scheduletoLimitationAct.

ThepeculiarfeatureabouttheSection7isthatlimitationunderitisextendedwithreference
totheentirebodyofpersonsjointlyentitledtosueormakeanapplicationforexecutionofa
decree.

Theextensionoflimitationdoesnottakeplacewithreferencetothepersonunderhis
disabilityalone.Thefirstpartofthesectionprovidesthatifadischargecanbegivenbyone
ofseveraljointcreditorsofclaimantswhoisfreefromdisabilitywithouttheconcurrenceof
hisotherjointcreditorsorclaimantswhoareunderdisability,thenthereisnoextensionof
limitationandtheordinaryperiodoflimitationaloneappliestoallthejointcreditorsor
claimantsincludingthosewhomaybeunderdisability.

Thesecondpartofthesectionprovidesthatifsuchadischargecannotbegivenwithoutthe
concurrenceofthepersonorpersonsunderdisability,thenlimitationwillbeextendedwith
referencetoallthejointcreditorsorclaimantsandnotonlywithreferencetotheperson
underdisability.

Section7isasupplementtotheSection6.

Section8,Specialexceptions:
Thissectionappliestosuitstoenforcerightsofpreemption(preferentialright).

ThefirstpartofSection8laysdownthatsuitsforpreemptionarenotgovernedbySections
6&7oftheActandinspiteofthedisability,theymustbeproceededwithandnoextensionof
timewillbegivenonaccountofthedisabilityoftheplaintiff.[JOECM25]

Thesecondportionofthesectionsaysthatapersonunderdisabilitymaysueafterthe
cessationofthedisabilitywithinthesameperiodashewouldotherwisehavebeenallowed
undertheschedulebutinnocasecantheperiodbeextendedtoanythingbeyond3years
fromthecessationofthedisability.

Section9saysthatoncetimehasbeguntorun,nosubsequentdisabilityorinabilitytosue
canstopitsrunning,thisappliestoapersonhimselfaswellastohisrepresentativesin
interestafterhisdeath.
