Gauger 864, a peace officer in and for the City of Bedford, Tarrant County, Texas, and after being duly sworn on oath, deposes and says that he has good reason to believe and does believe that MMIII 3 cor ited the offense of MURDER, TX 19.02(b)(1), THEN AND THE! I On June 19" 2017 at approximately 2015 hours, Bedford Police Department Officer Thomas was dispatched to 1702 Oak Creck Lane C, Bedford, Tarrant County, Texas in reference to a runaway. Upon arrival he met with Trisha West. Trisha advised that her daughter Kaytlynn Cargill, a white female born January 18, 2003 left her apartment to walk her dog around 1820 hours and had not retumed home. Trisha stated that she went to look for Kaytlynn and discovered the dog tied up at the dog park in the apartment complex. Kaytlynn was entered into the NCIC/TCIC database as a runaway. 0 On June 20" 2017 Kaytlynn was still missing. On this date it was leamed that a juvenile identified throughout this affidavit as “Source 1” witnessed a digital message relating to a drug transaction between Kaytiynn and a black mele known 2 iil HMMs later identified as Source 1 believed that Kaytlynn was supposed to meet Hin the pool area of the apartment complex in the 1600 block of Oak Creek Lane On June 20, 2017 Detective Shelley and Detective Cottongame learned that [IEEE had been staying at 1610 Oak Creek Lane C for approximately two weeks prior to this date (located in close proximity to the pool). [il stated that he arrived at the dog park at which time he observed Kaytlynn’s dog. INEM stated that he did not meet with Kaytlypn and he went back to MIMI apartment. He stated that his “uncle” then picked him up at the apartment at approximately 1800 hours. Upon completion of the autopsy Hicks learned that the female was identified as, Kaytlynn Cargill. v On June 23" 2017 Investigator Hicks conducted a voluntary interview with Source 1 and his Mother. During the interview Investigator Hicks learned that on the date of her disappearance Source 1 was at Kaytlynn’s apartment smoking marijuana. While at the apartment Source 1 advised that Kaytlynn received a digital message from| questing to meet in the apartment complex in regards to purchasing and selling marijuana. During that conversation Source 1 advised that Kaytlynn was supposed to meet pa another unknown person deseribed by’ his brother. Source 1 stated that| requested that Kaytlynn come alone and not bring him or her dog. Source 1 advised that he knows| [because he used to live with Source 1 and his family. Source 1's mother explained that asked to leave the apartment when she learned that he was manipulating the young children and was a bad influence on the children. When Kaytlynn left her apartment to meet with ES Source 1 followed behind her with her dog. Source | stated that he followed Kaytlynn because he was curious and concemed for her safety. Source | added that he was concemed because has been aggressive and disrespectful to females. Source | observed Kaytlynn meet with IIE at the pool area located in the 1600 block of Oak Creek Lane, in close proximity to building 1610, Source 1 then observed Kaytlynn run away from I at which time they met up. Source | explained that Kaytlynn ran away because IMond the unknown male observed Source 1 watching them. ‘They then returned to Kaytlynn’s apartment, Approximately one hour later Kaytlynn and Source 1 walked to the dog park area located in Oak Creck Apartments, When they arrived, Kaytlynn lefi the dog with Source | and she walked west through the complex towards the location where she had met with Ilan hour earlier. Kaytlynn was never seen again, ‘Source 1 tied the dog up in the dog park and began playing basketball with his friends while he waited for Kaytlynn, After waiting for Kaytlynn at the dog park for approximately 30 minutes, Source 1 went back to his apartment. When he arrived he sent a digital message to Kaytlynn checking on her welfare. EMstated that she spoke with Ion the phone on that Monday June 19" 2017 at approximately 1900 hours when he told her that he was leaving the residence with his uncle who he identified as MRE stated that left his key to the apartment, locked the front door and exited through the back sliding glass door. On June 20" 2017 Detective C. Regan requested an Exigent Circumstances request for cellular telephone records on [EEE s cellular telephone number KIMon 06/20/2017 and forwarded them to me for review on 06232017. On June 23" 2017, | reviewed the exigent cellular telephone records for EE related to his whereabouts the night of the disappearance of Kaytlynn Cargill that were obtained by Detective C. Regan, Treviewed those records and found the following items of concern: L reviewed the records for 06/18/2017, 06/19/2017 and 06/20/2017 06/21/2017 and 06/22/2017. © [found that from 16:55 to 18:06 there are 3 incoming calls for A. 16:55, 0 minutes &.17:21, 44 seconds I, C. 18:06, 4 minues Zt RR | found trom the key that T-Mobile provided that those calls were answered. © The 3 above mentioned cellular telephone calls to [cellular telephone pinged off the tower at 541 Bedford Road, Bedford, Texas 76021. + [found thet at 19:27 i s Uncle calicd and eft SD amessage and it was said the [JIMMhis Uncle arrived at 1610 Oak Creek Lane Page 5 PC 207185 s ARREST WARRANT AFFIDAVIT NUMBER: 1721386A, STATE OF TEX/ COUNTY OF TARRANT § Bedford, Texas and picked [MMU and drove him to his house ot VI On June 25" 2017 I responded to 1610 Oak Creek Lanc IMB cdford, Texas 76022 with Detective Shelley, Inv. Hicks, Inv. Versocki and Crime Scene in relation to a consent search of the apartment that EEE had been staying at for approximately two weeks. MMMM advised that they had consent to search her apartment and wished to help us in any way. While walking through the apartment on this date Bedford Police Department Crime Scene Technician B. Magee located small areas of what appeared to be blood spatter along the hallway walls and several doors inside the apartment to include the bathroom door, bedroom that AIH stays in and the hallway closet door. Bedford Police Department Crime Scene Technician B Magee found small areas of what appeared to be blood on the blinds in the kitchen area that leads out to the patio. There also appeared to be blood on the patio sliding glass door handle, Bedford Police Department Crime Scene Technician B. Magee Bedford Police Department Crime Scene ‘Technician B. Magee and L. Lobdell began processing the scene. Bridger’s vehicle and once they arrived back at the Bedford Police Department, Crime Scene Tech Magee, responded and took possession of the bag as they believed it may contain possible evidence. Page 6 PC 3165 STATE OF TEXAS § ARREST WARRANT AFFIDAVIT NUMBER: 1721386A COUNTY OF TARRANT § VIL On July 18" 2017 on this date, Kristen Hammonds, a Senior Forensic Biologist for the Tarrant County Medical Examiner's Office, gave a verbal confirmation that Kaytlynn Cargill’s blood was found on the swab obtained from the hallway closet door frame, the swab obtained from the bathtub, and the swab obtained from the outside back patio railing, x On July 28" 2017 on this date, Investigator Hicks met with Source 1 again who advised the following: Source | stated that the first mecting withvas supposed to happen so could give Kaytlynn and Source 1 the marijuana so they could make dabs. vas going to give them the marijuana and not charge them for it. Afier they made the dabs, Kaytlynn was going to sell it back to[knd his brother making the $300.00 that she was going to split with Source 1. Source 1 said that when Kaytlynn went to meet with [lhe second time she told him “I'm going to get the money”, He never saw her again after that. x On August 2™ 2017 on this date and based on the above-mentioned facts, I presented and ‘obtained a search warrant for the address of EM Fort Worth, Texas 76119. XI On August 3 2017 at approximately 0915 hours the Bedford Police Department executed the above-mentioned search warrant at [I Fort Worth, Texas. SJ end Mr. (Pere contact and allowed to sit outside the residence. ‘The Bedford Police Department Crime Scene Technicians B Grice and L Lobdell began to process the scene searching for evidence related to the murder of Kaytlynn Cargill. During the search of the residence Bedford Potice Department Crime Scene Technicians B Grice and L. Lobdell collected 17 pieces of evidence related to the case. Those pieces of evidence are documented in the crime scene report done by Bedford Police Department Crime Scene Technician B Grice. He showed the note to her and she stated that it was INNN's handwriting. INMBtated that |was attempting to create an alibi with her and told her to write down times and things they would have been doing on that date. She stated that she was suspicious of HS gep in staying in contact with her around that time that Kaytlynn was supposed to come by the apartment, I stated that the conversations about his alibi were over Facetime because IIE was worried that his telephone conversations were being intercepted. XII On August 18" 2017 I reviewed the official DNA report prepared by Kristen Hammons B.S. Senior Forensic Biologist report. She reported that she found Kaytlynn Cargill’s DNA ona Hammer (item22.1), swabs from the south hallway door frame (item 21.1), and bathtub(23.1), swabs from the side of the patio ledge(19.1) which were a match to Kaytlynn Cargill’s blood a (10.1). These a were all collected from inside the apartment located at [EE These DNA results place Kaytlynn Cargill inside the apartment located 2t [iy en the time of her murder and that the hammer is a likely murder weapon due it having Kayilyna's blood on the head of the hammer.
