SECTION1.G.S.14190.5Areadsasrewritten:
"14190.5A.Disclosureofprivateimages.
(a)Definitions.Thefollowingdefinitionsapplyinthissection:
(1)Disclose.Transfer,publish,distribute,orreproduce.
(2)Image.Aphotograph,film,videotape,recording,digital,orotherreproduction.livetransmission,digitalorcomputergeneratedvisualdepiction,or
anyotherreproductionthatismadebyelectronic,mechanical,orothermeans.
(3)Intimateparts.Anyofthefollowingnakedhumanparts:(i)maleorfemalegenitals,(ii)maleorfemalepubicarea,(iii)maleorfemaleanus,or(iv)
thenippleofafemaleovertheageof12.
(4) Personalrelationship.AsdefinedinG.S.50B1(b).
(5) Reasonableexpectationofprivacy.Whenadepictedpersonhasconsentedtothedisclosureofanimagewithinthecontextofapersonal
relationshipandthedepictedpersonreasonablybelievesthatthedisclosurewillnotgobeyondthatrelationship.
(6)Sexualconduct.Includesanyofthefollowing:
a.Vaginal,anal,ororalintercourse,whetheractualorsimulated,normalorperverted.
b.Masturbation,excretoryfunctions,orlewdexhibitionofuncoveredgenitals.
c.Anactorconditionthatdepictstorture,physicalrestraintbybeingfetteredorbound,orflagellationoforbyanudepersonorapersonclad
inundergarmentsorinrevealingorbizarrecostume.
(b)Offense.Apersonisguiltyofdisclosureofprivateimagesifallofthefollowingapply:
(1)Thepersonknowinglydisclosesanimageofanotherpersonwiththeintenttodoeitherofthefollowing:
a.Coerce,harass,intimidate,demean,humiliate,orcausefinanciallosstothedepictedperson.
b.Causeotherstocoerce,harass,intimidate,demean,humiliate,orcausefinanciallosstothedepictedperson.
(2)Thedepictedpersonisidentifiablefromthedisclosedimageitselforinformationofferedinconnectionwiththeimage.
(3)Thedepictedperson'sintimatepartsareexposedorthedepictedpersonisengagedinsexualconductinthedisclosedimage.
(4)Thepersondisclosestheimagewithouttheaffirmativeconsentofthedepictedperson.
(5)Thepersondisclosesobtainedtheimagewithoutconsentofthedepictedpersonorundercircumstancessuchthatthepersonkneworshouldhave
knownthatthedepictedpersonhadareasonableexpectationofprivacy.expectedtheimagestoremainprivate.
(c)Penalty.Aviolationofthissectionshallbepunishableasfollows:
(1)Foranoffensebyapersonwhois18yearsofageorolderatthetimeoftheoffense,theviolationisaClassHfelony.
(2)Forafirstoffensebyapersonwhoisunder18yearsofageatthetimeoftheoffense,theviolationisaClass1misdemeanor.
(3)Forasecondorsubsequentoffensebyapersonwhoisundertheageof18atthetimeoftheoffense,theviolationisaClassHfelony.
(d)Exceptions.Thissectiondoesnotapplytoanyofthefollowing:
(1)Imagesinvolvingvoluntaryexposureinpublicorcommercialsettings.
(2)Disclosuresmadeinthepublicinterest,including,butnotlimitedto,thereportingofunlawfulconductorthelawfulandcommonpracticesoflaw
enforcement,criminalreporting,legalproceedings,medicaltreatment,orscientificoreducationalactivities.
(3)Providersofaninteractivecomputerservice,asdefinedin47U.S.C.230(f),forimagesprovidedbyanotherperson.

SECTION2.TheJointLegislativeOversightCommitteeonJusticeandPublicSafetyshallstudytheissueofimproperdisclosureofanimageofaperson
superimposedontoanotherimageofexposedintimatepartsordepictingsexualconduct.Thestudyshallincludewhetheranyexistingcrimesorcivilactionscurrently
applyandwhetherG.S.14190.5A,asenacted,shouldbeamendedtoincludesuperimposedimages.TheJointLegislativeOversightCommitteeonJusticeandPublic
SafetyshallreportitsfindingsandanyrecommendationstotheGeneralAssemblybyApril1,2018.
SECTION3.Exceptasotherwiseprovided,thisactbecomeseffectiveDecember1,2017,andappliestooffensescommittedonorafterthatdate.
