Act No. 30-2017, enacted on June 5, 2017 (Act 30)

Title of the Legislative Measure:

Act for the Equality and Congressional Representation of the American


Citizens of Puerto Rico

Summary of the Legislative Measure:

Act 30 establishes the Commission for the Equality of Puerto Rico (the
Commission), as a legal entity of the Government of Puerto Rico under the
Puerto Rico Federal Affairs Administration (PRFAA).
The Commission is composed of two senators and five representatives,
appointed by the Governor of Puerto Rico, with the advice and consent of the
Senate and the House of Representatives of Puerto Rico.
Act 30 provides that the Commission shall meet at least once every month and
shall be considered the Puerto Rico delegation before the US Senate and House
of Representatives.
The Commission is in charge of promoting and advancing the admission of
Puerto Rico as a state of the Union.
PRFAA shall submit, as part of its own budget, a budget petition for the
Commission to the Office of Management and Budget and to the Legislative
Assembly.

Impact of the Legislative Measure on Fiscal Plan:

Pursuant to Section 402 of PROMESA, Puerto Ricos right to determine its


future political status shall not be constrained under the provisions of such
statute.
The referendum on the political status of Puerto Rico was a central tenant of
the 2016 general election and constitutes a programmatic political mandate
voted for by the people of Puerto Rico.
On November 6, 2012, a referendum on the political status of Puerto Rico was
held. The majority voted for statehood.
On June 11, 2017, a referendum on the political status of Puerto Rico was held.
The majority voted for statehood.
Act 30 implements the will of the People of Puerto Rico, as expressed on the
referendums held on November 2012 and June 2017.

Estimate of Impact of the Legislative Measure on Revenues and Expenses:

The Office of Management and Budget (OGP, by its Spanish acronym)


estimates an impact of approximately $373,800 on the expenses of the
Government for fiscal year 2018 for statutorily allowed reimbursements and
stipends. Act 30 has no impact on the revenues of the Government.

Determination of the Legislative Measures Compliance with the Fiscal Plan:

Section 402 of PROMESA clearly states that [n]othing in this Act shall be
interpreted to restrict Puerto Ricos right to determine its future political status,
including by conducting the plebiscite as authorized by Public Law 11376.

Act 30-2017 establishes a Commission that will further advance the process of
self-determination of Puerto Rico.
Act 30-2017 will be funded from budget appropriations included in the soon to
be certified 2017-2018 budget.
Act 30-2017 is not significantly inconsistent with the Fiscal Plan for Puerto Rico,
as certified by the Financial Oversight and Management Board for Puerto Rico
on March 13, 2017.
Conclusion:

For the reasons stated before Act 30 complies with the requirements set forth
in 48 U.S.C. 2144.
