Section 4 (a) Agricultural land

This provision gives the definition of agricultural lands.

SHDA : based on the commentary of SHDA they want to add in the definition of agricultural land
that it should be based on the Comprehensive Land Use Plan as approved by the LGU.

In my opinion, it would be better to keep the definition as imposed in both house bills of Quimbo and Bag
Ao rather than inserting the phrase based on the Comprehensive Land Use Plan. It would be better that
its definition can stand alone and not based on any plan since there are also other existing laws defining it
and nevertheless, in reality agricultural lands will be included in the comprehensive land use plan.

SECTION 4 (B) AGRICULTURAL LAND CONVERSION

In both bills that last sentence says nonagricultural purposes under an approved order of conversion
issued by the appropriate government agency;

SHDA: Previously, SHDA wants approval of DAR as deleted and in this 2016 version of both bills it
is indeed deleted and replaced with appropriate government agency.

I proposed to amend it to issued by appropriate and duly authorized agency. It is better to add duly
authorized government agency because not all appropriate agencies are authorized by the law to issue
such conversion order.

SECTION 4 (H) COMPREHENSIVE LAND USE PLAN

SHDA has no comment on this.

However, I would like to insert the phrase as approved by appropriate government agencies and experts
who contributed to its study in the final sentence. This CLUP should be based on the study of experts
and appropriate agencies since it would be partly the basis of land use.

SECTION 4 (N) DEVELOPMENT PLAN

SHDA: SHDA wants to include in its definition of the the development in the national, provincial
and regional levels.

I agree with the suggestion of SHDA. It is important to include in the definition the explicit involvement of
national, provincial and regional development in any development plan of the government.

SECTION 4 (KKK) RECLASSIFICATION OF AGRICULTURAL LANDS

I suggest that there should also be reconversion of nonagricultural lands which are idle or unused
converted agri land which has potential to be reconverted. Future is uncertain and we might have
shortage in agri lands if we dont put a protection to its possible reconversion.

SECTION 13 CONVERSION OF AGRICULTURAL LANDS

SHDA: They propose to delete the second paragraph which provides for the DAR Conversion
Order.

I suggest that we dont delete it but change it to order DAR and/or other duly authorized government
agency to make it consistent with the definition of agricultural land in Section 4.

SECTION 56 COMPOSITION OF NLUPC

I commend both bills which has in its composition the inclusion of private sectors directly involved in
development. However, I suggest the inclusion as well of experts in urban and environmental planning or
other study focused on development and planning
