PROPOSED CITY ORDINANCE 2016-007

AN ORDINANCE INSTITUTIONALIZING THE


INTEGRATED SOCIAL DEVELOPMENT ASSISTANCE
PROGRAM (ISDAP) OF THE CITY OF CABADBARAN

WHEREAS, Section 16 of the Local Government Code states that, Every local
government unit shall exercise the powers expressly granted, those
necessarily implied therefrom, as-well-as powers necessary, appropriate or
incidental for its efficient and effective governance and those which are
essential to the promotion of the general welfare;

WHEREAS, one aspect of the promotion of the general welfare includes


addressing the plight of our indigent constituents who, by and large, are
already struggling to find a living, let alone, find the means to help
themselves in times of exigencies;

WHEREAS, it is therefore imperative to provide them with proper and


expedient benefits to alleviate them from the difficult circumstances they are
in;

HENCE, the passage of this legislative measure in order to institutionalize,


promote and improve the economic and social welfare of our indigent
constituents.

SECTION 1. TITLE - This ordinance shall be known as the Integrated Social


Development Assistance Program (ISDAP) Ordinance of the City of
Cabadbaran.

SECTION 2. COVERAGE This Ordinance shall cover all indigent residents of


the city, including those in difficult circumstances. This is without prejudice
to residents of other municipalities/cities, who are identified as stranded and
extremely in need of financial assistance in order to return home.

The following are the coverage of the ISDAP assistance and the
corresponding amount that the city can grant under the program:

1. Hospitalization without surgery - P1,000.00 - P5,000.00


2. Hospitalization with surgery - 5,000.00 -
10,000.00
3. Medical assistance (for medicines) - 500.00 -
2,000.00
4. Medical assistance (for laboratory
requests) - 1,000.00 -
2,000.00
5. Blood for transfusion - 1,800.00 - 3,600.00
6. Burial assistance (for coffin and
embalming) - 3,000.00 - 5,000.00
7. Shelter assistance for victims of
calamity/fire (partial) - 2,500.00 -
5,000.00
8. Shelter assistance for victims of
calamity/fire (total) - 10,000.00
9. Shelter assistance for repair of poor
dilapidated houses (in materials, not
in cash) - 2,500.00 - 5,000.00
10. Transport assistance:

SECTION 3. REQUIREMENTS FOR AVAILMENT The following are the


requirements for the availment of the program:

GENERAL REQUIREMENTS

1. Resident claimant must be an indigent resident of the City of


Cabadbaran;
2. For claims made through a representative, except burial assistance
claims, an authorization letter from the indigent resident claiming
the assistance is required to establish proof of relationship with the
latter. Aside from presenting the claimants requirements, the
representative must also present his/her valid ID or certification
issued by the punong barangay or barangay kagawad where the
indigent resident claiming the assistance or his representative
resides, attesting the relationship of the claimant and the
representative.
3. For resident claimants who are minors (less than 18 years old), only
immediate family members such as parents, guardians, siblings (at
least 18 years old) or grandparents or any person with proof of
relationship to the claimant can process and receive the claim;
4. Financial assistance can only be granted once every six (6) months,
except for educational assistance, which can only be granted once
every year, and burial assistance and assistance for the stranded,
which can only be granted once. Any assistance under lSDAP is
considered the same.
5. For medical cases, the medical prescription or physician's referral or
medical abstract, for those needing a medical procedure, should not
more than one (1) month from date of issuance and, for medicines
as maintenance, not more than six (6) months from date of
issuance;
6. The certification of residency and indigency shall be valid only for
one (1) month from date of issuance except for certification issued
in the month of December which will not be valid in the month of
January of the following year.
7. In cases where the claimant shall be granted the maximum amount
under the burial or educational assistance, checks issued shall be
payable to the facility/institution. For hospitalization assistance,
checks shall automatically be payable to the hospital or clinic
regardless of the amount granted.
8. All documents must have no erasures/alterations, or if there be any,
the erasures/alterations must be countersigned by the signatory.

SPECIFIC REQUIREMENTS

HOSPITALIZATION/MEDICAL ASSISTANCE:

FOR lN-PATIENTS:
a. Photocopy of a valid government issued ID (original copy must be
presented);
b. Photocopy of physician's prescription/laboratory request/medical
procedure to be done (original copy must be presented);
c. Photocopy of the latest billing statement from the hospital (original
copy must be presented); and
d. Certification of eligibility from a CSWD social worker.

FOR OUT-PATlENTS:
a) Photocopy of a valid government issued ID (original copy must be
presented);
b) Photocopy of physician's prescription/laboratory request/medical
procedure to be one (original copy must be presented);
c) Photocopy of the medical abstract or social case study, for
assistance amounting to P5,000.00 and above (original copy must
be presented); and
d) Certification of eligibility from a CSWD social worker.

BLOOD FOR TRANSFUSION:


a) Photocopy of a valid government issued ID (original copy must be
presented);
b) Photocopy of the physician's prescription/request (original copy
must be presented); and
c) Certification of eligibility from a CSWD social worker.

BURIAL ASSISTANCE:
a) Photocopy of the Death Certificate duly signed by the authorized
signatories confirming his/her death (original copy must be
presented); and
b) Certification of eligibility from a CSWD social worker.
c) If the death certificate is not yet available because of the non-
payment in full of the hospital bills of the deceased, the latest billing
statement from the hospital and a temporary burial permit issued
by the punong barangay or barangay kagawad will suffice. If the
same is not yet available because the deceased has no birth
certificate yet, an affidavit or certification from the Civil Registrar
attesting the fact of the foregoing and a temporary burial permit
issued by the punong barangay or barangay kagawad will suffice.
CALAMITY/FIRE VICTIM ASSISTANCE AND ASSISTANCE FOR REPAIR OF POOR
DILAPIDATED HOUSES:
a) Photocopy of a valid government issued ID (original copy must be
presented), except unless the same has been gutted by fire;
b) Picture of the house (partially/totally) gutted by fire must be within
six (6) months from the occurrence of the incident;
c) For calamity victims, a certification from the Local Risk Reduction &
Management Office (LDRRMO) or for fire victims, a police or fire
department report attesting to the occurrence of the incident; and
d) Certification of eligibility from a CSWD social worker.
e) For repair of poor dilapidated houses, a member of the barangay
council must assist in the purchase of the materials needed to
repair said houses, and be able to report the fact of the foregoing
with the CSWD.

TRANSPORTATION ASSISTANCE:
a) Photocopy of a valid government issued ID (original copy must be
presented); and
b) Certification of eligibility from a CSWD social worker.
c) For assistance outside the province, the purpose must be the
following:
1) Claimant's direct family member shall be transported due to
medical reason;
2) To transport a cadaver;
3) To transport a victim of domestic abuse/violence;
4) Claimant's member of the family within the 4th civil degree of
consanguinity or affinity dies in another place.

EDUCATIONAL ASSISTANCE:
a) Photocopy of a school ID or a valid government issued ID (original
copy must be presented);
b) Photocopy of the latest billing/statement of account issued by
claimants educational institution, duly signed by the school's
authorized representative (original copy must be presented);
c) Certificate of enrollment and an attestation that the claimant is not
a beneficiary of a scholarship grant from his/her school or from any
public/private agencies from the school registrar; and
d) Certification from a CSWD social worker attesting the indigency of
the claimant.
e) The budgetary allocation for educational assistance shall only be up
to ten percent (10%) of the total amount appropriated for the
effective implementation of this ordinance, without prejudice to it
being already allocated to claimants of assistance other than
educational, if such was the case. In no case shall an educational
assistance be granted in excess of the ten percent (10%) threshold.

ASSISTANCE FOR STRANDED NON-RESIDENTS:


a) Photocopy of a valid ID, if there be any (original copy must be
presented); and
b) Assessment attesting the veracity and extreme necessity of the
claim and certification of eligibility from a CSWD social worker.

SECTION 4. APPROPRIATION There shall be appropriated an initial amount of


Ten Million Pesos (P10,000,000.00) for the effective implementation of this
Ordinance, under the City Social Welfare and Development (CSWD). If it
deems necessary, subsequent budgetary allocations for the program shall be
increased annually upon approval by the Sangguniang Panlungsod.
SECTION 5. PENAL CLAUSE
a. Any claimant who shall fraudulently present fabricated/tampered
documentary requirements shall be black-listed by the CSWD and
banned from availing any benefits from this ordinance.
b. The member of the barangay council who assisted in the purchase of
the materials needed to repair poor dilapidated houses and failed to
report the fact of the foregoing with the CSWD more than a month
from the release of the grant, shall be reported to the City Mayor, who
shall, in turn, reprimand him/her for his/her nonfeasance. After the
second reprimand, the member of the barangay council shall be held
liable to pay the amount of the grants released upon claimants, which
he helped to purchase.
c. The failure to maintain a black-list log for banned claimants; or the
fraudulent inclusion or non-inclusion of claimants in the log of banned
claimants; or the issuance or non-issuance of a certificate of eligibility
or other certificates required herein; or other forms of non-feasance, if
made with grave abuse of discretion or in violation of the provisions of
this Ordinance, shall subject the concerned CSWD social worker, or
member of the barangay council, or officers of the Civil Registrars
Office, LDRRMO, fire or police department, or physician, or school
registrar, as the case may be, to appropriate administrative
disciplinary actions under the Civil Service laws or the Local
Government Code, or other pertinent laws, rules and regulations issued
by a competent authority.

SECTION 6. REPEALING CLAUSE All city ordinances or administrative


issuances or part thereof which is inconsistent with any provision of the
Ordinance are hereby repealed or modified accordingly.

SECTION 7. EFFECTIVITY DATE This Ordinance shall take effect upon


approval.
