In the context of business ethics, this case study aims to:

What action should the Philippine Government take to address the welfare of
Marinduque people affected by the Marcopper disaster and attain environmental
justice for the afflicted areas?

4. Stakeholders
Stakeholder Group Impact on the Stakeholder
Investors The investors sponsor Placer Dome which
co-owns Marcopper by 40%. They expect
profit from this Marinduque-based
company, and may buy more shares or
expand to other possible areas.
Customers of Marcopper and Placer Marcoppers current customers would

providing them with. They may opt to
import the products if there are no local
alternative to Marcoppers products and

electricity) and goods to its staff.

number of residents needed to evacuate
because of the Marcopper incident.

Marinduque to study and investigate on
this incident. Also, these groups
supported the needs and voices of the
community.

5. Alternative Courses Of Action

Alternative 1: Strict implementation of environmental and mining regulations.


Discussion:
With strict implementation of rules and regulations, the assigned
governing bodies (i.e. DENR and MGB) would be able to resolve the current
demands of Marinduqueos from Marcopper/Placer Dome. These departments
will be responsible in enforcing the company to continuously fund the
rehabilitation of the affected areas of Marinduque until its restored to its original
state. Also, they are accountable in ensuring that Marcopper never operates
again and establish a Health Trust Fund that would address the health dangers it
has incurred to its employees and citizens. For further punishment, DENR should
initiate the conclusion of the criminal cases against Marcopper and the collection
of taxes. The collection shall be used for wellness programs in Marinduque.
For establishing new mining companies, top management of this
organizations must adhere to all standards and up-to-par practices by the
government. These regulations shall impose environmental sustainability and
personal wellness.

Alternative 2: Prohibit mining in the Philippines. Local government to continue


and develop Rehabilitation program in partnership with international
environmental organizations for Marinduque.
Discussion:
Since Placer Dome claimed that they already compensated the
rehabilitation of the environment and wellness of people in Marinduque, even if
several deliberated that its not enough, the government will let them go and
establish that no mining industry can operate in any Philippine territories. The
government takes full responsibility of funding the rehabilitation programs and
coordinate with international organizations who have shown support and wanted
to take the opportunity to help in restoring the island.
6. Effects of Alternatives on Stakeholders

Alternative 1:

Investors With the strict implementation of the mining
regulations, the government will spend more time
and effort for review for its initial set-up. Also, labor to
do these paper works, coordinating with technical
experts to approve, and permit issuance would incur
costs to investors.
In the long-run, if theyve decided to push through
with setting up a mining company in the country, they
would be concerned of the high and improving
standards of maintaining the business. They would
be required to instill whats the best for the
environment and well-being of, not just the
employees, but the people residing in the area.
Customers of Marcopper Customers located in the Philippines may choose to
and Placer Dome import the goods or find another local mining entity.
Choosing to import mining goods may cost more
than what they were paying to Marcopper. If they opt
to find another local supplier, they must also consider
their role to adhere with the standards set by the
government.
Employees of Marcopper The employees of Marcopper can still continue their
mining career in other companies that comply with
the standards. The regulation captures the welfare of
all employees which considers health, compensation,
and benefits.

seen as a profitable opportunity, investors need to
explore other countries where they can establish their
mining companies. There is a possibility, when the
Marinduque disaster already surpassed and the land,
together with its people, are already well, that these
investors still interested to put up a business in the
Philippines may influence government bodies.
Customers of Marcopper Customers located in the Philippines may choose to

environmental groups helping aid the destruction that Marcopper caused,
these international environmentalist groups shall help
raise funds for the government to cover the
continuous rehabilitation program. They (international
group) shall need the assistance from their local
counterparts to ensure that the finances are really
going to Marinduques restoration and its peoples
prosperity.
7. Choosing the Best Alternative
The group will use the Markkula Framework as illustrated below:

Alternative 1:

Utilitarian Approach The act would benefit the Marinduqueos, together with
Filipinos, who resides near the mining area sites across the
Philippines. Also, it would benefit the environment as it is
seen that it would be sustained according to standards.
Nevertheless, this act would burden Placer Dome as they are
banned from putting up operations in the country. For
investors and customers, they may see this positively or
negatively depending on their options.
Rights & Duties The government now gives different Filipino stakeholders (i.e.

investors who are willing to put up with the specifications that
would best benefit them.
Justice & Fairness It has caused inequality since Placer Dome has been

Human Dignity and People of Marinduque is given the chance to improve their
Common Good lives through the continuous reparations funded by Placer
Approach Dome. For the investors, it would give them the opportunity to
develop a more sustaining means of mining operations. As for
Placer Dome, this will be a lesson for them to value the
environment and health of its workers and the community.
Virtue Approach The government should value justice and addressing whats
best for its people. The purpose of government is to protect
the individual rights of its citizens.

Alternative 2:

Utilitarian Approach Banning mining operations in the Philippines would burden


the investors and customers who see quality products
inexpensive made in the country.
This act would benefit, otherwise, the local residents who are
near the mining areas and rely heavily on fishing and
agriculture as means of their livelihood.
Rights & Duties The welfare of Marinduques situation and its people is given

However, it would deprive investors who wanted to take the
opportunity to make a living and provide additional job
opportunities to locals.
Justice & Fairness Since the priority of the government is the overall welfare of

Human Dignity and Due to the disastrous incident, the government must take
