Constitutional provisions and Case Law to support your answer.

3. Discuss the merits and demerits of DRM provisions introduced by the Copyright (Amendment)
Act in view of relevant international provisions under the Internet treaties, DMCA and prevailing

4. When does comparative advertising amounts to infringement? Discuss in light of relevant
provisions and case laws.
5. PIGLET is a well-known registered trade mark in India for toys. It is a leading brand and enjoys
trans-boundary reputation. An alleged infringer uses the trade mark Piggie for services relating
to managing and depositing the savings by young kids. Would this alleged act amount to
infringement? Decide on the basis of relevant provisions and principles.
6. A trade mark Globe 69 with the character written in green and blue, has been registered in
India for futuristic furnitures as a product. An alleged infringer uses the trade mark Global 6n9
with the characters written in all green in relation to a company which provides studio services
for designing of futuristic furnitures to other companies as an upstream business model. Is he
liable?

(SECTION A) (04X15)
1. A gift deed of a house worth Rs 20 lakh executed by a lady M, aged about 62 years, in
favour of a lady L, aged about 27 years, on the condition that she will marry V, the
son of M, aged about 32 years and will live with them and also take care of them.
Accordingly L married V and started living with them. Unfortunately, V died in a
road accident just after one year of the marriage. Thereafter, M started torturing L
which compelled her to leave the house and returned to her maternal home. Now, M
has entered into an agreement of sale of gifted property with K but L has claimed the
gifted property. Decide the case by referring relevant statutory provisions and case
law. Also discuss under what conditions a gift can be revoked or suspended.

2. A lease agreement provided the renewal of lease after expiry of one year but the
landlord (A) served two consecutive notices to the tenant (B) to quit on July 10, 2015
and August 4, 2015. The lease agreement was determined on July 31, 2015 by the
efflux of time but B has not vacated and continued in possession. Thereafter, B
offered the rent from August to October 2015 to the LR of A which was duly accepted
by him. On November 10, 2015, A filed a suit of eviction but B has claimed that the
lease is renewed for another one year as LR of A has accepted the rent. Decide the
case highlighting the relevant statutory provisions and case law.
3. What do you mean by right of redemption and equity of redemption? Does default in
repayment of security debar a mortgagor from redeeming the mortgaged property?
Discuss with the help of relevant statutory provisions and decided case law.

4. A licence does not create any interest in the immovable property of another but a
bare permission to use. Critically analyse this statement. Also draw the clear
distinction between lease and licence.
5. What is charge? Discuss different types of charge and also differentiate from simple
mortgage. Do you agree that every mortgage is charge but every charge is not
mortgage, if so, why?
6. Define easement of necessity. Differentiate between Customary easement and
customary rights. Describe the various modes of creation and extinction of easement.

7. Write short note on Equitable Mortgage.
8. If a property of a person is transferred to another and one of the parties pays an
additional sum for equalization of value, will it amount to Exchange? Explain.
