Re: Constructively/Unfairly Dismissed

I refer to the above matter wherein I was appointed as a Director. Centre of A Levels by City College on
06.03.2017. I had also verbally informed the management that I will be still teaching at Brickfields Asia
College on a part time basis until my cohort of students complete their semester to which Datin
Rohaidah Shaari, the owner of City College had consented. I would like to put on record the following
events which took place over the past few months:

a) My probation period ended on 06.06.2017 and in mid July 2017 my appraisal was done
by Associate Professor Dr James. Dr james told me that he was happy with my work and
verbally confirmed my employment. He further added that the Human Resource
Department will forward me my confirmation letter the soonest (no written form of
evidence provided to me).
b) However on 26.07.2017, Dr james called me in for a meeting stating that my
confirmation has been put on hold as the management are allegedly not happy with my
work which totally took me by surprise. Dr james went on to threaten me that my
position as Director could be taken away. He added that I may also need to choose
between being either a full time or a part time Lecturer. When enquired what I had to
do to hold on to my position, Dr James had told me that I have to follow what he says
and also extended my probation for a further two months (no written form of evidence
provided).
c) My pay for July 2017 was not credited to my bank account on 28.07.2017. When I
enquired Dr James regarding this, he told me that he has my pay cheque with him and
asked me to collect the cheque on 31.07.2017.
d) When I went to collect the cheque on 31.07.2017, Dr James informed me that he will
need to hold on to my pay cheque as there is an ongoing investigation regarding my
association with Brickfields Asia College. However, I have clearly informed City College
regarding this matter prior to joining the College. They went on to pressure me
regarding this issue, Dr James in fact told me that he would take me to court before
handing my pay cheque to me much later .
e) On 21.08.2017, I was called for a meeting by Dr James. Dr James once again went on to
question my association with Brickfields Asia College and went on to tell me that I can
leave City College if I feel they are treating me unfairly. I still carried on with my usual
duties for the City College diligently.
f) On 25.08.2017, a meeting regarding Cambridge Examination was called. The meeting
was attended by all other staff as well as Datin Rohaidah. At one point during the
meeting, Datin Rohaidah shouted at me for things that I didn't do and I was not even
allowed to say anything to defend myself. Due to this incident, I walked out of the
meeting stating that I am not happy and will consider leaving the organisation.
g) The management immediately denied my access to the College email as well as
deactivated my access card.

2. Based on the incidents above, I would like to say that I have been constructively/unfairly dismissed
by City College.
