Ill. Investigative Process

Trey Atchley, UT System Chief Inquiry Officer, was the lead investigator on the two complaints filed against
President Romo. James Weaver, Director of Compliance at UTSA, and Maria Perez, Senior Compliance
Analyst, assisted in the investigation. Numerous witnesses were interviewed during the investigation.
President Romo was interviewed on February 13, 2017. Emails between President Romo and the
employees were reviewed. Photographs of the employees saved on President Roma's computers were
reviewed. See sample emails and photos attached as Exhibit F.

IV. Analysis

A. Sexual Misconduct & Sexual Harassment

The evidence supports that it is more likely than not that President Romo engaged in sexual misconduct

In all three situations, President Romo requested that the employees give him frontal hugs that
all three were uncomfortable with. President Romo expected the employees to hug him regularly and on
special occasions as well. The employees feared that they could lose their jobs if they confronted him and
asked him to stop. The duration of this conduct lasted from approximately two years to four years.
Additionally, all three employees described, in varying degrees, a pattern of behavior which created, at
times, an uncomfortable working environment.

"Four years ago, when I returned to work from my President Romo


called me into his office and proceeded to tell me that I had "super-friended" him .
He said, "you super-friended me when you came up to me at your and
gave me a hug." He went on to say that he didn't have many friends because he
was never sure whom he could trust and then said that a few people in the office
used to be his friend but were no longer. He told me that the
used to be his friend but then one day got angry with him
and since then they were no longer friends . He then went on to tell me how
beautiful I looked at my and that he had taken many pictures of me and
then asked for a hug to celebrate the fact that I was back in the office ... "

stated the hugs were "disgusting", "perverted", and President Romo always squeezed her back
as tight as he could so that her chest was pressed up to his for a few very uncomfortable seconds.
President Romo was disappointed she had cut her hair for her and "caressed her head" on at
least five occasions. President Romo even emailed her an article discussing women with short hair versus
long hair. He also emailed her a photo of a mermaid that was nude from the waist up, and told her to
share the photo with the other in the office. While was
in September 2014, President Romo finally asked her if she was uncomfortable hugging him and she sa id
yes she was. The inappropriate hugging stopped at that time, but, the evidence supports that President
Ramo's obsessive and jealous behavior began soon thereafter.

The UTSA Equal Opportunity Service Department (EOS) received an incoming call from a female on Friday
February 17, 2017 stating that she saw a news article that mentioned President Romo was suspended.
The article went on to state that President Romo was going to clear his name. The woman on the phone
was infuriated and this led her to call EOS so she could tell her story. She also insisted that she wanted to
remain anonymous because she feared that if President Romo found out who she was that he would
retaliate against her. However, later she decided not to remain anonymous, and to stand with the other
individuals that have stepped forward to provide information regarding President Romo's actions. Her

was in San Antonio to attend a meeting of
At the time, she was a graduate student at UT Austin. She attended a meeting at the UTSA
Downtown Campus and then went to President Romo's house for a social gathering after the meeting.
Before departing President Romo's house to return to Austin, she mentioned to President Romo that she
needed to get gas and could he tell her where to go. President Romo told her she could follow him to a
gas station. She believes she followed him to a Valero gas station near his house. She said that while she
was standing near her vehicle, President Romo, "suddenly grabbed her by the waist and pulled her close
to him ." She characterized this as a "forceful" action. Romo forcefully pulled her body close to his body
for 20-30 seconds before he let go.

VI. Conclusion

Witness testimony and other evidence discovered during the course of this investigation supports the
conclusion that it is more likely than not that President Romo engaged in activities which constitute Sexual
Misconduct and Sexual Harassment, in violation of UTSA Handbook of Operating Procedures (HOP),
Section 9.24 and Regents' Rules and Regulations 30105 - Sexual Harassment, Sexual Misconduct, and
Consensual Relationships.
