Nevada belongs to the Ninth Circuit Court of Appeals. The case Amanda J. v. Clark

County School District and Nevada DOE 267 F.3d 877 (9th Cir. 2001) is a case dealing with the

education of a special needs or autistic child. Amanda J.s mother filed a case against the school

district for failing to diagnose her as autistic and provide proper education. The District Court

ruling was that Amanda was given free appropriate education under the Individuals with

Disabilities Education Act. The ruling was reversed by the Court of Appeals. It was determined

that Amanda was misdiagnosed and the District failed to provide an appropriate IEP as mandated

by the Individuals with Disabilities Education Act. The family would receive reimbursement for

medical tests indicating autism, special education programs, and compensation for inappropriate

speech and language services given by the District.

Article 11 of the Nevada Constitution covers education. There are 10 sections for

education within Article 11. A specific topic addressed in the statutes is the appropriation of

funds to public schools. Land and funds are designated for educational purposes. The proceeds

made from educational sources, as well as fines collected under penal laws are pledged for

educational purposes. Such land and funds cannot be used for anything else.

As an educator, it is important to know how property and money is distributed for

educational purposes. The funds appropriated to the schools determine the amount and kind of

supplies schools can provide for their students and teachers. All students should be provided with
the right tools and supplies for their academic success. Teachers also need the right tools in order

to help students be successful. It is important to know how the budget works as educators to

ensure that students have the necessary supplies and proper facilities.
