Resolution 92/98 and UL Services

Thank you for your interest in the product certification services of UL in Argentina. This brochure provides
you with information about UL and explains the process of certification, the main steps, the rights and
obligations as well as answers to frequent questions.

UL de Argentina S.R.L. is accredited by the Argentine Accreditation Organization (OAA) as a Product


Certification Body and recognized by the government to provide the mandatory certification for electric and
electronic products established in the Resolution 92/98.

Furthermore, UL de Argentina S.R.L. certifies quality management systems to ISO 9001, ISO/TS
16949, OSHAS 18000 standards, among others.

UL de Argentina S.R.L is a Limited Responsibility Society of Underwriters Laboratories Holdings B.V. and
UL International, L.L.C. under the laws of Argentina.
Resolution 92/98

Generalities

Argentina has a RESOLUTION of MANDATORY COMPLIANCE, which requires that all electrical
and electronic products marketed within the national territory shall have a safety certification issued by a
Product Certification Body verifying compliance with essential safety requirements. The
Certification Bodies that take part in this mandatory system must be OAA accredited and
recognized by the national government. Pursuant to this Resolution, if products comply with the
applicable IRAM or IEC standards, the essential safety requirements are considered fulfilled.
Resolution 92/98 came into force on August 18, 1998.
Certification Models established in Resolution 92/98

At the beginning of Resolution 92/98, three sequential phases were established for its
implementation.

Phase I: Self declaration


Phase II: Type certification
Phase III: Conformity mark certification

After that, the government established the Res. 197/04 in which the Lot certification model was
added, and the possibility of choosing among Type, Mark and Lot certification was established.
The models are explained below:

Type

This certification model consists of testing samples of the product to evaluate the conformity with the standard,
followed by market surveillance. The product shall bear the official safety mark. Below are the elements of the
Type model:
Samples, selected by the Certification Body
Tests and evaluation of the product using the applicable standards
Evaluation of test reports
Reviewing of the process
Certificate issuance
Use of the official safety mark (see the example below)
Market surveillance, carrying out tests on samples selected in the market or at customer
warehouse.
Below, the official mark for Type certification is shown. The number of the certificate issued by
the Certification Body can accompany this mark. (Resolution 197/2004 and 109/2005).

Mark
This certification model consists of testing samples of the product to evaluate the conformity with the standard
and the assessment of the factory, followed by the market surveillance. The product shall bear the official
safety mark, plus the mark of the Certification Body involved in the process. Below are the elements of the
Mark certification model:

Tests and evaluation of the product using the applicable standards
Evaluation of test reports
Reviewing of the process
Factory inspection
Certificate issuance
Use of the official safety mark, plus the mark of the Certification Body (see the example below)
Market surveillance, carrying out tests on samples selected in the market or at customer
warehouse.

The main difference between Type (Phase II) and Mark certification (Phase III) is the factory
inspection (once a year as a minimum). Besides, since for Mark certification the product shall bear
the mark of Commerce and Industry Secretary (S Mark) and the one corresponding to UL
Argentina (UL-AR), the applicant must pay the annual license fee for this.
Below, the official mark for Mark certification is shown. The number of the certificate issued by the
Certification Body can accompany this mark. (Res. 799/1999).

All the products that have obtained a Mark certification shall bear the official mandatory safety S
Mark, plus the UL safety Mark UL-AR of Argentina.

If the product already has the UL-US or C-UL-US Mark issued, one option would be to
add the AR below the UL-US or C-UL-US circle and the S mark on the right, keeping all the
other required elements (control number, LISTED, etc.). Additionally, the corresponding certificate
number can be part of the marking.

Lot
This certification model consists of testing samples of the product, selected from the lot to be
certified, to evaluate the conformity with the standard. The product shall bear the official safety
mark. Below are the elements of the Lot model

Below, the official mark for Lot certification is shown. The number of the certificate issued by the
Certification Body can accompany this mark, and a reference to the lot certified shall be indicated
(Resolution 197/2004 and 109/2005).

Products under the scope of Resolution 92/98
Classification of products that fall into the scope of Resolution 92/98 and alternatives for its certification.

The following products, designated as group I in Resolution 507/2000, shall be certified using the Mark
certification model (Phase III)

Conductors for use in fixed systems, cables, fuses, fuse carriers, switches, thermo-magnetic and differential
switches, elements for installation of discharge to earth, insulating tapes, incandescent and fluorescent lamps,
sockets for domestic use, both stationary and portable.

The following products, designated as group II in Resolution 507/2000, shall be certified by choosing
between Mark certification model (Phase III), Type certification model (Phase II) or Lot certification model.

Electrical irons, electrical heaters, portable electrical tools, refrigerators, freezers, air conditioners, kitchen
electrical appliances (mixers, blenders, multiprocessors, etc.), electrical appliances for heating liquids (coffee
makers, kettles, deep fryers, etc.), appliances for personal use, (hair dryers, curling tongs), electrical shavers,
smoke extractors, bulbholders (for incandescent and fluorescent
lamps), starters and ballasts (both electrical and inductive).

The following products, designated as group III in Resolution 507/2000, shall be certified by choosing
between Mark certification model (Phase III), Type certification model (Phase II) or Lot certification model.

Lighting appliances, lawnmowers, washing machines, dishwashers, clothes dryers, industrial washers, kitchen
electrical devices, electrical water heaters, electrical hot water tanks, gas appliances with electrical
components, fans, microwave ovens, vacuum cleaners, floor polishers and other equipment for cleaning and
treatment of floors.

The following products, designated as group IV in Resolution 507/2000, shall be certified by choosing
between Mark certification model (Phase III), Type certification model (Phase II) or Lot certification model.

This group includes those products not mentioned in the aforementioned groups, but which nevertheless
require certification, such as computing devices (such as PCs, printers, scanners, etc.), electronic items (such
as audio equipment, TV, VCR, DVD, etc.), photocopy machines, etc.

The following products rated less than 50 V have been included into the scope of Resolution 92/98 by
Resolution 198/2004

Luminaries and supply systems for luminaries, supplied by sources connected to a line of more than FIFTY
VOLTS (50 V) of alternate current, dichroic lamps and their lamp holders, manual portable tools, fence
electrifiers, muscular electro stimulators which complement physical activity.
National Differences
The products shall comply with all the requirements included in the Law 22.802 Commerce
Loyalty. A summary of these requirements is:

The supply rating shall include 220 V 50 Hz


Test shall be carried out taking into consideration this supply rating
The network connection plug must be IRAM 2063 for products Class II and IRAM 2073
for products Class I. The plug, cable and coupler set shall be certified in conformance
with Resolution 92/98. The supply cable shall comply with Resolution SCI 731/87.
All warning or safety notes on the product shall be in Spanish. When these bear the
standardized symbols or refer to the users manual, all these references shall be in
Spanish in the manual.
All use or installation instructions in the users manual that imply risks for the users
safety shall be in Spanish
The rating plate shall comply with the requirements of the applicable standard. As a
reference, the following parameters shall be identified:
Registered mark or manufacturer

Voltage
Frequency
Power or current
The plate shall be in Spanish. However, the following words can be used providing they
are not confusing for the user: Voltage, Current, Power, Frequency, Model, Serial Number, Input
The packaging shall contain the following information:
Country of origin
Manufacturers data
Importers or local dealers data
General Certification Scheme

1. Quoting request
The applicant requests (by mail, fax, phone, letter or personally) a quote for the
certification required.

2. Application for certification


Once the quote is accepted, the applicant will fill in the Application Form 40-CA-F0039
with the following information as a minimum:
Scope of certification
Corporate entity, name, address and legal status
A definition of the products to be certified, the certification system, and the standards to which each
product is to be certified, if known to the applicant
A duly authorized representative of the applicant will sign the application form.

3. Application form analysis and preparation for evaluation


The Project Engineer designated by UL analyzes and approves the application form to assure:
The requirements for certification are clearly defined, documented and understood
Any difference in understanding between the Certification Body and the applicant is resolved
UL de Argentina S.R.L. has the capability to perform the certification service requested
The Project Engineer confirms the applicable standard and test plan.

4. Sampling
Once the test plan is confirmed, the sampling of products to be certified and the
identification of samples are performed.

5. Product Evaluation on Laboratory


Tests are made at third party laboratories recognized by DNCI and accredited by OAA, or, when this is not possible,
at factory laboratories which comply with minimum requirements and under supervision of UL de Argentina S.R.L. If
any non-conformity is found, the applicant is informed in order to take the corrective actions as necessary.

6. Initial factory inspection


For Mark certification, UL will sends its inspectors to perform the inspection. The inspector is sent by the closest
Inspection Center, which belongs to one of ULs affiliates, decreasing the economic impact for traveling and
expenses.
The initial factory inspection aim is to determine if the factory is capable of manufacturing the products according to
the requirements. The production quality system of the manufacturer is evaluated.

7. Outcome analysis and issuing of certificate


The Project Engineer analyzes the outcome of the evaluation and if the product complies with the applicable
requirements, the Final Report of Evaluation is issued. A qualified reviewer participates on behalf of the certification
committee revising all the records of activities and making the final decision of certification.
Preexisting Certificates

UL de Argentina S.R.L can recognize the certifications issued by UL (US) to re-validate them in the local
certification system, provided that the following requirements are met:

The standard used is IRAM or IEC, or UL harmonized with IEC


The test conditions are those required for the use under local conditions
The product meets the local Argentine differences

For Mark certification, where the factory inspection requirement is added, UL de Argentina S.R.L. accepts the
inspections performed by UL under FUS procedures (Follow Up Services), or the inspections
performed by UL under CENELEC, or CIG procedures.
For the test validation, UL accepts any of the following documents:

1. Test Report issued by UL under IEC standards or harmonized with IEC, or


CBTR and CBTC (Test report and test certificates) issued under the CB
Scheme by UL (US) or UL (Demko). This process is called FAST TRACK

In this case, the general certification scheme applies, except for the steps relating to sampling
and product testing. This scheme has the following particularities: the applicant must provide the File/Volume
numbers or the product and model to be certified. In its internal database, UL de Argentina S.R.L. then checks the
validity of the certification and the compliance with local requirements.

The applicant must provide the following documentation:


Authorization letter of the original applicant
Marking evidence according to Resolution 92/98
Evidence of compliance with the local differences

The advantages of Fast Track certification are:


Saving of money and time
No testing
No sampling

2. Test reports issued by UL under UL standards not harmonized with IEC


In this case all the steps of the general certification scheme are applied with the following
particularities: a test plan covering the differences between the requirements of tested
product and the requirements of IEC in Argentina must be prepared.
Surveillance
The authority of application has issued Resolution 96/2003 that sets forth how surveillance activities shall be
carried out.

Cancellation of certification
In addition to the established clauses in Guide ISO 27 and Guide ISO/IEC 28 (IRAM 354)
standards, UL de Argentina S.R.L. will cancel the certification if:
There is evidence of critical non-conformity on mark or certification use
There is evidence of non-conformity on financial obligation
There is evidence of non-conformity to finish a suspension
Due to change of standards and non-conformities related to that issue
Due to stopping of manufacturing
Due to contract end
Due to applicant decision
Due to an agreement between the applicant and UL
Suspension of certification
In addition to the established clauses in Guide ISO 27 and Guide ISO/IEC 28 (IRAM 354)
standards, UL de Argentina S.R.L. will suspend the certification if:
The surveillance of UL shows negative results and the corrective actions are not appropriate or effective
Modification of certified product, without a previous notification to UL of manufacturing process that
implicates modifications to the certified product
Inappropriate use of the mark
Decrease of certified product quality which impacts security
Change of materials not declared
Difficulties in use or accidents caused by the certified product
By common agreement
A notification of suspension will be sent, indicating the conditions under which it will be closed
UL will perform an audit, to verify that the causes of suspension have been overcome
Scope extension of the certification
A scope extension is related to an applicant request. The Project Engineer analyzes it to
technically sustain the extension. He may require the following:
An applicant declaration
Sampling
Inspection
Reduced or completed tests
Other technical activities that show that the changes requested by the applicant comply with the
established requirements of certification
Rights and Obligations
In order to develop certification activities, both the applicant and UL shall commit themselves in a contract to
perform certain activities. Additionally, both parties shall have certain rights. There is a list of the main rights of
the applicant and UL. It is understood that an obligation of the applicant shall constitute a right for UL, and vice
versa.
When necessary, UL shall conduct tests and inspections through subcontracted bodies. Notice shall be
given to the applicant when this happens.
The fees correspond to the activity in Argentina. When such activities involve other parts of the world, UL
shall quote them based on the local cost of ULs subsidiary at a daily or hourly rate for time and materials.
In such cases, the clients shall receive two invoices: one from UL de Argentina S.R.L. (by concept of
certification activities) and the other (by concept of inspections and testimonial activities) by ULs affiliate
identified in the invoice.
UL de Argentina S.R.L. is owner of its own stamp and administrator of the electrical safety stamp
pursuant to provisions by the Argentine Government. UL of Argentina S.R.L. is enabled to extend or
restrain the scope, suspend or cancel the authorization to use the stamps under the particular conditions
of each case.
UL de Argentina S.R.L. shall keep a record of the certificates and stamps issued, and notify the applicant
and the Domestic Trade Authority as well.
UL shall give notice in due advance of the effectiveness of any changes to its certification process that
imply that the applicant must modify, whether in whole or in part, a product or a product family.
UL shall inform the applicant immediately of any case in which the test could result in non-compliances.
The applicant may take appropriate corrective actions. After that, only the non-conformity items of the
product shall be tested. In case the corrective actions affect other parts of the product, other tests may be
repeated.
The applicant is entitled to appeal in controversies, file claims on valid technical and legal grounds against
any decision by UL de Argentina S.R.L., at any stage or instance of the certification process. The first step
in this process shall be conducted through the engineer in charge of the project.
The applicant is entitled to make a complaint to UL de Argentina S.R.L., which will record it and will take
the appropriate actions for its satisfaction. UL de Argentina S.R.L. makes available for the applicant a
procedure of complaints, appeals and disputes to solve any controversy during the certification process.

The applicant shall:


Keep a record of the claims filed by its clients related to electric safety
failures due to low voltage in the products or families under the scope of the granted
certification. The applicant shall prove that measures are being taken in relation to such
claims. The applicant shall make these records available to UL.
Comply always with the dispositions of the certification program.
Make the necessary arrangements to facilitate the evaluation, including the provision of
documentation for analysis, access to all the areas, records (including internal
audits) as well as personnel for evaluation and resolution of complaints.
Declare that he/she is certified only under the scope for which it has been certified.
Not use UL certification in a way that may discredit UL and not make
any false or unauthorized declaration. Assure that each certificate or report, or any part of them, is used in
an appropriate way. The use of certificates and stamps on products, packaging, advertising material, etc,
shall be adequate and not confusing. The inappropriate use of stamps or certificates can lead to the
cancellation of the authorization of stamp or certificate use.

In case of suspension or cancellation of certification, interrupt the use of all the advertising material, which
contains any reference to it, and bring back all the documents about certification required by UL.

Maintenance of the certification
In order to keep a certificate issued by UL active, several activities shall be performed as follows:

Follow-up inspections
For Mark certification, follow-up inspections are performed to verify the quality control of the manufacturer.
The aim is to verify that the quality control systems are maintained and improved. During the inspection, the
inspector will revise, for example, records of the tests and control the calibration records.

Annual Fee
For Mark certification, annual documental verifications are performed. This activity is called annual fee and it is
charged. As a consequence of this, due to changes in the original report, it might be necessary to issue an
amendment of the original certificate.
