Exemptions on Minimum Wage Order:

For exemptions based on the nature or circumstances of employers


business as issued by NWPC, the following may be exempted:

1) Distressed establishments;
2) New business establishments;
3) Retail/Service establishments employing not more than ten
(10) workers;
4) Establishments adversely affected by natural calamities;
(Section 2, NWPC Guidelines No. 2, s. 2007)

The mentioned exemptions are not automatic. The business owner


has to file an application for exemption with supporting documents
with appropriate Regional Board. Upon approval by the board, the
exemption will only be valid for a year.

For retail/service establishments regularly employing not more than


ten (10) workers, an exemption may be granted under the following
conditions: (1) it is engaged in the retail sale of goods and/or services
to end users for personal or household use; (2) it is regularly
employing not more than ten (10) workers regardless of status,
except the owner/s, for at least six (6) months in any calendar year
(Sec. 3 (C), (NWPC Guidelines No. 2, s. 2007).

For exemptions as an establishment with not more than ten (10)


workers, it must be supported with an affidavit with the employer
stating that it is a retail/service establishment regularly employing
not more than 10 workers for at least six (6) months in any calendar
year, and business permit for the current year from the appropriate
government agency. (Section 4, NWPC Guidelines No. 2, s. 2007).
