( A comparative Study)

ABSTRACT

The responsibility for the damages resulting from the works of both the contractor and
the engineer has been of interest to lawyers since the ancient times. This interest is
attributed to the fact that faults in the buildings pose hazards to peoples lives and
properties. The responsibility for the collapse of buildings has gone through various
developments over the years to the extent that it is now a self-dependent theory whose
provisions constitute an important part of civil responsibility. Apart from the legal rules
pertaining to the civil responsibility for the professional errors perpetrated by both of
the contractor and the engineer thereby causing building defects, the Jordanian
lawmaker has drawn up legal rules regulating a special type of responsibility in which
both are bound to insure the building safety and strength for a period of ten years from
the date of delivering the building. These are called the provisions of decimal
guarantee .

Modern methods of building have been devised to construct very high buildings with
new designs which are different from those of earlier periods. Such methods prompted
the engineers and contractors to look for means and methods which enable them to
make as much profit as possible. However, profit sometimes comes at the expense of
the construction strength and quality, and also leads to violating the standards and
measurements. This often ends up in the total or partial collapse of the building or
results in hidden faults within the building which involve some degree of risk.

In view of the growing costs and huge size of the buildings and constructions along with
the losses that might affect persons or assets, along with the resulting large
compensations which the incumbent alone cannot often bear, protecting both of the
harmed party on the one hand, and the person responsible for compensation, on the
other hand, has become an essential requirement. As a result of the possible
socioeconomic losses, the lawmaker has been bound to intervene for drawing up a legal
regulation whereby mandatory insurance can be imposed against the civil responsibility
for both of the contractor and the engineer. This is hat some countries like France and
Egypt have done in the sense that they issued a law providing the engineers and
contractors with compulsory insurance against building accidents liabilities. As the legal
regulation in Jordan still includes no provisions for compulsory insurance against this
liability, I have chosen this topic as one of the components of the dissertation, and to
study such topic in light of the other legislations. I have also attempted to come up with
the proper legislations which can be included within the provisions of the regulation that
will be hopefully established in Jordan in order to come to grips with the legislations
which adopted this regulation.

The topics of this dissertation have been addressed through discussing the provisions of
decimal guarantee in the introductory chapter. The provisions of this guarantee have
been studied, through identifying the intended meaning and conditions of the decimal
guarantee. Then, it has been necessary to discuss the extent of decimal guarantee within
the personal and objective extents finally I this discussed the reasons of excluded this
guarantee .

The main Chapters have discussed providing insurance for both of the contractor and
the engineer against the civil liability. This chapter presented us with an explanation of
the meaning of liability and the nature of this insurance which we can distinguish from
similar legal regulations. It has, therefore, been quite essential to discuss this insurance
on the personal and objective levels and to emphasize the need to address the provisions
of insurance against liabilities. This discussion took the form of elaborating on the
