SUBSTITUTION OF HEIRS

SUBSTITUTION is the appointment of another heir so that


he may enter into the inheritance in default of the heir
originally instituted. (857)

SUBSTITUTION is a disposition by virtue of which a 3 rd


person is called to receive hereditary property in lieu of
or after another person.

KINDS OF SUBSTITUTION

1. Simple or Common
a. Instituted heir dies before the testator;
b. Incapacity of the instituted heir to
succeed from the testator; and
c. Refusal or repudiation of the
inheritance by the heir.
2. Brief or Compendious
3. Reciprocal
4. Fideicommissary
