RESOLUTION No.

991936WHEREAS
, Section 12 (2), Chapter 3, Title I, Subtitle (A), Book V
o f Administrative Code of 1987 (Executive Order No. 292) empowers the Civil
Service Commission to prescribe, amend and enforce rules and regulations
to effectively carryout its mandate;
WHEREAS
, Section 12(11), Chapter 3, Title I, Subtitle (A) Book V of the same Code
provides, in part that the Commission shall hear and decide
administrativec a s e s i n s t i t u t e b y o r b r o u g h t b e f o r e i t d i r e c t l y o r o n a
p p e a l , i n c l u d i n g c o n t e s t e d a p p o i n t me n t , a n d r e v i e w d e c i s i o n s a n d
a c t i o n s o f i t s o f f i c e r s a n d o f t h e a g e n c i e s attached to it; and
WHEREAS
, the existing rules and regulations in administrative cases need to be updated and
revised to make them more responsive to demands for speedy, fair and judicious
disposition of cases;
NOW, THEREFORE
, the Commission hereby adopts and promulgates the following rules that
shall govern disciplinary and non-disciplinary proceedings in administrative
cases.
RULE IGENERAL PROVISIONS
Section 1.
Title
. These Rules shall be known as the Uniform Rules onAdministrative Cases
in the Civil Service.
Section 2.
C o v e r a g e a n d De f i n i t i o n o f Te rm s
. T h e s e R u l e s s h a l l b e applicable to all cases brought befor
e t h e C I VI L S e r v i c e C o m mi s s i o n a n d o t h e r government agencies, except
where a special law provides otherwise. The terms hereunder shall be construed as
follows
:a.
CIVIL SERVICE
is the generic term which refers to all men and
womeni n a l l b r a n c h e s , s u b d i v i s i o n s , i n s t r u m e n t a l i t i e s a n d a g
e n c i e s o f t h e Government, including government-owned or controlled
corporations withoriginal charters.
b.
COMMISSION
refers to the Civil Service Commission (Central Officeand Regional
Offices).c.
COMMISSION PROPER
r e f e r s t o t h e C i v i l S e r v i c e C o m m i s s i o n Central Office.d.
CIVIL SERVICE REGIONAL OFFICES
refer to the sixteen (16) CivilService Regional Offices and those which may be
subsequently created,each headed by a Regional Director.

DEPARTMENT
r e f e r s t o a n y o f t h e e x e c u t i v e d e p a r t me n t s o r e n t i t i e s having the
category of a department, including the judiciary and the other constitutional
commission and offices.f.
AGENCY
refers to any bureau, office, commission, administration, board,committee,
institute, corporation with original charter, state universitiesa nd
c o l l e g e s , o r a n y o t h e r u n i t o f t h e n a t i o n a l g o v e r n me n t a s we l l
a s provincial, city or municipal government.g.
DISCIPLINING AUTHORITY
r e f e r s t o t h e p e r s o n , t r i b u n a l o r b o d y duly authorized to suspend, dismiss
or discipline officials and employeesin the Civil Service.h.
APPOINTING AUTHORITY
refers to the person, tribunal or body dulyauthorized to suspend, dismiss or discipline
officials and employees in theCivil Service.i.
PERSONNEL ACTION
refers to any action denoting the movement or progress in the Civil
Service which shall include appointment
thoroughcertification, promotion, transfer, reinstatement, reemployment,
detail,reassignment, secondment, demotion and separation from the service. j.
RESPONDENT
r e f e r s t o t h e p e r s o n wh o i s f o r ma l l y c h a r g e d b y t h e disciplining
authority.k.
PERSON COMPLAINED OF
refers to the person who is the subject of ac o mp l i a n t b u t wh o i s n o t a s ye t
f o r ma l l y c h a r g e d b y t h e d i s c i p l i n in g authority.l.
PARTY ADVERSELY AFFECTED
refers to the respondent againstw h o m a d e c i s i o n i n a d i s c i p l i n
a r y c a s e h a s b e e n r e n d e r e d o r t o t h e disciplining authority in an
appeal from a decision exonerating the saidemployee. (as amended by CSC
Resolution No. 021600 published Dec.29, 2002 in TODAY.)m.
FORUM SHOPPING
refers to the filling of an administrative action or complaint before another
agency or any tribunal against the same partyinvolving the same acts or causes
of action and relief.n.
QUALIFIED NEXT-IN-RANK
refers to the employee who is appointedunder a permanent status to a position
previously determined to be a next-in-rank to the vacancy and who meets the
requirements for appointmentthereto.o.
THIRD LEVEL
refers to positions in the Career Executive Service
(CES)wh i c h i n c l u d e Un d e r s e c r e t a r y, A s s i s t a n t S e c r e t a r y, B u r e a u D
i r e c t o r ,R e g i o n a l D i r e c t o r , As s i s t a n t R e g i o n a l Di r e c t o r a n d o t h e r
o f f i c e r s o r equivalent rank.

PROBATIONARY EMPLOYEE
refers to the employee who is issuedan original appointment and who is
required to undergo the first six (6)months of service on a probationary
status.Section 3.
Technical Rules in Administrative Investigations
. Administrative investigations shall be conducted without necessarily adhering
strictlyto the technical rules of procedure and evidence applicable to judicial
proceedings.Section 4.
Jurisdiction of the Civil Service Commission
. The Civil
ServiceC o m mi s s i o n s h a l l h e a r a n d d e c i d e a d mi n i s t r a t i v e c a s e s i n s t i
t u t e d b y, o r b r o ug h t before it, directly or on appeal, including contested
appointments, and shall reviewdecisions and actions of its offices and of the
agencies attached to it.Except as otherwise provide by the Constitution or by
law, the Civil ServiceCommission shall have the final authority to
pass upon the removal. Separation andsuspension of all officers and
employees in the Civil Service and upon all mattersrelating to the conduct,
discipline and efficiency of such officers and employees.Section 5.
Jurisdiction of the Civil Service Commission Proper
. The CivilService Commission Proper shall have jurisdiction over the following
cases:
A.Disciplinary
1 . D e c i s i on s o f C i v i l S e r v i c e R e g i o n a l O f f i c e s b r o u g h t b e f o r e
i t o n petition for
review;2 . D e c i s i o n s o f h e a d s o f d e p a r t m e n t s , a g e n c i e s , p r o v i n
c e s , c i t i e s , mu n i c i p a l i t i e s a n d o t h e r i n s t r u me n t a l i ti e s , i mp o s i n g p
e n a l t i e s exceeding thirty days suspension or fine in an amount
exceedingthirty days salary brought before on it on
appeal;3 . C o m p l a i n t b r o u g h t a g a i n s t C i v i l S e r v i c e C o m m i
s s i o n P r o p e r personnel;4 . C o mp l a i n t s a g a i n s t t h i r d l e v e l o f f i c i a ls
w h o a r e n o t p r e s i d e n t i a l appointees;5.Complaints against Civil Service
officials and employees which arenot acted upon by the agencies and such other
complaints requiringdirect or immediate action, in the interest of
justice;6 . R e q u e s t s f r o t r a n s f e r o f v e n u e o f h e a r i n g o n c a s e s b e i n g
h e a r d b yCivil Service Regional Offices;7.Appeals from the Order of
Preventive Suspension; and8 .S u c h o th e r a c t i o n s o r r e q u e s t s i n v o l v i ng
i s s u e s a r i s i n g o u t o f o r i n connection with the foregoing enumerations.
B.Non-Disciplinary
1.Decisions of Civil Service Regional Offices
brought before it;2 . R e q u e s t s f o r f a v o r a b l e r e c o mme n d a t i o n on
petition
f o r e x e c u t i v e clemency;3 . P r o t e s t s a g a i n s t t h e a p p o i n t m e n t , o
r o t h e r p e r s o n n e l a c t i o n s , involving third level officials;
and4.Such other analogous actions or petitions arising out of or inrelation
with the foregoing enumerations.
