Town of Scituate
RESOLUTION OPPOSING THE SEPARATION OF THE DAM FROM THE REST OF
THE PROPERTIES LOCATED AT THE HOPE MILL

The Town Council of the Town of Scituate hereby resolves as follows:

WHEREAS, the dam on the Pawtuxet River at Main Street and Hope Furnace Road in the Town
of Scituate, located on Tax Assessors Lots 58 & 69 on Plat 5 (hereinafter, Hope Mill Dam),
has been in historical common ownership with property commonly referred to as the Hope Mill;
and

WHEREAS, the RI Department of Environmental Management has classified the Hope Mill
Dam as a significant hazard dam and during an inspection of the dam in 2012 determined the
embankment to be in fair to poor condition and the spillway to be in fair condition; and also has
approximately 12 outstanding deficiencies on file with DEM; and

WHEREAS, the Hope Mill Dam may be in need of serious maintenance and repair to ensure the
health, safety and welfare of the Hope community; and

WHEREAS, the Town Council of the Town of Scituate (hereinafter Town Council) is
concerned that the safety of the general public is endangered by physical condition of the Hope
Mill Dam; and

WHEREAS, the condition and repair of the Hope Mill Dam must be considered and included in
any development of the Hope Mill.; and

WHEREAS, failure to integrate the maintenance and repair of the Hope Mill Dam with
development of the Hope Mill will encourage further disregard for the maintenance and repair of
the dam and could lead to its abandonment altogether, resulting in an unsafe condition for the
residents of Hope and the rest of the Town of Scituate.

NOW THEREFORE, BE IT RESOLVED that the Town Council of the Town of Scituate
hereby advocates the integration of the Hope Mill Dam with any development of the Hope Mill
to assure for the proper maintenance and repair of the Hope Mill Dam and to prevent an unsafe
condition for the residents of the Town of Scituate.

BE IT FURTHER RESOLVED that the Town Clerk is hereby instructed to submit a copy of this
resolution to any and all entities that may have jurisdiction over such a separation.

The RESOLUTION shall take effect immediately upon the date hereof.
