1.On May 11, 2017 at 0234 hrs Patrolman Stacy Cavazos and I, Corporal Michael Yaws, were
patrolling the area of 900 W. Main Street. We were traveling westbound operating a fully marked
Edna police patrol unit and wearing our standard issue Edna police uniforms. During that patrol we
saw a silver vehicle coming into town on W. Main.

2.As the vehicle passed I noticed it had a defective license plate light (not visible). A number
of businesses in that area of Edna had recently been burglarized so we had been paying close
attention to all late night movement in that area. I turned around to catch up to and stop the
driver for the violation. As I turned around the vehicle was already approximately 3 blocks away.
As I was trying to catch up to the vehicle the driver made a sharp, quick turn onto N. Pumphrey
Street.

3.As I approached Pumphrey Street we noticed the vehicle to already have turned right onto
Hickory. We also noticed the driver had turned off the vehicles head lights as it was travelling
west on Hickory. I was driving 60 mph in a 30 mph zone in an effort to catch up with the vehicle.
I believed the driver was attempting to flee. At that time I decided to stop the vehicle. I
turned onto Hickory and activated my marked patrol units overhead emergency lights as the driver
turned left onto S. Colorado and proceeded south at a high rate of speed. The vehicle was
approximately 100 yards ahead of us at that point.

4.I attempted to catch up to the vehicle as it turned left onto Dugger Street. On Dugger Street
I activated my audible siren in addition to my overhead lights. The vehicle turned right onto
Pumphrey and then right onto W. Gayle. The vehicle continued to travel at a high rate of speed.

5.As I continued to follow the vehicle on Gayle we reached speeds of 90 miles per hour. The
vehicle then turned left onto Apollo Drive, also known as FM 1822. I continued to pursue the

vehicle out of the city limits. There was no traffic on the roadway and the pavement was dry.

6.The pursuit continued on FM 1822 and reached speeds of over 120 miles per hour. The driver of
the vehicle continued to turn the lights off and on. I pursued the vehicle. In my estimation I
never got any closer than 100 yards and was sometimes as far away as 300 yards.

7.As we came out of a curve just west of FM 3131 we noticed the vehicle was several hundred yards
ahead of us and was coming up on the stop sign at FM 3131 with a turn signal activated. I thought
the vehicle turned right onto FM 3131 but Cavazos and I lost sight of it.

8.As we approached FM 3131 we could not see where the vehicle went. I turned right, drove slowly
for a short distance, then stopped and shined my patrol units spot light around. I saw damage to
the Lavaca-Navidad River Authorities main gate, which was directly to our east. I notified
dispatch that the suspect vehicle had gone through the gate at LNRA.

9.I drove up to the gate and found that the vehicle had crashed into the gate. The vehicle
appeared to be in two halves. Officer Cavazos and I exited our unit cautiously. I told dispatch
to send EMS and more officers.

10.After a search we found the other half of the vehicle in a ditch about 20-30 yards beyond the
main gate. Officer Cavazos alerted me that she had a visual on a man hanging out of the driver
seat.

11.I again told dispatch that EMS was required and there was a person inside the car and the car
was smoking. We yelled to the person but he didnt respond.

12.The vehicle was on an incline in the ditch. I believed it was not safe for Officers to
attempt to get close to the vehicle because it could possible roll over.

13.Officers Thompson arrived to assist. The three of us started a search of the area to make
sure nobody had been ejected from the vehicle. We did not find anyone in the immediate area.

14.I was able to find a license plate for the vehicle still attached to a detached bumper. The
plate was run through dispatch and it came back to owner Iesha A. Barnes, 1400 N. Wells, Edna,
Texas 77957. The vehicle was a silver 2006 Acura 4-door.

15.Jackson County Deputy Steven Lang and LNRA Security arrived and I advised them we needed EMS
and Fire to continue to search the area to make sure there were no injured parties lying in the
field somewhere.

16.While looking through the debris from the car we found some mail with the name Iesha Barnes on
it and some more with the name Emmitt Harris on it. Officer Cavazos started taking photographs of
the scene.

17.EMS personnel had arrived and came to me and advised me that the man was deceased and to have

dispatch contact the Justice of the Peace. I looked at the black male but I did not recognize him.

18.While waiting for a Justice of the Peace to arrive we continued to search the area for anyone
that could have been ejected. Edna Fire Department Nick Straus used their infrared tool to search
the area. We didnt find anybody.

19.Lavaca-Navidad River Authority Director Jimmy Kaelin arrived and assessed the damage to the
property.

20.While searching the area Officer Cavazos found a small white bag that was broken open and a
white powdery substance was coming out of it. The bag and the white powder were collected in an
evidence bag.

21.On the ground around the vehicle a damaged cell phone was found along with several twenty
dollar bills. The money was collected and put into an evidence bag.

22.After the Justice of the Peace Judge Cindy Poulton arrived she pronounced the subject
deceased. The Edna Fire Department proceeded to extract the subject from the vehicle.

23.The man was identified as Emmitt James Harris though a jail photo and then his Texas drivers
license was found inside the vehicle. Neither Officer Cavazos nor I had ever had any contact with
Harris.

24.Several more five, ten, and twenty dollar bills were found inside the vehicle. The money was
collected and added with the other money in the evidence bag. Another LG phone was found in the
passenger floor board and was collected too.

25.Emmitt Harris was photographed after he was extracted from the vehicle. More money was found
in his pockets and it was put in the evidence bag with the other money. We also collected the
mail and a notebook for safe keeping.

26.After collecting all the evidence and property I secured it in the back of my patrol unit to
be taken back to the Edna Police Department and put into an evidence locker.

27.The wrecker driver, Sid Clifton, arrived and took the vehicle from the scene. At that time we
were released from the scene. Officer Cavazos and I took the evidence and property back to the
Edna Police Department where it was secured in an evidence locker.

1. On May 11, 2017 at approximately 0234 hours Corporal Mike Yaws and I were patrolling in the

standard issue police uniforms. We were traveling west when we observed a small grey car
traveling east at a slow rate of speed. Corporal Yaws stated that the vehicles license plate
light appeared to not be working. He turned around to catch up to the vehicle.

2. By the time we were able to catch up to the vehicle it appeared to have increased its speed
significantly. I observed the driver to take a hard right turn at the traffic light at West Main
and South Pumphrey. The driver appeared to be attempting to flee. The driver made a sharp, hard,
right turn onto Hickory Street in a residential neighborhood. I then observed the driver to
black out the vehicles lights and continue traveling at a high rate of speed on Hickory toward
South Colorado. The driver turned left onto South Colorado, failing to stop at the designated
stop sign and failing to signal the turn, and headed south toward Dugger Street. We activated our
emergency lights at Hickory and South Colorado. The driver was still traveling at a high rate of
speed with the lights blacked. The vehicle approached Dugger Street where the driver again failed
to stop at the designated stop sign and failed to signal a turn. The vehicle made a hard left
turn onto Dugger Street. The driver was still turning the lights off and on. We then activated
our emergency siren at Dugger and Dennis Street in an attempt to further get the driver to stop.
The vehicle approached South Pumphrey where the driver again failed to stop and failed to signal a
turn. The vehicle made a hard right turn onto South Pumphrey and headed south toward West Gayle
Street. The vehicle was traveling at dangerously high speeds and we were unable to catch up to
it. The vehicle approached West Gayle where the driver again failed to stop at the designated
stop sign and failed to signal a turn. The driver took a hard right turn onto West Gayle heading
west toward Apollo Drive. The vehicle was traveling in excess of 70mph in a 30mph zone. We
reached speeds of 90mph attempting to catch up to the vehicle but were still unable to keep up. I
observed the vehicle to approach Apollo Drive where the driver again made a sharp, hard, left turn
and began heading south on Apollo Drive. The vehicle continued on Apollo Drive and headed out of
the city limits on 1822. The driver continued to turn the vehicles lights on and off. I further
observed the vehicle to travel down the center of 1822 while completely blacked out. The vehicle
continued south on 1822 at speeds in excess of 120mph. The vehicle then approached 3131 in front
of the LNRA Headquarters. At this time we were approximately mile behind the vehicle. I
observed the driver turn the vehicles right signal light on and attempt to make a right turn
towards the dam. The driver did not stop at the designated stop sign at 1822 and 3131 and lost
control of the vehicle.

3. The vehicle had struck the main entrance gate to the LNRA Headquarters. The gate is made of
thick, heavy, steel and pipe. It appeared that the vehicle split in half at the point of impact
with the gate. I observed the rear end of the vehicle to be up by the main entrance where the
gate had been. I observed the front end of the vehicle to be approximately 10-20 yards away,
close to the creek inside the LNRA fence. At this time we were still unsure where the driver of
the vehicle was. We had dispatch go ahead and get EMS en-route to our location. The driver was
then located pinned inside the vehicle, seat belted in the drivers seat and unresponsive.
Dispatch was advised to also send fire and rescue and to contact Chief Wooldridge and Captain
McConathy to advise them of the situation. EMS arrived on scene and advised us that the driver
was DOA. Dispatch was advised to send a JP to our location along with State Troopers. I was
able to identify the driver through dispatch as Emmitt James Harris of Edna, Texas.

NARRATIVE:
4. Pictures were taken of the scene and evidence was collected and placed in the evidence locker
at the Edna Police Department. Miscellaneous paperwork was collected from the debris to help
identify the driver and family members. Also collected were numerous wads of cash from inside and
around the front end of the vehicle. Cash was also collected from Harris pants pocket. The cash
totaled $800.00. Among the debris I located a cream colored packaging bag with a white powdery
substance inside. I collected the bag and substance to be tested at the Edna Police Department.
I also located a black cell phone in the debris on the roadway and another white cell phone was
located in the front end of the vehicle next to where the driver was sitting. All evidence was
collected and placed in the evidence locker at the Edna Police Department.

5. The crash Investigation is being conducted by the Texas Department of Public Safety.

SUPPLEMENT #5 Captain Bruce McConathy - 81877 06/06/2017 07:32

At around 0245 hours on 05/11/2017 I was notified by Corporal Yaws that he and Patrolman Stacy
Cavazos attempted to make a traffic contact that resulted in the suspect fleeing and eventually
crashing his vehicle into the gate at LNRA. The suspect was believed to be deceased at the scene.
I arrived at the location around 0300 hours and supervised the on scene investigation. I called
Texas Ranger Drew Pilkington who in turn put me in contact with Ranger John Lingle. Lingle came
to the scene and assisted Corporal Yaws with his investigation. I also contacted District
Attorney's Investigator Craig Repka who in turn contacted District Attorney Pam Guenther. Ms.
Guenther came to the scene also.

Shortly before 0600 hrs. Iesha Barnes and her mother Juliet Jones arrived at the scene. Ms.
Barnes is the registered owner of the vehicle that crashed and the girlfriend of the deceased
suspect. Juliet Jones told me that Emmett Harris called Iesha and told her that the police were
trying to stop him. He also told Iesha that he wasn't going back to prison.

On 05/11/2017 all the evidence collected was brought back to the Edna Police Department. I
conducted a NIK swab on the white powdery substance that had been located in the debris from the
crash. The substance tested negative for cocaine. It is believed that the substance is a type of
packaging material and not narcotics. The substance was entered into evidence and placed in the
evidence locker at the Edna Police Department.

1. Investigator Bubela and I have had several conversations with Kelsey Harris, who says she is
the daughter of Emmitt James Harris. She has been interested in the disposition of the money
collected at the scene. Kelsey says that her father has seven children by multiple mothers. She
says that his own mother, Peralene Caples of Grand Prarie, was listed as his surivor on the death
certificate. She said that her father died without a will and there is no named executor of his
estate. I explained to Kelsey that some of the money was found on her father's person, but some
was found on the ground amongst the debris and some was found in the car. I told her that the
owner of the car may be entitiled to part of the money. Kelsey asked me if she could ask me a
question. I told her she could. She asked how many of Iesha's relatives worked for me. I told
her none that I knew of. She then said that she would rather see the money shredded than go to
Iesha. She said that she knows the money belonged to her father. I asked her how she knew that.

NARRATIVE:
I asked if her father had any income other than singing his rap music. She said that he might
have still been driving a hot-shot truck, she wasn't sure. She said that one member of her family
knew that her father had that money.

2. Kelsey then asked my why Iesha was allowed to go to the crash scene and take three bags of her
father's clothes. I told her I was unware of that.

3. I made telephone contact with Iesha. She said she didn't take three bags of Harris' clothes
from the scene. She said he has been living with her for two years and he has lots of clothes at
her apartment. She said she did pick up some little things, some cds, some papers, things like
that. I asked her if she had money in the car. She said she had been keeping money in the car,
she knew it to be $800.00, because she was saving it to take her paramedics class. She said she
kept the money in the center console and some in an compartment underneath her CD player. Iesha
works in the emergency room at Detar hospital.

4. I called Kelsey Harris and spoke with her about who paid for the funeral. She wanted to know
why I asked that. I told her it seemed logical when deciding who should get the money left in the
car. She said she thought her grandfather, David Caples, (972) 854-3393 has been heading up the
collection of money for the funeral service. .

4. At this time I am trying to identify how much money came from Harris' person and how much from
the ground and the car.

1. I spoke with City Attorney Jake Srp regarding the disposition of the money. He asked who
would I normally give property from a vehicle to. I told him that normally, if property was in a
vehicle, I'd release it to the vehicle owner. In fact, property normally stays with the vehicle
and the wrecker driver releases the property along with the vehicle to the property owner, in
cases where there are no holds on the vehicle. He recommended this property be handled in the way
tha I would normally handle any other case.

2. I instructed Investigator Bubela to release the money that was Harris' person to Kelsey and
the money that was in the car to Iesha.

as some of the property she requested. I told her that I would need to get with Captain McConathy
to see what can be released to her. I told her that I could release any paperwork and wallet that
belonged to her. She said that the money that was in the car belonged to her. She said that the
family already has the money that was on Harris. She said that her money was in her car.

3. Iesha became rude and asked if I understood that it was her car. I told her most people dont
keep money or cash in their car. I told her that I would believe that any money in the car
belonged to him, not her. She insisted that his money was on him. I told her that I would call

4. CALL BACK TO IESHA BARNES

5. I called Iesha Barnes back on the afternoon of May 23 at about 1517 hours. I told her that
only her paperwork, wallet, and workbook could be released to her. I told her that there would
more than likely have to be a property hearing for the money and phones. I told her that I would
have to see how the property hearing would work. I did tell her that money was taken from a
business in town at about the same time frame. She said that was her money and that he was coming
from Victoria. I asked her where she got the money. She said that she works and that she was
supposed to deposit it that day but that he was gone in the car. She said that was the only money
she had and that it was to be deposited because it is the end of the month and her bills need to
be paid. I asked her how she got the money or if she went to the bank. She said that she got it
off of a prepaid card. I asked her if it was done at an ATM machine and she agreed that it was.
She talked in circles. She said that she cant tell me the denominations of the money. She then
said that she doesnt believe that she got it from an ATM and she wasnt sure. It was obvious
that she wasnt sure about the money and was trying to get it. I dont believe that it was her
money. I did explain to Iesha ways that she could prove that she took the money off of her card.
She said that Harris had just gotten out (of either jail or prison) meaning that he did not work.

6. IESHAS PERSONAL PROPERTY

7. I was able to power on the LG phone that was in the property. The phone number on the phone is
361-652-5074 and in the contacts, Ieshas phone number is listed under Boo Luv. This makes me
believe that the phone did belong to Emmitt Harris. Photos were taken of the phone, wallet, and
paperwork to be released back to Barnes.

8. On the morning of May 24 at about 10:10 hours, the workbook, wallet, and miscellaneous
paperwork belonging to Iesha Barnes was released to her. She did ask some questions about the
incident including asking which officer hit the back of her car. She was told that the officers
never got close enough to get his license plate number. She again asked for her money so that she
could pay her bills. She said that her rent was due on the first. She could only name the
denomination of the bills to be between hundreds and ones. The property was released to her and
there is a video with audio recording of the conversation.

9. PROPERTY DISPUTE

10. Iesha Barnes was claiming that the money was hers and Harris eldest daughter, Kelsey Harris,
was attempting to get the money and phone. I spoke with Judge Stancik about a property hearing
and I was told that since Harris was deceased, it would be better handled in District Court. I
spoke with District Clerk Sharon Mathis and she said that the money could be released to her
court, but she believed that it would best be handled as a seizure through the Jackson County
District Attorneys Office. I was directed back to the district clerks office.

11. Chief Wooldridge made the executive decision to give $50 and Harris personal property to
Kelsey Harris and to give the remaining $750 to Iesha Barnes.

12. On the morning of June 29, the personal property and $50 was released to Kelsey Harris.

13. On the afternoon of June 29, the remaining $750 was released to Iesha Barnes. (See property
