-2013 at 11 am
in the under construction office building of KP Bar Council Peshawar.

The meeting started with the recitation from the Holy Quran by Hafiz Muhammad
Naseem Advocate, Member Bar Council.

The following agenda was discussed;

1. Recent recruitments of Civil Judges/Magistrates/Alaqa Qazi in sub-
ordinate judiciary by Peshawar High Court.
2. Aid and grants/allocation of funds by the Govt.
3. Medical Facilities for the lawyers of the Province.
4. Report of Housing Society.
5. Benevolent Fund and Group Insurance.
6. Other matters with the permission of Chair.

Mr. Muhammad Arshad Awan Advocate Chairman Executive Committee KP Bar

Council briefed the audience about the aims and objects of the meeting and explained as
to why they felt the need of holding the meeting.
He said that apart from other issues, the important issues is the induction of
judicial officers in the judiciary. These posts have been recently advertized in daily
newspapers with criteria of qualification for appointments. He objected on the criteria of
the qualification in the best interest of justice. He narrated the audience about the
procedure adopted by High Court prior to 1990 and also explained the drawbacks of the
appointment being done in near past.
Besides the appointment of judicial officers he also highlighted other items of the
agenda and invited the audience / representatives to give their views on the above cited
agenda.

Eighteen representatives of the Bar Associations addressed the meeting and

blessed the audience with their ideas, valuable suggestions, future line of action and

extended assurance of their cooperation in the best interest of justice and future security
of young lawyers as well as aged lawyers to an extreme limits of sacrifice.

Syed Amjad Shah Advocate, Vice Chairman KP Bar Council through his
concluding address thanked all the participants for their coming at short notice, on the
presentation of ideas, valuable suggestions, extension of Cooperation and promises of the
sacrifices in the best interest of justice and future security of lawyer fraternity.

Discussion of the representatives on the agenda resulted in the following

approved resolutions.

1. All the representatives not only affirmed the point of K.P Bar Council
with respect to recent recruitments of judicial officers in the sub-ordinate
judiciary but it was unanimously resolved to have a bi-lateral dialogue on
the issue with the worthy Chief Justice along with all the Honourable
Judges of the Peshawar High Court, Peshawar. Meanwhile operation of
the procedure of appointment of judicial officers be suspended.

It was also decided that in case of failure of dialogue on the part of other
end, protest is to be carried out throughout the Province which shall
continue till solution of the issue.

2. A high level meeting is proposed to be conducted with the Govt. high-ups

for allocations of funds to the Bar Council and all the Bar Associations. It
was further decided that funds to the concerned Bars should be allocated
equivalent to that of judiciary and further disbursement of funds should be
through Bar Council.

The above decision was taken to assist and give relief to respective Bar
Associations.

3. It was unanimously desired to provide Medical Facilities to all the lawyers

equivalent to Grade 18 Civil Servants.

4. Housing Society has been unanimously authorized to search suitable and

low price lands in different parts of the Province suitable for Lawyers
Housing Society and thereafter to strive for the development of so
acquired lands through Govt. It was also suggested to negotiate Govt. for
the allotment of lawyers quota in all Public Sector Schemes.

5. It was unanimously resolved that reform should be brought in collection of
Benevolent Fund and Group Insurance be introduced as is being done by
rest of the Bar Councils of the Country.
