3. Applicaticn .
.These regulations shall appzy t.o everywho1e-t:irne employee of the
Organisation, other than the Canmissioners a.ppointed under paragraphs 19
and 20 of the Scheme:
Provided that a GOV'ernment
servant or an employee of a local a.uthority
or any statutory Organisation, whose services
have been or may be obtained
,
on deputation by the Organisation may be governed by such 'BelmS and conditions
as may be settled by the appointing authority in consultation with the
Government or the local authority or tho statutory Organisation concerned ;
PrOV'idedfurther that an employee appointed on contract or tonure
basis may be exempted frem these regulations to such extent and subject
to such co,nditions as may be specified by the appO:lllte.rlg
authority but
the appointing authority shall subnit a report thereon to the Board,
4.. Classifioation and Central

(1) The posts under the Orgnnisatian other than those OIUinarily
held by persons to whan these regulations do not apply shall be olassified
as shown in the First Schedule.

(2) The Canmissioner and the Board shall exercise such pQ\.rers
in the matter of creation of posts as are laid down in the Schemee

5. Appointing Authority

The posts of Central and Regional Canmlssioners and Deputy Provident


Fund Camnissioners shall be filled by the Central Governmentin accordance
with the provisions of the Schemewithout consulting the Union Publio
Service Canmissian.,

(2) - Appointments to posts o::l.lTyi..1J.g scale of pay "\-1ithmaximum


of Rse500/":' per month or more, other than those mentioned L1J. ::rub-regulation
(1) shall be made by the CentraJ. Government in ccnaul.bat.Lcn with the Unicn
Public Service Ccrnmissian, in accordance with the recruitment rules laid
down in the Second Schedule.

(3) Appointments to posts fe.1.ling under sub-regulatian(2) for ~rioc1


not exceeding one year may be made by the Central Govermnentwithout cmsulting
the Union Public Service Camnission.

(4) Appointments to other categories of' posts shall be made by the


Ccm:nissioner in accordance with the provisions of' the Scheme and the l"eOIruit-
raenb rules laid downin the Third Schedule'. "TheCentral Camnissioner shall be

the appoing Authority for the posts in the Headquarters office and the posts
of Head Cle~'Provident Fund Inspector Grade II in the Regional, Offices
and the :RegicnaJ.Canmissioner ,for. all the romainfug 'posts in thoir respective
Regians.

* (5) Without prejudice to the generality. of the prmrisioos corrbadned


in sub-regulation(4) the Canmissioner, may, if itL.90nsidered necessa.ry,delegateLv')
the powers of appointment in respect of Class IV posts or any of the j'Wlior
Class III posts for vThichhe is the appoint:ing authority, to an officer
eubord.inate to Mm, but not belo-wthe rank of an Assistant Canmissionor.

6. Probc.tia.1

(1) Ewry person appointed to a post by direct recruitment or by
departmental. pranotion with a view to his eventual substantive appo:intment
to that post, shall be on probation for a period of two years :

Pravided that the appointing authority may, in suitable cases,


extend the period of probation Oldinarily for not moro than one year, and
for special reasons, for more than ono year but notemplqyee shall, in ~ case,
be kept on probation for a total period cxoeeding four years in any post.

(2) In the case of 0. tenure appcdrrbnonti,the appoint:ing authority


may prescribe such period of probation as that authority may consider necessary,

(3) The appointing authority may, at its discretion, count any


contdnuous period dur~g wh~Chan emp'Loyoe has successfully officiated dn a
post as period of probation in that post,

(4) an employee shall be confinnod in the post on satisfactory


canpletion of probation if the post against wh.ichho is appointed is pennanent

(5) The decision on the que stion whether an employee


should be confirmed or whether he should be deemed to hgve comp.
leted the period of probation satisEactorily or wheth~r his
probation should be extended shal-lbe e xbaaded shall o.rdinarily
be taken with a period of two months after the expiry of the
period of probation, and communicated to the employee together
with the reasons in a case of extension.'An employee who does
not make satisfactory progress, or shows himself to be inadequate
for the post in any way, shall be informed of his shortcomings
sufficiently before the expiry of the initial period of probation
to enable him to make special efforts for improvement.
*6A. Regulation of payor probationers.
Drawal of pay and increments by persons appointed
on probation to the posts in the Organisation shall be regulated
by the relevant provisions contained in the Fundament~l Rules
and Supplementary Rules as are applicable to persons similarly
appointed to corresponding categories of posts under the Cent.
ral Goverrunent.
7. Commencement of Service.
Service mall commence from the working day on which
an employee reports for duty in an appointment covered by these
regulations at the place and time intimated to him by the appo~
inting authority provided that he reports for duty in the forenoon;
otherwise his service shall commence from the next working day.
8. Termination of service.
(1~ Notwithstanding anything contained in these'regulations,
an employee shall npt leave or discontinue his service without
giving, where he is a permanent employee, three months' notice,
and in any other case one month's notice in writing of his in.
tention to do so, to the Officer_in.charge of his office or in
the case of the Head of an Office. to the next superior Officer,
~nd uptil the not~ce so given is accepted by the appointing auth-
ority.
l2) The services of a permanent employee may be terminated

on the abolition of the permanent post held by him in a class
or cadre, or reduction.in the number of posts in a class or cadre
by the authority competent to make appointment to the post which
tee employee holds on giving three months' notice or pay in liew
thereof, provided that this power shall be excercised where the
appointing authority is not the Central Government or the Commi.
ssioner as the case may be, with the approval of the Central
Goverrunent or the Commissioner.

(3) The services of a temporary employee may be tem.inated with rut

(4) Notwithstanding the provisions of sub-regulations (1), (2) and


(3), the services of any anployee may be tenuinated by the appointing authority
after giving one monthI s notice or pay plus allwances in lieu thereof on his
being oerti.fll.d by a M3dical Board to be permanently incapacitated for
furtmr samoa in the Organisation. e

9. Pay,leD.w..:provident:fund and age of canpul.sor:-iretirement.

(1) The scales of pay attached to the posts under the Organisaticn
shall be as set out in the First Schedule.

(2) The regulations relating to the grant of leave,benefit of pens Lcn


and gratuity or contributory provident fund to the employees and the age at
which they shall be canpulsorily retired fran service, shall be as set out
:L"l too Fourth Schedule.

(5) The fixation of pay, grant of Incremenbs and -connected matters


shall, in the case of an emr>loyeo,be governed by the provisions contained
in the Fundamental Rules and the SupplElIlentaryRules, framed thereunder, ~s
applioable, fran time to t:irn.oto employees of the Central Government. The
initial pay of ~ployees appointed on the eooomnondatdons of the Canmission
wi11~ however, be as recamnended by the Ccrnmission.

(4) Notwithstahding the provisions of sub-regulation(5) -


(a) the initial pay of a Government servant, pennanent or temporary
an first appcdntmerrt :in the Organ.Lsat.Lcn-on the recanmendation
of the Canmission or otherwise, shall not be less than what WQl1d
have-been admissible to him if he was appointed to a. post in a
similar scale of pay under the Central Government,
(b) the servioo, including the broken period of servioo,Nn dared
by a temporary Government servant under the Central GOV"Crnment
in the tiIne scale of pay s:im.ilar to that to which he is appointed
:i.nthe Organisation shall be counted for purposes of increment
to the extent that 9~h service is counted for increoont under th.e
Central Gavement in such cases pravided that he is appointed
in the Organisati<n without DIlY break after the teminatim of his
service under the Central q.avernnent.

(2) Without prejudice tonthe provisions of sub-regulation (1)
but subject to the provisions of sub-regulation (3), any of the penalties
specified in regulation 14 may be imposed 00 any employee.,by the appodntdng
authority or the authority specified in this behalf by a general or a special
order of the CentraJ. G~lernment.
(3) Notwithstanding anything can.taJ;ned.iil-th1s-regula.tion, no
penalty specified in clauses (iv) to (vii) of l'9gtiLation 14 shall be, lmpooed
by an authority lower than the appointing authority.

3. Procedure for imposing mal"ot penalties - No order imposing
on an employee any of the pena ti~ specified in clause. (1.v) to
(vii) of regulation 14 shall be passed except after an l.nqul.ry
held as far as may, in the foll?wing manner:
(1) The d:!.sciplinaryauthori ty shall frame definite
charge on the basis of the aJlegations on which the inquiry i~
proposed to be held. SUch charges, together with a statement of
the allegations on ,whi~h they are based, shall be communicated
in wr! ting to the employee and he shall be required to subni t
within such time as may be specified by the disciplinary authority-
(2)(a) to s~h authority, or
(b) where, a Board of Inquiry or Inquiring Officer
has been appointed under sub-paragraph(2)
below, to that ,Board or Officer,
a written statement of his defence and also to state whether he
desires to be heard in person.
Explanation: In this ~ub-paragraph and, in sub-paragraph(2) and
(3) below, the expression "the d1.sciplinary authority" shall

assistance of any other employee approved by the disciplinary

(6) The inquiring authority shall, in' the course of


the inquiry, consider such documentary evidence and take such
oral evidence as may be relevant or material, in. regard to the
charges. The employee shall be entitled to cross examine witness
examined in support of the chargesi1nd to give evidence in person.
The pe~son presenting the case in support of the charges shall
be entl.tled to cross examine the employee and the witnessess
examined in his defence. If the'inquiring Authority declines
-t:oexamine. t-e oxamiM any witness on the ground that his evidence
is not relevant or material, it shall record its reasons in writing.

(r.;~":(7) At the conclusion of the inquiry, the Inquiring


Authority 'shall prepare a report of the inquiry, recordilIl.ill its
findings on each of the charges together with reasons therefor.
If in the opinion of such authority, the proceedings of the
inquiry establish charges different from those originally framed
it may record findings on
such charges provided that finding on
such charges shall not be recorded unless the employee has admitted

(~) The disciplinary authority shall, if it is not the
Ihquiring Authority, consider the record of the inquiry ana Kat

(10) If the dise1plina,:ryauthority. having regard to
its findings on the charges, 1S of the opinion that any ,of the
penalties specified in clauses (iv) to (vii) ~ regulation 14
should be imposed, it shall -
(a), furnish to the, employee a copy of the report of
the Inquiting Authority and where the disciplinary
a~thority is not the Inquiring Authority, a
statement of its finding together with brief
reasons for disagreement. if any, with the
findings of the Inquiring Authon ty ; and
(b), give him a notice stating the action proposed to
be taken in regard to him and calling upon him to
subnf t within a specifi ed time such representation
as he may wi~h to make against the proposed action.
(11) The disciplinary authority shall consider the representatior.,
if any, made bY the employee in response to the notice under sub.
paragraph (10) above and determine what penalty, if any, should be
imposed on the employee and pass appropriate orders in the ease.
(12) If..the di.ac LpIdnarv authority having regard to its findings
is of the o~inion that any of the penalties specified in clauses
(i) to (iii) of regulation 14 should be imposed, it shall pass
appropriate order~ in the Case.
(13) Orders passed by the disciplinary authority shall be 4)

communicated to the ,employee who shall also be supplied with a


copy of the report of the Inquiring Authority and, ~mere the

2. FOIm and contents of appeal _ Every person s'ubmitting


an appeal shall do so spparetely and in his own name. The
appeal shall be addressed to the authority to whom.the appeal
lies, shall contain all material st~tements and arguments on "
which the appellant ~ shall not contain any "disrespectful
or improper language, and shall be complete in itself. ;
3. Submission of appeals _ Every appeal shall be submitted
to the authority which made the order appealed against, through
the head of the office ih which the appellant may be serving or,
if he is not in service, through the head of the office in which
he Was last serving. If such authority itself is the head of office
or is subordinate to the head of office in which the employee may
be serving, or was serving if he is not in service, the appeal
shall be submitted direct to that authority. A copy of the appeal
may be submitted direct to the appellate authority also.
4. Withholding of appeals (1) The authority which made the"
order appealed against may withhold the appeal if -
(i) it an appeal against an order from which no ~
lies; or
(ii) it does not comply with any of the provisions
laid down in paragraph 2; or
"(iii:) it is not submitted within the pr~scribed time-
limit and no cause is shown for the delay; or
(iv) it is repetition of an appeal already decided
and no new factsLcircumstances are adduced. L~
(2) If an appeal is withheld on the ground only
that it does not comply with the provisions "in paragraph 2,it
shall be returned to the appellant and shall not be withheld
if resubmitted with ~ in one month thereof after compliance
with the said provisions.
(31 Where an appeal is withheld, the appellant
shall be ~nformed of the fact and the reasons therefor.

(4) At the cammencment of each quarter, a list of the


appeals withheld by any authority during the previous quarter,'
!:~ with the reasons for withholding them, shall be furnished

5.,. Transmission of appeals _ (1) The authority which made
the order'appealed against shall, vdthout any avoidable delay,
tran,smit to the appealate authori ty every appeal which is not
,w,ithheld under paragraph 4, together with its comments thereon
~nd the relevant records~
,(2) The authority'to which the appeal lies may direct
transmission to it of any appeal withheld, and thereupon such
appeal shall be transmitted to that authority together with the
comments ofthe authority withholding the appeal and the relevant
records. " .
6. Consideration of appeals (1) In the Case of an appeal
against an order of suspension, the appellate authority shall
consider whether in the light :of the provisions of regulation
13 and having regard to the circumstances of the case, the order
of suspension is justified or,not and confirm or revoke the
order accordingly. '
, (2) In the case of' an appeal against an order imposing
any of the penalties specified in regulation 14, the appellate
aut ho.r-i ty' shall consider :_

(a) 'whether the prbcedure prescribed in the regulations


and the Fifth :Schedule has been complie.tlwith and
if,not, whethe; such non-compliance has resulted
in failure of ~ustice ;

(b) whether the findings are justified;

and
(e) whether the penalty imposed is ex~essive, adequate
or inade,quate; and pass orders -
(i) setting aside, reducing,confirming or
enhancin$ the penalty; or
i
(ii) remittidg the Case to the authority which
imposed the penalty or to any other authority
with such direction as it may deem fit in-
the oircumstance~ of the case
Provided that:-
(i) ~he appellate authority shall not impose any
enhanced penalty which neither such authority
