AFFIDAVIT OF WITNESS

I, MARLYN M. APURA, of legal age, married, Filipino Citizen, a farmer,

and a resident of Brgy. Agbatuan, Anilao, Iloilo, Philippines, after having been
duly sworn to in accordance with law, do hereby deposes and avers:

1. That my husband Rolando P. Apura was the Respondent in NPS

Docket No. VI-11-INV-16F-00499 for FRUSTRATED MURDER and
which case is now pending for Preliminary Investigation before the
Office of the Provincial Prosecutor, Province of Iloilo, Philippines;

2. That the accusations of RONALDO B. CABAOG and JOEMARTIN D.

CORDERO in their Sworn Statements executed on June 7, 2016
alleging that my husband Rolando P. Apura immediately hacked
Ronaldo B. Cabaog were absolutely not true, frivolous, and
fabricated;

3. That the truth of the matter is that, on May 28, 2016 at around 8:00
in the morning, I, together with my husband Rolando P. Apura were
putting fence in our sugar cane farm at Brgy. Agbatuan, Anilao, Iloilo;

4. That moments later, I saw Joemartin D. Cordero and Maylyn Allanic

pulling out and destroying the fence that I and my husband Rolando
P. Apura just put up;

5. That as such, my husband Rolando P. Apura then told Joemartin D.

Cordero and Maylyn Allanic to stop their action however, Maylyn
Allanic then attempted to hit my husband with a wooden branch that
she was holding during that time;

6. That upon seeing Maylyn Allanic attempting to hit my husband with a

wooden branch, I then told her to stop what she is planning to do
against my husband for we do not want to have a fight with them and
we were only putting fence on the boundary of our sugarcane farm;

7. That Ronaldo B. Cabaog then came in the area where he was yelling
at my husband asking why we were putting a fence in our sugarcane
farm which my husband replied that we were just putting physical
boundaries in our sugarcane farm;

8. That when we were about to leave the area where we put our fence to
avoid further arguments, Ronaldo B. Cabaog then rushed towards
my husband without any warning and suddenly struck my husband
Rolando P. Apura at his back with a thick wood and upon being hit,
my husband then faced him and raised his arm with a bolo as an act
of defense for himself so that Ronaldo B. Cabaog will stop from
further hitting him with a thick wood;

9. That Ronaldo B. Cabaog again struck my husband with the thick
wood that he is holding which caused my husband Rolando P. Apura
thereafter to fell on the ground after he was hit on the head and
thereafter, Ronaldo B. Cabaog together with his companions
Joemartin D. Cordero and Elson Cordero alias Pikok, they mauled
my husband while he was lying on the ground facing downwards;

10. That while my husband Rolando P. Apura was lying flat on the
ground facing downwards and being mauled by the three of them,
Joemartin D. Cordero was trying to take hold of the bolo that my
husband was holding however, my husband was trying everything
that he can to retain the possession of the bolo up to the extent where
he put all his efforts in holding the bolo at the expense that he was no
longer defending himself from the three of them so that Joemartin D.
Cordero will not take the possession of the bolo from him;

11. That when I saw my husband Rolando P. Apura fell to the ground
helpless and being mauled by Rolando B. Cabaog, Joemartin D.
Cordero and Elson Cordero, I then rushed towards my husband to
protect him from their attack by lying on the back of my husband
while hugging him at the same time telling them to stop mauling my
husband;

12. That Ronaldo B. Cabaog then started to pin me to the ground

through my back while I was protecting my husband which caused
too much pain on my part considering that I was pregnant and
Ronaldo B. Cabaog did not bother to heed to my request to stop it for
I might suffer miscarriage on my pregnancy;

13. That minutes later, a number of persons came in the area where
they pacified and stopped the aggressors of my husband and I was
then carried away to the side of the incident by Mario Dela Cruz
considering that I cannot stand from too much pain and I was
thereafter carried by Arnel Maalom towards the road to be brought to
the hospital considering that I suffered vaginal bleeding;

14. That moments thereafter, Police Officers came and I was brought
to the hospital. I was later on shocked when I was informed that my
husband was the one who was brought to the Police Station and was
arrested when in truth and in fact, I and my husband Rolando P.
Apura were the victim in this incident;

15. That I and my husband tried to report the truth of the said
incident to the Barangay of Agbatuan, Anilao, Iloilo, through our
Barangay Secretary however, she refused to cater our complaint
considering that she told us that she was instructed by the Punong
Barangay of our place in the person of Robert Amable not to record
the said incident;

16. That the allegations contained in the sworn statements of Ronaldo

B. Cabaog and Joemartin D. Cordero were all fabrications and

 products of their concocted facts to twist the true incident that
transpired on May 28, 2016 at around 8:00 in the morning in our
sugarcane farm at Brgy. Agbatuan, Anilao, Iloilo;

17. That moreover, my husband never hacked Ronaldo B. Cabaog

during the whole incident when they attacked him for if indeed just
for the sake of argument my husband was the one who attacked them
first and intentionally hacked Ronaldo B. Cabaog, he will not sustain
only a shallow injury in his arm nor my husband will be mauled by
the three of them for my husband could easily hacked them to death
since that the companions of Ronaldo B. Cabaog were unarmed and
could have attacked them when they were still not in a position to
defend themselves;

18. That the injuries sustained by Ronaldo B. Cabaog could have

come from their acts of mauling my husband while the latter was
protecting the bolo to be taken away by Joemartin D. Cordero from
his hand while he was lying on the ground;

19. That a careful perusal of the Complaint and Sworn Statements of

RONALDO B. CABAOG and JOEMARTIN D. CORDERO, there is
clearly no basis to charge my husband of FRUSTRATED MURDER as
there was no sufficient evidence to speak of and such incidents
mentioned in their Sworn Statements were all products of their made-
up imaginations to indict me of a crime which I did not commit and to
twist the true facts which transpired on May 28, 2016;

20. That given the foregoing circumstances, the case filed against my
husband for FRUSTRATED MURDER should be dismissed;

21. That I am executing this affidavit to attest to the truth of the

foregoing facts stated hereto, to refute the allegations of Ronaldo B.
Cabaog and Joemartin D. Cordero, and for whatever legal purpose it
may serve.
