This is an e-tender initiated by IOCL through its website https://iocletenders.gov.in. To participate in this tender, all interested bidders are
requested to obtain Class-3 Digital Signature Certificate (DSC) from any authorized certifying agency and register themselves with IOCL on this
website using the DSC. Detailed instructions are available on the websites Bidders Manual Kit section.
The tenderer shall furnish necessary documents online in support of required qualification and experience along with their offer.
The tenderers shall upload scanned copies of necessary documents in support of required qualification and experience along with their offer.
Tender issuing authority reserves the right to reject any or all of the tenders or any part of a tender so received and no compensation shall be
paid for the efforts made by the bidder. Reasons for rejection shall be disclosed on written representation by the concerned bidder whose bid is
rejected.
IOCL reserves the right to extend e-tender download /submission date etc. without assigning any reasons thereof.
The Bidder should have executed the works either as a Main Contractor (or) as Sub-Contractor to a Main Contractor.
The supporting document submitted against pre-qualification criteria given in SN 7b of this NIT i.e. copy of work order (WO) along with
completion certificate as main or as sub-contractor clearly specifying WO no., final executed value & duration of said contract and other
supporting documents towards required qualification and experience shall be self certified. Copy of TDS Certificates shall be submitted in case of
sub-contract work orders and in case where the tender issuing authority specifically seeks the same. The said documents must be for the work
executed between the periods as indicated in the NIT. The value of job done before or after this period will not be considered for this purpose. In
case, the document submitted is for the period exceeding the said period, IOCL reserves the right to calculate the pro-rata amount. In case it is
found that the tenderer is not meeting the pre-qualification criteria as per the supporting document submitted by them, their offer is liable to be
rejected.
Following are exempted from payment of EMD and Tender Fees:- (1) Public Sector Undertaking of Central /State Govt. / Joint Ventures of IOCL,
and (2) As per MSMED Act 2006 Industries / Organizations registered under; SSI/NSIC/MSME Units. Bidder shall submit notarized copy of NSIC
certificate with the offer.
In the event of any legal disputes arising out of the tender and/or contract, the same shall be within the jurisdiction of Beawar (Rajasthan) courts
only.

Having examined the Tender Documents consisting of the Tender Notice, General Instructions to Tenderers,
General Conditions of Contract, Special Instructions to Tenderers, Special Conditions of Contract, Technical
Specifications, Plans (Exhibits NIL to NIL), Drawings (Exhibits NIL to NIL), Time Schedule, Form of Contract, Form
of Schedule of Rates, and Corrigendum(s)/ Addendum(s) to the Tender Documents, and having understood the
provisions of the said Tender Documents and having thoroughly studied the requirements of Indian Oil
Corporation Ltd. relative to the work tendered for in connection with the Annual Maintenance Contract for
Emerson make PAC units installed at KSPL, Kot and having conducted a thorough study of the job site(s)
involved, the site conditions, soil conditions, the climatic conditions, labour, power, water, material and
equipment availability, the transport and communication facilities, the availability and suitability of borrow
areas, the availability of land for right of way and temporary office accommodation and quarters and all other
facilities and things whatsoever necessary for or relative to the formulation of the tender or the
performance of work, I/we hereby submit my/our tender offer for the performance of proposed work in
accordance with the terms and conditions and within the time mentioned in the Tender Documents.
In consideration of the sum of Rupee 1/- (Rupee one only) paid to me/us by Indian Oil Corporation Ltd., by
adjustment in the price of Tender Documents, I/We further undertake to keep my/our this tender offer open for
a period of not less than 4 (Four) months from the scheduled date of opening of Tenders as specified in the
General Instructions to Tenderers forming part of the Tender Documents.

(in the case of a Company) was/were employed as Directors of Indian Oil Corporation Ltd., during the period of

1. The contractors / suppliers will have to adhere to safe handling/ transportation methods. They will
ensure compliance to the provisions of the Hazardous Wastes (Management and handling) Rules,
1989, Manufacture, storage and Import of Hazardous chemical rules, 1989 and other applicable
legislative requirements.
2. The contractors/ suppliers will ensure that packaging, labeling and transportation of materials is
carried out in accordance with the provisions of Motor Vehicles Act 1988.
3. The contractors/ suppliers will provide relief in case of death or injury to any person or damage to
property from an accident occurring while handling/ transporting the materials on the principle of
no fault.
4. If contractors/ suppliers do not follow the instructions, the management will take necessary action as
per the provisions of the contract.
WRPL has implemented Environment Management System as per international standard ISO 14001 and
OHSAS 18001:1999. SH&E policy of WRPL is enclosed for reference. It is required that:
1. The Contractors or their personnel, working on WRPLs behalf, will have to follow the requirements
of EMS while doing the job.
2. The Contractors will have to demonstrate that their employees have requisite training/awareness in
respect of EMS of WRPL. For this, the Contractors will conduct requisite training/awareness
programme for their employees in consultation with respective Station-in-charges/Engineer-in-
charges. The training programme would have emphasis on the environmental policy, objectives and
targets of WRPL and significant environmental aspects of their work.
3. The Contractors will submit a record in this regard to the respective Station-in-Charges/Engineer-in-
Charges before start of work.
4. If Contractors fail to impart requisite training/awareness to their employees, the Management will
take necessary action as per the provisions of the Contract.

(CHAPTER I)
INDEX
1.0.0 INFORMATION
1.1.0 Special Instructions to Tenderers (SIT) shall be read in conjunction with the Instruction to
Tenderers contained in the General Conditions of Contract (GCC) (Page No. 114 to 121) and
other documents forming part of this contract wherever the context so requires.
1.2.0 Notwithstanding the sub-division of the documents into these separate parts and volumes,
every part of each shall be deemed to be supplementary to and complementary of every
other part & shall be read with & into the contract in so far as it may be practicable to do so.
1.3.0 Where any portion of the Instruction to Tenderers of GCC (Page No. 114 to 121) is
repugnant to or at variance with any provision of the SIT, then the provision of the SIT shall be
deemed to override the provisions of the Instruction to Tenderers of GCC and shall, to the
extent of such repugnance or variations prevail.
2.0.0 INTRODUCTION
2.1.0 Indian Oil Corporation Limited (IOCL), the largest commercial undertaking in the country is
engaged in the business of refining, transportation and marketing of crude oil and petroleum
products. IOCL is one of the Fortune Global 500 Companies.
2.2.0 Pipelines Division of IOCL (hereinafter called as the Owner), owns and operates about
11,000 Km of petroleum (Crude, Product, LPG, R-LNG) pipeline network across the length and
breadth of the country.
2.3.0 Western Region Pipelines (WRPL) of IOCL, with its headquarter at Gauridad, Rajkot (Gujarat)
operates & maintains several pipelines, namely Salaya - Mathura Pipeline (SMPL, Crude),
Mundra - Panipat Pipeline (MPPL, Crude), Koyali - Ahmedabad Pipeline (KAPL, Product), Koyali
- Dahej Pipeline (KDPL, Product), Koyali - Sanganer Pipeline (KSPL, Product), Koyali - Ratlam
Pipeline (KRPL, Product) and their branch lines. The total length of cross-country pipelines
operated under WRPL is approximately 4590 km having a combined capacity of approx 41.20
MMTPA.
2.4.0 Owner invites tenders under e-Tender mode from bona-fide and experienced Indian
Contractors of financial standing and reputation for the following work:

2.5.0 The information given in the bid documents and in the plans and drawings (if any) forming
part thereof is merely intended as a general information without undertaking on the part of
the Owner as to its accuracy and without obligation relative thereto upon the Owner. The
Vendors are expected to conduct their own surveys and investigations prior to bidding.
2.6.0 The detailed scope of work for the subject contract shall be as given in Clause-4.0.0, Chapter-
III: Special Conditions of Contract of this tender document.
3.1.0 IOCL KOT PUMP STATION is located near Kot Baliyan Village in Pali district of Rajasthan and
is around 15 Km from nearest railway station Falna.
4.1.0 As a precautionary measure, it is advised that tenderer visit the sites before submitting offer.
The intending tenderers may contact the following IOCL's site offices for necessary guidance
and help during site visits:
4.2.0 The intending tenderers shall be deemed to have visited the site and familiarised themselves
thoroughly with the working conditions at the work site before submitting the tender. Non-
familiarity with the site condition will not be considered a reason either for extra claims or for
not carrying out the work in strict conformity with the specifications.
5.1.0 It will be imperative on the part of each tenderer to acquaint him with all local laws, conditions
and factors which may have any effect or bearing on the execution of works and supplies under
the scope of this tender. In their own interest, the tenders are required to familiarize
themselves with (but not limited to) the Indian Income Tax Act., Indian Companies Act, Indian
Customs Act, Factories and Boiler Act, Contract Labour (regulation and abolition) Act,
Arbitration Act, PF Act, ESI Act and other related Acts and Laws and Regulations of India with
their latest amendments as applicable. The Owner shall not entertain any clarification from the
Tenderer(s) regarding such local conditions.
5.2.0 It must be understood & agreed that above factors have been properly investigated and
considered while submitting the officer. No claim for financial or any other adjustments to
contract price or completion time on account of lack of clarity of such factors shall be
entertained.
6.2.0 Owner has hosted the complete tender document on the e-tendering web site
(www.iocletenders.gov.in) and has ensured its availability for downloading the full set
comprising of the above. The tenderer is expected to download the complete tender
document, as per the index of the tender, compile the same and submit with their offer
digitally signed at all applicable places.
6.3.0 The tenderer is expected to examine the tendering documents, including all instructions,
specifications and drawings in the tendering document. Failure to furnish all the information
required by the tendering documents or submission of tender not substantially responsive to
the tendering document in every respect shall result in the rejection of the tender.
6.4.0 The bidders to note that Physical/ Hard Copy of tender documents shall not be issued from
the Owners office. Any request in this regard shall not be entertained.
6.5.0 Any person/ bidder downloading the tender document from Owners web site shall do so in
strict confidence and shall not part with possession thereof or copy or disclose the provision
thereof or any of them or disclose or take copies or tracings of any drawings, plans or routes
forming part thereof, it being understood that the information therein are confidential and
that the tender documents have been downloaded by the eligible tenderer solely for the
purpose of bidding.
6.6.0 Further to Clause 4.12 of Instructions to Tenderers of GCC, it is hereby stipulated that the
bidders shall not affect any corrections either in the General Conditions of Contract (GCC), the
Special Conditions of Contract (SCC), the Special Instructions to the Bidder (SIT), Technical
Specifications or in the description of the several items of works contained in the Schedule of
Rates forming part of the tender documents. Such tenders are liable to be rejected.
6.7.0 Further to Clause 4.1 of Instructions to Tenderers of GCC, tender documents shall always be
and remain the exclusive property of the Owner without any right with the Bidder to use
them for any purpose except for submitting the tender in accordance with the provisions of
these instructions by the prospective bidders and for use by the successful Bidder with
reference to the work. The Owner shall have no obligation to return to the Bidder the tender
documents submitted by Bidder.
6.8.0 The Bidder shall be deemed to have satisfied himself before tendering as to the correctness
and sufficiency of his tender for the works and of the rates stated by him in the Schedule of
Rates, which shall cover his entire obligation under the contract and all matters and things
necessary for proper completion of the works.
6.9.0 The tender document is non-transferable.
(ii) Please note, communication alerts in the form of e-Mail/SMS will be sent to the bidder if
and only if
His/her e-Mail/Mobile No. registered in the portal is correct and latest.
(iii) In addition to the above communication, the information is updated in portal under
Pending section of Dashboard like:
a) Limited Tender(s) to be made as favorite;
b) TQ/CQ to be responded;
c) Bids to be frozen;
(iv) All bidders must login and visit their DASHBOARD section on regular basis to get the
timely updates related to the pending activities as mentioned above at their end to act
timely even if they have missed any communication sent in the form of e-Mail / SMS by
system.
(i) All tenders available on the website can be searched by using the Search Active
Tenders menu under Bidders profile. Use any of the searching criteria to search your
tender. For a refined search, enter Work Title under Keywords and click Submit. The
intended tender(s) should be checked and saved as Favorite by clicking on the check
box. The bid submission process will start by clicking the menu My Tenders.
7.5.4 My Documents
(i) Provision of My Documents is available to bidders for uploading frequently required
documents in advance.
(ii) However, Uploading of any document in My Documents does not imply that the same
is submitted along with any tender.
(i) Bid along with all the copies of documents should be submitted in the electronic form
only through Indian Oil e-Tendering system. Bidder has to ensure that their bid
submission is complete in all respect by clicking on the FREEZE BID SUBMISSION button.
Any revision or amendment in bid shall be possible after bid submission only upto the due
date and time of submission of tender. Bidder in turn will receive an acknowledgement
against his/her bid submission. Successful submission of bid can also be verified under
My Bids section.
(i) Bidders may contact the following resource persons for any assistance required in this
regard.
Business Hours : Mon Fri, 09:00 to 16:00 Hrs India Time (IST) (GMT + 5:30 Hrs)
Bids can only be submitted / resubmitted before the last date and time of submission as per
tender.
The system time (IST) displayed on e-Tendering web page shall be considered as the
reference time for all transactions and no other time shall be taken into cognizance.
Bidders are advised in their own interest to ensure that bids are uploaded and submitted
successfully in e-Tendering system well before the closing date and time of bid.
No physical bid shall be accepted except the documents as specified in tender.
IndianOil does not take any responsibility in case bidder fails to upload the documents in the
portal within specified time.
7.10.0 Bidders are requested to provide correct/latest e-Mail address and Mobile No. for
receiving updates related to e-tender from time to time.
9.4.0 The Bidder shall furnish in Techno-commercial part the requisite information/ data/ detail,
etc. strictly in manner described below and shall be supported by the requisite documents/
annexure. Failure to furnish all information required as per the tender documents or
submission of bid not substantially responsive to the tender documents, in every respect,
shall result in rejection of the bid. Decision of the Owner, in this regard, shall be final &
binding on the bidder.
9.5.0 VOLUME-I (TECHNO-COMMERCIAL BID)
As a techno-commercial part of the tender, the Bidders are required to submit legible
scanned copies (more than 300 dpi) of the documents online in 03 (Three) covers as per the
list & sequence detailed below:
9.5.1 COVER-I: FEE
1) Tender forwarding letter duly signed by the authorised signatory.
2) Duly filled Checklist for submission of offer.
3) Copy of DD/ Bankers cheque or e-payment receipt of EFT as a proof for payment of
Earnest Money Deposit.
4) If bidder is claiming exemption from the payment of EMD as per Clause 16.0.0 of Special
Instructions to Tenderer, a notarised copy of registration certificate under NSIC/ Micro,
Small or Medium enterprise Development Act 2006.
5) Undertaking of bidder for acceptance of tender terms & conditions in format as per
Annexure-A.
6) Digitally signed copy of Techno-commercial Volumes of tender document including SIT,
SCC, GCC, Technical Specifications, etc.
7) Duly signed Corrigendum/ Addendum, if any, issued to the Bidder at a later date.
8) Form of tender (For Price Bid) as given on page 125 to 126 of General Conditions of
Contract.
9) Blank SOR duly signed on each pages indicating QUOTED or NOT QUOTED for each item
of SOR.
9.5.2 COVER-II: PREQUALIFICATION
1) In the case of Consortium tender, duly signed and executed Memorandum of
Understanding (MOU) indicating the name of the Leader of the Consortium, the roles and
responsibilities of each of the parties (Refer Clause 10.0.0 of Special Instructions to
Tenderers).
2) Copies of Articles of Association, Memorandum of Association and Certificate of
Incorporation in case of Limited Company/ Proprietary Firm/ JV.
3) Notarised/ Attested copy of Power of Attorney (or a copy thereof duly attested by a
Gazetted Officer) for the authorised signatory who signed the tender documents and is
having the Digital Signature Certificate (DSC) as required by Clause 4.13 of Instructions to
Tenderers (Page No. 116 of GCC) in the following manner:
a) If bidder is a proprietary firm, tender shall be signed by proprietor of the firm or power of
attorney holder of the firm, in such case original or certified (attested/ notarised) copy of
the power of attorney shall be submitted.
b) If the bidder is a partnership firm, it shall be signed by all the partners of the firm or by a
partner holding power of attorney for the firm or power of attorney holder of the firm for
signing the tender, in such case original or certified (attested/Notarised) copy of the
power of attorney shall accompany the Tender. A certified copy of the partnership deed
and current address of the partners of the firm shall also accompany the Tender.
c) If the bidder is a Private Limited Company, the power of attorney holder of the company
shall sign the Tender. Original or certified (attested/ notarised) copy of the power of
attorney along with the certified (attested/ notarised) copy of the Articles of
memorandum of Private Limited Company shall accompany the tender.
d) If the bidder is a Public Limited Company, the power of attorney holder of the company
shall sign the Tender. Original or certified (attested/ notarised) copy of the power of
attorney along with certified (Attested/ notarised) copy of the Articles of memorandum of
Public Limited Company shall accompany the Tender.
e) In case of bid from JV, the tender shall be signed by an authorised representative of JV
having power of attorney signed by legally authorised signatories of all the JV members.
Also, certified copy of Memorandum of Association, Article of Association & certificate of
incorporation from ROC, JV agreement shall be submitted along with the bid.

Special Instructions to Tenderer amplified hereunder. Documents in support of above in the
form of copies of work order, execution/ experience/ completion certificate, etc. shall also be
furnished.

9.5.3 Solvency certificate from a Scheduled bank in India acceptable to the Owner. In case of
Consortium, the Solvency Certificates shall be furnished by all consortium members.
9.5.4 COVER-III: TECHNICAL

will be required to extend the validity of his bid security correspondingly. The provisions of
discharge and forfeiture of bid security shall continue to apply during the extended period of
the bid validity.
14.1.0 The tenderer shall furnish, as part of his tender NIL as Earnest Money Deposit at the time of
submission of the tender.
15.1.0 The successful bidder will submit Initial Security Deposit (ISD) at the rate of 2.5% of the
nominal contract value prior to taking up works lying with the owner. The ISD shall be
retained by the owner during the currency of the contract along with the Security deposit
deducted at the rate of 7.5% of the running bills maximum up to 10% of contract value and
the same shall be refunded after completion of defect liability period upon due certification
by Engineer-in-Charge. Same may be submitted by e-banking, if desired as per Bank Details of
IOCL mentioned in above clause.
15.2.0 If ISD has been submitted through E-Banking, then Contractor shall have to submit the ISD
submission details to EIC & Finance department through EIC, within 7 days, as per following
format: -

17.1.0 The bid prepared by the bidder and all correspondence and documents relating to the bid
exchanged by the BIDDER and the OWNER shall be written in English language only.
Supporting documents and printed literature furnished by the bidder may be in another
language provided they are accompanied by an appropriate translation of pertinent passages
in the above stated language. For the purpose of interpretation of the bid, the English
language shall prevail.
18.1.0 The Bidder shall bear all costs associated with the preparation and submission of his bid and
OWNER will in no case be responsible or liable for these works, regardless of the conduct of
outcome of the bidding process.
19.1.0 A Bid once made can be modified and /or resubmitted as per the instructions given in the
online bid re-submission document in the bidders manual kit on www.iocletenders.gov.in but
a bid once made cannot be withdrawn.
20.1.0 Any queries in connection with the bid shall be discussed and clarified during a pre-bid
conference as per time and venue specified in the e-tender notice. (If pre-bid meeting
information is not available in the tender then the same shall not be held.) The authorized
representatives of the parties which have downloaded the tender document from Indian Oils
e-tendering website shall only be allowed to attend the meeting.
21.1.0 Pre-price bid meeting shall be held as a prelude to price bid opening if required.
Representatives of the tenderers shall attend the pre-price bid meeting for resolving the
outstanding issues, if any, and for other mutual clarifications. The date and time shall be
conveyed to the technically qualified tenderers at a later date.
21.2.0 Any modification to the tendering document which may become necessary as a result of the
pre-price bid meeting (if held) shall be made by Owner exclusively by issue of an addendum.
22.1.0 The Techno-Commercial Bid (Volume-I of Bid) of all the tenders submitted online up to the
due date & time for receipt of bids shall be opened as per due date and time as specified in
detailed NIT. The system time (IST) that will be displayed on e-Procurement web page shall be
the time considered for determining the expiry of due date and time of the tender and no
other time shall be taken into cognizance.
22.2.0 The Owner shall not be responsible for delayed submission of offers or non-submission of
offers due to any reason whatsoever. The responsibility of ensuring online & on-time
submission of their offers lies entirely with the bidders. The bidders are requested to submit
the bid online much before date and time of submission, failing which IOCL shall not be
responsible for any such technical problem.
23.1.0 Evaluation of the tenderer shall be primarily done based on the following qualifying criteria:
(i) Annual turnover of the tenderer for at least one of the last 3 (three) financial years
(2012-13, 2013-14 & 2014-15) shall not be less than Rs. 2.20 Lac.
(ii) The tenderer should have successfully completed a single work of similar nature during
last five years ending on the start date of download / sale of tender documents.
a) 3 similar nature completed works each of amount not less than Rs. 1.02 Lac OR
b) 2 similar nature completed works each of amount not less than Rs. 1.35 Lac OR
c) 1 similar nature completed work of amount not less than Rs. 1.69 Lac
27.1.0 Owner shall have full discretion to engage consultant of his choice for expert advice on the
evaluation of bids, inspection of equipments, supervision of installation and commissioning or
any other services deemed necessary from time to time. Bidder shall be bound to answer all
relevant queries from Owner/ Consultant.
28.1.0 The right to accept in full or in part/parts the tender will rest with Owner. However, Owner
does not bind itself to accept the lowest tender and reserves the right to reject any or all the
tenders or any part of a tender so received and no compensation shall be paid for the efforts
made by the bidder. Reasons for rejection shall be disclosed on written representation by the
concerned bidder whose bid is rejected.
28.2.0 The right to abandon tendering without assigning any reason will rest with Owner. No
compensation shall be paid for the efforts made by the bidder.
28.3.0 No bidder shall contact the OWNER on any matter relating to its bid from the time of the bid
opening up to the time that the contract is awarded. Any effort by a bidder or bidders agent,
consultant or representative howsoever described to influence the OWNER in any way
concerning scrutiny, consideration, evaluation or computation of the bid(s) or decision
concerning award of contract shall entail rejection of bid.
28.4.0 Tenders in which any of the particulars and prescribed information is missing or is incomplete
in any respect and/or the prescribed conditions are not fulfilled shall be considered non-
responsive and are liable to be rejected.
28.5.0 The price bid of only those Bidders will be opened who are considered techno-commercially
acceptable to the Owner. Date of opening of the price bid shall be informed to the technically
qualified Bidders.
29.0.0 INDIGENISATION
29.1.0 Tenderer shall make maximum possible utilisation of indigenous manufacturing facilities and
other services/ expertise available for their project implementation plans. It is, therefore,
essential that as a preliminary exercise, Tenderers should explore potential available
indigenously for utilisation of manufacturing facilities and other various products/
equipment/ material of Indian origin conforming to specifications as well as construction
expertise available indigenously and associate experienced Indian Agencies under overall
supervision and responsibility of Contractor.
30.0.0 NEGOTIATIONS
30.1.0 Negotiations will not be conducted with the bidder as a matter of routine. However,
corporation reserves the right to conduct negotiation.
37.2.0 In the Form of Tender for Price Bid (Page-125 & 126), commercial bid (Page-127 & 128) and
Format for Bank Guarantee in lieu of Earnest Money Deposit (Page-133 & 134) of GCC, the
following changes may be incorporated while submitting the bid:

1.1.0 Special conditions of contract shall be read in conjunction with the General Conditions
of Contract, specifications, scope of work, schedule of rates and other documents
forming part of this contract wherever the context so require.
1.2.0 Notwithstanding the sub-division of the documents into these separate sections and
volume, every part of each shall be deemed to be supplementary to and
complementary of every other part and shall be read with and into the contract in so far
as it may be practicable to do so.
1.3.0 Where any portion of the General Conditions of Contract is repugnant to or at variance
with any provisions of the Special Conditions of Contract, then the provisions of the
Special Conditions of Contract shall be deemed to over-ride the provisions of the
General Conditions of Contract and shall be to the extent of such repugnancy or
variations prevailed.
1.4.0 Wherever it is mentioned in the specifications that the Contractor shall perform certain
works or provide certain facilities, it is understood that the contractor shall do so at his
cost, being deemed to be part of the relevant item in the Schedule of Rates whether
expressly stated or not.
1.5.0 The materials, design and workmanship shall satisfy the relevant Indian Standards,
manufacturer's recommendations, the Specifications contained herein and codes
referred to. Where the specifications stipulate requirements in addition to those
contained in the standard codes and specifications, these additional requirements shall
also be satisfied.
1.6.0 Contractor shall satisfy the relevant Indian Standards, specifications contained herein

1.7.0 The experience questionnaire enclosed to the General Conditions of Contract has to be
filled in by the tenderer. Failure to fill in questionnaire completely or submitting
incorrect information therein may make the tender liable for rejection.
1.8.0 The tender shall also submit a brief company profile-indicating list of equipment owned
/ intends to be mobilized for the present work.
2.1.0 The scope of work under this tender is Annual Maintenance Contract for Emerson
make PAC units installed at KSPL, Kot complete as per directions of site engineer/
Engineer-in-charge.
3.1.0 IOCL KOT PUMP STATION is located near Kot Baliyan Village in Pali district of
Rajasthan and is around 15 Km from nearest railway station Falna.
4.1.0 The VFD room of KSPL is having 04 nos of Air Conditioning units of Emerson make
model No. PEX 125 EC and for the uninterrupted service of these packaged AC units, the
machines are being put under Annual Maintenance Contract. The scope of work under
this Annual Maintenance Contract shall comprise of:
2) Breakdown maintenance services As and when the complaint is lodged with the
contractor
The scope includes Cleaning up of unit & Air filter, cleaning of cooling coil & condenser
coil, cleaning of Humidifier bottle & electrodes, cleaning of water supply Strainer &
drain inside the machine & attending any leakage or overflow. Checking of drive belt &
replacement if necessary. Lubrication of bearings, if necessary, Checking up of operation
of Unit, controller and condenser and taking corrective action (if necessary), Combing of
Fins of condenser & evaporator coil, if necessary, Measurement of current of each
individual equipment and taking corrective action, if applicable, Checking & rectification
of the overload relay settings, Checking of all electrical components for loose
connections and tightening if necessary , Checking of refrigeration piping for any gas
leakage and rectification, if necessary, Checking of refrigeration system & pressure
readings and taking corrective action, if applicable, Checking & rectification of pulleys,
motor mounts, condenser fan mounts etc, Checking & rectification ( if applicable) of
panel insulation, Checking & rectification ( if applicable) of temperature readings,
Checking & rectification ( if applicable) of microprocessor controllers for operation.
The scope excludes day-to-day routine maintenance & operation of units, repairs/
replacement of electrical main incoming switch, main incoming cable, fuses, control
transformers & indicating lamps. repairs/replacement of water piping & accessories,
major work on ducting, Dampers, duct lining, grilles etc. and any work related to false
ceiling.
The replacement of all spare parts including the compressors shall be in the scope of
contractor and such parts removed shall be the property of the contractor. However,
the spare supply while replacement of major equipments like condenser & cooling coil,
consumables like Fan belts, Humidifier electrodes, refrigerant gas (if leakage occurs due
to fault not attributable to the contractor), air filters and sheet metal parts shall not be
in the scope of contractor under AMC charges. Separate requisite shall be made for the
excluded spares mentioned above. However, the bidder is required to quote the rates
for these excluded spares in the SOR and the rates of these spares shall remain the
same during the entire contract period and shall not undergo any variations.
In case of spares, this job is in nature of the rate contact and hence no quantities are
mentioned in the SOR against spares. Therefore it is not necessary for Engineer-in-
Charge to execute all the items. The decision of the Engineer-in-Charge for the
applicability of particular item and the extent to which particular item/(s) is operative
shall be final and binding upon the contractor.
The maximum time allowed for attending minor complaints shall be 8 hrs from the time
of lodging of complaint and for major complaints involving replacement of compressors
/ driers or leakages, the time allowed shall be 3 days from the date of lodging of
complaint.
6.1.0 The Owner may be engaging at work site other agency(ies) to carry out some works
and/or to provide services to the Owner. The contractor shall co-operate with the
Owner or other agency (ies) engaged at the work site to ensure harmonious working
among the contractor and the owner and the agency(ies) involved and shall comply with
any instruction issued by the Engineer-in-Charge and/or Site Engineer for this purpose.
6.2.0 Any delay caused due to non-availability of work fronts (including delayed availability of
work fronts if applicable) and/or due to the requirements of other agency(ies) engaged
at the work site and/or change in design and other stipulations of requirements at site
shall not entitle the contractor to any extra payments/claims whatsoever. Only suitable
extension of time for completion shall be granted in accordance with the provisions of
relevant clause of Abridged General Conditions of Contract, provided the reasons for
delay are not solely attributable to Contractor.
7.1.0 The contractor shall be responsible for the true and proper setting out of the works and
for the correctness of the position and levels, dimension and alignment of all parts of
the works and for the provision of all the necessary instruments, appliances and labour
in connection therewith.
7.2.0 If at any time during the progress of the works any error shall appear or arise in the
position, levels, dimensions or alignment in any part of the work; the contractor, on
being required to do so by the Engineer-in-Charge or the Site Engineer, shall at his own
expense rectify such error to the satisfaction of the Engineer-in-Charge or Site Engineer

unless such error is based on incorrect data supplied in writing by the Engineer-in-
Charge or Site Engineer in which case the expense of rectifying the same shall be borne
by the Owner.
7.3.0 The checking of any setting out or of any line or level by the Engineer-in-Charge or the
Site Engineer shall not in any way relieve the contractor of his responsibility for the
correctness thereof and the contractor shall carefully protect and preserve all bench
marks other things used in setting out the works.
8.1.0 Payment shall be made as stipulated in Schedule of rates. Wherever, not so specified,
mode of measurement shall be as per IS 1200 latest edition and payment will be made
accordingly.
8.2.0 All payment to the Contractor shall be released from WRPL Sendra office.
9.1.0 The contractor shall at his own cost and initiative arrange for and obtain all necessary
permissions, permits, consents etc, as may be necessary, to transport the contractors
materials, tools, equipments and labour along highway, roadway, railway, bridge, dyke,
dam, river or through posts of toll collection, octroi checks or other line border or
barrier.
10.0.0 RECORD :
10.1.0 The contractor shall maintain all the records in the register as instructed by the EIC.
11.1.0 On no account the contractor shall proceed for concealing/covering of the works making
beyond reach of inspection or measurement by the Site Engineer or his authorized
representative. Should the contractor do so, the same shall be uncovered at
contractors risk and expense for carrying out the inspection and measurement.
12.1.0 The contractor shall arrange / procure water required for the work at his own cost for all
leads and lifts. IOCL shall not be responsible for supplying water and Contractor shall
ensure timely and adequate supply of water to meet the schedule.
12.2.0 The contractor shall make his own arrangement for power required for the work at his
cost. DG set of suitable capacity may be installed and operated by the contractor at his
cost. IOCL shall not be responsible for power supply and contractor shall ensure proper
supply of electricity to meet the schedule. The electrical works shall be carried out
through Licensed Electrical personal only.
13.0.0 JURISDICTION
13.1.0 Further to article 4.1 of Form of Contract in the General Conditions of Contract, Beawar
Court shall have exclusive jurisdiction.
14.0.0 QUALITY OF JOB
14.1.0 Work shall be carried out according to Indian Standard Code. Wherever IS Code is not
applicable direction of EIC shall be final.
16.1.0 No part of the contract or any share or interest therein shall be in any manner or decree
transferred/assigned or sublet by the Contractor directly or indirectly to any Person,
Firm or Corporation whatsoever.
17.1.0 The contract price shall be firm and valid for the entire duration of the contract till the
completion of work, and shall not be subject to any adjustment due to increase in price
of materials, utilities, taxes, duties etc. or any other input for performance of work and
the contract except for new taxes and duties.
18.1.0 Further to provisions of Clause 5.6.0.0 of GCC & sub-clauses there under, Defect
liability period for the work is 12 months and shall commence from the date of
completion of work as certified by EIC as per completion certificate.
18.2.0 The Contractor shall at his own cost & initiative correct, repair and / or rectify all such
defect(s) and/or imperfections in the works performed as shall be discovered during the
said defect liability period.
18.3.0 The contractor shall indemnify and keep owner indemnified against all loss and damage
suffered by the owner arising from any negligence/omission or default on the part of
contractor or breach of any of the terms of the contract by the contractor, its servants
or agents observed within the defect liability period. In the event of the contractor
failing to do so, the provisions of Section-5 of GCC shall apply.

21.1.0 The contractor shall not allow any visitors to the works or premises of the site(s)
without the approval of the E-I-C and/or Site Engineer.
22.1.0 The price offer for the subject work shall exclude service tax as applicable under Finance
Act, 1994 and subsequent amendments thereto. The bidder shall indicate in its bid the
Service Tax registration no. and in case the Service Tax registration no. is not obtained,
the bidder will give confirmation for obtaining registration with a copy of application for
registration.
22.2.0 Bidders are required to clearly indicate the applicable rate of Service Tax considered for
this job, after abetment if any, in the format given in Annexure F and to be submitted
along with technical bid which shall be used during evaluation of price bids. (Table
indicating different options available under Service tax Rules has been attached as
Annexure G for reference). Bidder to note that the prices quoted for the subject work
shall be exclusive of the applicable service tax.
22.3.0 Bidders to note that prices quoted for the subject work shall be exclusive of the
applicable service tax and their offer shall be evaluated in regard to their declaration of
the service tax as follows:
22.3.1 Rates as quoted by the bidder shall be considered for evaluation of the bids. The
declaration regarding service tax submitted with the bid shall be treated as final and no
communication / correspondence shall be entertained from the bidder after opening of
the techno-commercial bids.
Further, in case of entities other than companies or business entity registered as body
corporate where reverse charge mechanism is applicable, for evaluation purposes, the
service tax implication shall be worked out based on sum of the following:
(i) For the value on which service provider (bidder/contractor) is liable to pay
service tax, amount of service tax calculated on rates quoted by the bidder, and
(ii) For the value on which service receiver (owner) is liable to pay service tax based
on the rates as determined by the Owner, i.e. for Supply @ 0%, for Service @
14%, for Composite @ 5.6% (without adding any value of material issued by the
Owner to the Contractor) and AMC services @ 9.8%. These rates are subject to
change as per notification of Govt. Of India issued from time to time.
Payment of service tax will be made in accordance with the invoice(s) raised by the
Contractor, limited to the rate considered during evaluation, as above.
22.3.2 Bidders to note that, in case of non-submission of service tax rates or submission of
blank service tax formats etc. With the techno-commercial offer, evaluation of the bid
shall be done by loading service @14% on all items of SOR other than Supply items.
Further in case of entities other than companies or business entity registered as body
corporate where reverse charge mechanism is applicable, for evaluation purposes, the
service tax implication shall be worked out based on sum of the following:
(i) For the value on which service provider (bidder/contractor) is liable to pay service
tax, amount of service tax calculated based on rate @14% on all items of SOR other
than Supply portion,
(ii) For the value on which service receiver (owner) is liable to pay service tax based on
the rates as determined by the Owner, i.e. for Supply @ 0%, for Service @ 14%, for
Composite @ 5.6% (without adding any value of material issued by the Owner to the
Contractor) and AMC services @ 9.8%. These rates are subject to change as per
notification of Govt. Of India issued from time to time.
Payment of service tax will be made in accordance with the invoices(s) raised by the
Contractor, limited to the rate considered during evaluation, as above.
22.3.3 As mentioned at Clause 22.1.0 above, the quoted price shall be exclusive of service tax.
However, if a bidder is found to be have quoted prices inclusive of service tax in the
techno-commercial bid, the Owner reserves its right to bifurcate the quoted prices into
basic price and service based on:
(i) Service tax rates quoted by the bidder or in absence of such information,
(ii) Service tax rates as determined by the, i.e. for Supply @ 0%, for Service @ 14%,
for Composite @ 5.6% (without adding any value of material issued by the
Owner to the Contractor) and AMC services @ 9.8%. These rates are subject to
change as per notification of Govt. Of India issued from time to time.
Payment of service tax will be made in accordance with the invoices(s) raised by the
Contractor, limited to the rate considered during evaluation, as above.
22.4.0 Upon award of work, Service Tax shall be paid by OWNER to the CONTRACTOR at the
rate mentioned in the invoice raised by the Contractor, limited to the rate(s) considered
during evaluation as per Cl. No. 22.3.0 and its sub-clauses above in accordance with the
provisions of Rule 4A of the Service Tax Rules 1994 which state that each invoice shall
be serially numbered and shall contain the following details:
(ii) Name and address of the person receiving the taxable service
The above details are required to enable OWNER to claim CENVAT credit on Service Tax
paid. In case Contractor does not furnish such invoices enabling the OWNER to claim
CENVAT benefit then such amount shall not be reimbursed to the CONTRACTOR
irrespective of whether the CONTRACTOR has paid such amount to the Tax authorities.
CONTRACTORs liability however shall be limited to furnishing if CENVATABLE invoices.
22.5.0 Statutory variation on Service Tax (as payable to the bidder) as applicable for the
category/service shall be to Owners account up to the contractual completion period.
Any statutory variation in service tax after the contractual completion period shall be to
contractors account.
22.6.0 The service tax payable by the Owner to the Contractor shall be limited to the rate(s)
considered during evaluation as per clause 22.3.0 and its sub-clauses above (except for
condition mentioned in clause 22.5.0) irrespective of the amount payable by the
Contractor towards Service Tax to Statutory Authorities.
27.0.0 INFORMATION
27.1.0 Further to Instructions to Bidders of GCC, the Bid Documents shall always be and remain
the exclusive property of the owner; use thereof has been permitted by the owner to
prospective bidders for submitting the tender in accordance with the provisions of these
instructions. In the event of the tender document not being used by the prospective
Bidders, the document shall forthwith be returned to the owner.
29.0.0 TAXES
29.1.0 Any new taxes, duties, levies etc imposed by the Central or State Government
subsequent to the submission of the final price bid shall be reimbursed against
documentary evidence However, the benefit of any withdrawal of any existing taxes,
duties, levies, etc must be passed on to IOCL.
29.2.0 Any increase in the existing taxes duties, levies, etc or replacing existing taxes, duties,
levies, etc with new taxes, duties, levies, etc after the submission of bids shall be borne
by the bidder.
29.3.0 Further to clause 8.1.1.0 of General conditions of contract, all duties, taxes and other
levies including cess on all duties, taxes and other levies (excluding service tax & cess
thereon) payable by the contractor under the contract shall be included in the rate and
prices submitted by the bidder.
30.1.0 All works shall be performed & executed by the Contractor in strict conformity with the
job description, specification, plans, drawings designs and other contract documents
applicable to the specific works(s) and any relative instruction as may be issued to the
contractor by the Engineer-in-Charge or Site Engineer from time to time.
30.2.0 The Engineer-in-Charge and Site Engineer shall be entitled from time to time or at any
time at their discretions to issue written orders or instructions to the contractor relative
to the performance and or execution of the work(s) by the Contractor or otherwise
relative to any matter touching or effecting the contractor or arising there from and to
revise or revoke any orders or instructions previously issued and the Contractor has to
abide by them.
30.3.0 Engineer-in-Charge (EIC) or the person authorized by EIC may stop the work whenever it
is necessary for proper execution of the job. He shall have the authority to reject all
work or part thereof at any time, which do not conform to the specifications & no claim
whatsoever on this account will be entertained.
30.4.0 During the contract period if any damage / defect is discovered due to poor quality
material workmanship it shall be rectified / replaced by the contractor at his own
expenses. The contractor shall attend this problem in the shortest time.
30.5.0 If there is any loss or damage to the Corporation property or its employees due to the
negligence of the persons(s) deployed by the contractor he shall make good the loss as
assessed by the IOCL.
31.2.0 The contractor shall be required to furnish the bill as per the Schedule of Rates in
triplicate after having carried out the job, which shall then be verified by the Engineer -
inCharge for payment.
31.3.0 The payment shall be released within One Month from date of submission & acceptance
of the bill by Site Engineer / EIC.
31.4.0 As per IOC policy payments and receipts to / from Government and Semi-Government
Agencies would be rounded off to the near higher rupee and in other cases the rounding
off will be to the nearest rupees that is paisa 50 or above will be rounded off the near
higher rupee and paisa less than 50 will be ignored.
31.5.0 All taxes like sales tax, Income Tax & any other Government taxes as applicable at the
time of execution of contract shall be deducted on Running Bills.
31.6.0 All payments will be released through E-banking only. Successful bidder should
provide their bank details as per the annexed format.
31.7.0 If the bidder takes deviations to specified payment terms, loading for interest
implication at 1% higher than IOCL cash credit rate shall be done.
32.1.0 Contractor shall observe, in addition to codes specified in respective specifications, all
national and local laws, rules and regulations and requirements pertaining to the work.
33.1.0 Any money paid to any director, attorney, agent, officer or employee of the Contractor
and any receipt, settlement, acknowledgement of liability or other arrangement,
agreement of document whatsoever signed by any such director, attorney, agent,
officer or employee of the Contractor or erstwhile director, attorney, agent, officer or
employee of the Contractor (without notice of his cessation of interest) or by any person
held out to be a director, attorney, agent, officer or employee of the Contractor
authorized to act on behalf of and/or to bind the Contractor, be binding upon the
Contractor and shall constitute a full release and discharge to the Owner and/or
settlement, acknowledgement or obligation of, upon or with the Contractor, as the case
may be, and the Owner shall not be concerned with the actual application of any money
so paid or of the actual authority of such director, attorney, agent, officer or employee
(actual, erstwhile or purported as the case may be) vis--vis the company to make the
settlement, receipt, acknowledgement, agreement or other document concerned.
34.1.0 Before starting of work, Contractor shall obtain license from concerned authorities
(Assistant Labour Commissioner) & furnish copy of the same to Engineer-in-Charge.
35.1.0 In addition to the provisions of clause 10.0.0 of GCC, the Contractor shall take all
reasonable precautions to avoid pollution or contamination of the air, land or water
arising out of the performance of the work.
36.1.0 The bidder to state that it is not engaging child labour as per various labour laws
applicable to them. Any entity making a fake claim would have its contract terminated
forthwith, if detected later. Further, amendments to certain clauses of the General
Conditions of Contract, attached as Annexure-D1 elsewhere in the tender, are to be
complied in totality. An undertaking for non-engagement of Child Labour, as per
Annexure-D is also to be submitted by the bidder.

i. During excavation, the excavated earth must be dumped at a safe distance from the
edge of excavation. In no case this shall be less than 1.5 meters from the top edge of
the excavation.
ii. Necessary slopes and stepping shall be provided to the sides of the trenches. Shoring is
to be provided in places where danger is expected due to side collapses resulting from
seepage, over - burden soils, etc.
iii. Safe cross walkways are to be provided at distances not more than 30 mtrs along a
continuous trenching for pipelines etc.
iv. Ladders, gangways are to be provided at convenient places for carrying excavated muck
from deep trenches. Ladders shall be firmly secured to ground and rungs of the ladders
shall be properly secured and safe.
v. Scaffolding for shuttering and gangways for concreting, etc. (all) be checked for safety to
carry loads during construction. Necessary hand rails/rope guards and other protections
are to be ensured. These shall be properly secured to ground or tied to any permanent
structure nearby. The Contractor should arrange rigid double steel scaffolding for the
working at the height of more than 3 mtr. All the workers should wear certified safety
belts & nets with secured ropes during working at heights.
vi. All the water in the excavated pits shall be drained away from the area of working using
dewatering pumps by contractor at his own cost.
vii. Excavated pits shall be barricaded & proper danger boards for day & night shall be
exhibited.
viii. Hard hats (safety helmets), rubber boots, safety shoes, and hand gloves, etc are
required to be provided for supervising as well as other working personnel by the
contractor.
ix. Keep a watch on buried cables/OFC and underground systems. If the cable/OFC is
damaged, the same shall be repaired by the contractor at his own cost.
x. All TLPs, anode / cathode connection, Turning Post, KM Post, warning sign boards etc if
damaged, has to be repaired/replaced by Contractor at his own cost to the satisfaction
of E-I-C. Failing to do so may make contractor liable for penalty as per penalty schedule.
xi. Hard hats (safety helmets) made out of insulating material to be used by personnel
working in 'live' areas like substations, etc.
xii. Safety boots, necessary hand-gloves as required, shall be used.
xiii. Earthing of machineries and equipments shall be ensured. No open/ bare connections
allowed. The arrangements should be checked periodically for damages to insulation
and loose connections, etc and rectified so that the wiring becomes non-hazardous.
xiv. The areas of working during nights shall be properly illuminated with flood- lights and
hand- lamps as per the demand of the job.
xv. Danger signals and safety tags in the live areas shall be demonstrated properly. All
connections are to be switched off after the working hours.
xvi. Proper and correct lifting methods shall be adopted.
xvii. All lifting tools, jacks, tackles and wires ropes etc shall be of tested quality for safe
working loads. Wire ropes shall be of sound construction without any splaying.
xviii. Check to be exercised before using ropes with for broken wires. Manufacturers
guidelines/standards instructions are to be followed for using wire ropes and slings with
broken wires. Ropes having damage in the core shall be rejected. Experience and
common sense is of immense help.
xix. Usage of hoisting belts/safety belts is must for personnel working at higher elevations.
Such safety belts and hoisting belts are to be certified by safety personnel of the
station/EIC. Besides initial certification EIC / Safety personnel can inspect/assess the
condition and reject any or all such belts at any point of time.
xx. Only safe gangways/walkways shall be used for movement of personnel.
xxi. Check connections to headman anchors before hoisting.
xxii. All live wires to be crossed during hoisting shall be made dead near the vicinity of the
area during hoisting/ rigging.
xxiii. Avoid keeping loads supported by hoisting equipments for an unreasonable length of
time.
xxiv. Ropes, cables, and slings must be protected with pads or wooden blocks at sharp edges.
38.2.0 Safety-General
1) Safety starts from the individual on the job. Experience and common sense shall be
generously used. In case of doubt. Ask somebody who knows shall be the motive.
2) Proper communication and alertness on the job is to be ensured.
3) Manholes and openings for ducts etc shall be kept properly covered.
4) Safety zones during hoisting, radiography, sand blasting, pressure testing,
commissioning, etc shall be created and demarcated. Trespassers through site are
not being allowed in these areas. Contractor shall deploy security guards at open
site during night as well as in day to ensure security of pipelines.
5) Correct tools and tackles should be used for every work. Make shift tools and tackles
will result in accidents.

a) The person doing the electrical maintenance job should be minimum ITI/Diploma
in Electrical Engineering.
b) Workers / Labours should use Safety Belt while working on heights such as FLT /
High Mast / Street light etc.
c) Safety, Fire and Security regulations outlined below may be read in conjunction
with Safety Rules and Fire Prevention Regulations of the Owner given Safety
Manuals and other such documents. It will be the responsibility of the Contractor
and its supervisors to make themselves fully conversant with all the Rules and
Regulations regarding Safety and Fire Prevention and to issue necessary
instructions to all persons deployed by the Contractor at the Construction site(s)
d) The work shall be carried out on work permit basis after satisfying all safety
conditions laid down by the Safety Engineer/issuer. Work permit shall be obtained
by the Tenderer and shall be renewed from time to time.
e) Tenderer shall be responsible for any delay in this regard and no claim for idling
the machine/ manpower on safety ground shall be considered by IOC.
f) The contractor shall take other additional precautions or resort to such other
additional safety measures as may be directed from time to time by the Engineer-
in-charge / Site Engineer.
g) The Contractor shall be responsible to enforce in his work force strict discipline
and safety consciousness required to be observed in operating petroleum installa-
tion and shall ensure that the work is carried out under constant supervision by
competent supervisors who are adequately informed and experienced for
handling the work in such environment.
i) The Contractor shall take due precaution to avoid damage to other pipelines,
roads, cables, drains, water mains, dykes, poles, pillars, fences, wires, supports
and embankments and other underground works, structures or construction
whatsoever and shall at his own cost and initiative forthwith restore and repair
any damage thereof to the satisfaction of the Owner.
l) The following requirements shall be complied with by the Contractor in the event
of an injury being sustained by anybody on the works.
n) The Contractor shall ensure that the following general rules/guidelines pertaining
to safety are rigidly complied with :
i) Within the premises, the speed limit of vehicles shall not be more than 20
kmph.
ii) Wearing of terylene/nylon/polyester/clothing within premises is strictly
prohibited as there are chances of generation of static electricity in these types
of clothing.
iii) While on duty, wearing of chapels/slippers is prohibited and everyone should
wear shoes/safety shoes.
iv) Wearing of safety helmet is essential for all persons working in construction
jobs.
v) All personnel of the Contractor shall be required to wear photo badges for
identification.
o) The Contractor shall bear in mind the following aspects about safety equipment
and do the needful:
i) Special safety equipments like gas masks, fresh air breathing apparatus,
whenever required, can be taken on loan from IOC office through the Engineer-
in-Charge.
ii) Goggles should be used during grinding or chipping jobs.
iii) Safety guards, safety devices and like equipments must not be tampered with
and should be used.
p) The following safety aspects should be borne in mind by the contractor and his
man crew while working on electrical lines or with electrical tools and they
should take suitable precautions accordingly.
i) No person shall work on any live electric conductor or apparatus and no person
shall assist any other person on such works unless he is authorised in this
behalf.
ii) No defective extension cord/cable shall be used on portable hand tools.
iii) All portable power tools such as drills, grinders etc. which are operated
electrically, should be subjected to thorough inspection before being put into
use.
iv) It should always be checked that proper earthing wire is provided for all
electrical tools.
v) To ensure that electrical power is isolated before the commencement of any
electrical work.
q) Contractor shall take all the necessary precautions and abide by relevant rules of
safety including Explosive Rules and Regulations and such other rules and
regulations which are presently in force and which may come into force during
the currency of the contract. The Contractor shall also take such other additional
precautions and resort to such other additional safety measures as may be
directed from time to time by the Officer-in-Charge. Violation of any rules and
regulations will entail immediate termination of the contract.
39.0.0 IMPOSITION OF FINE DUE TO LACK OF ADHERENCE TO SAFETY NORMS
39.1.0 With a view to improve the safety aspects of execution of the job based on the job
requirements, following penalties will be imposed for violation/non-adherence of safety
procedures:

41.0.0 INSURANCE
41.1.0 The contractor shall provide the following insurance through his regular agency to cover
his men, machinery and equipment.
a) Workman compensation Insurance for the persons deployed for execution of the
work.
b) Group Personnel Accident Policy.
c) All required Insurances
d) Contractor is also recommended (NOT MANDATORY) to secure itself from any losses
arising out of cost incurred due to rectification of pipeline for damage to same by
contractor during coating refurbishment works
42.1.0 The Contractor shall adequately cover all its eligible employees under the provisions
contained in Employees Provident Fund Act, 1952 and subsequent amendment
thereof, if any. The Contractor shall furnish a certificate and statement embodying
therein all the relevant details in evidence of having complied with the provision of
the said Act. It would be obligatory on the part of the Contractor to take necessary
PF Establishment Code No. and regularly deposit the provident fund amount
(amount deducted from the employee's wage and employer's contribution) for and
on behalf of all eligible employees to the concerned statutory authority.
42.2.0 The Contractor shall abide by all provisions of CONTRACT LABOUR (REGULATION &
ABOLITION) Act 1970 failing which the contract shall be liable for rejection.
42.3.0 The Contractor will have to ensure compliance with various procedures of ESI Act,
1948 (wherever applicable) and keep indemnified the Owner from and against all
actions, claims, demands, liabilities whatsoever under and in respect of the breach of
any provision of clauses of the said Act.
42.4.0 The Contractor will have to ensure the submission of all the relevant documents of PF,
ESI deductions and also payment of minimum wages of individual employee engaged
by him in contract as per the EPF Act 1952 and ESI Act, 1948(wherever applicable),
failing which the bill shall not be processed for release of payment.
42.5.0 The Contractor shall defend, indemnify and hold the Corporation harmless, from any
liability or penalty which may be imposed by the Centre, State or Local authorities by
reason of any violation by the contractor/ his employees of such laws, regulations or
requirements and also from all claims, suits arising out including any liability that may
arise out of accidents, whether brought by the employees of the contractor, by third
parties or by the Central or State Government.
42.6.0 For any infringement of these provisions, the Owner shall be at liberty to rescind the
contract without any liability to pay any compensation whatsoever to the contractor.
42.7.0 In case of any legal dispute arising out of this tender/contract, the court of jurisdiction
for the same shall be the appropriate Civil Court of Beawar.
42.8.0 The Corporation may instruct the contractor to furnish proof of having made payments
to the workmen or ask the contractor to make such payment in the presence of their
representatives as and when desired.
42.9.0 Contractor is responsible for ensuring the Compliance of Building & Other Construction
Workers Cess Act, should get themselves registered under the said Act and produce the
challan as proof of payment of Building Cess. Without the production of the such
challan the bill will not be processed.
43.1.0 The salary of the labour engaged by the contractor shall be paid through ECS/ Bank
Cheque / Bank remittance, unless there are compelling reasons for not doing so, in
which case the same shall be intimated to the Engineer-in-Charge/Officer-in-Charge.
43.2.0 Any liability towards over time or extra payment for any person engaged for more than
nominal working hours shall be entirely & exclusively borne by the contractor as per
relevant labour laws. The Engineer-in-Charge or his authorized representative on his
own accord can change the timings without assigning any reason.
43.3.0 The contractor shall along with his monthly bills specifically certify that he has fully
complied with all the obligations under Contract Labour (Regulations and Abolition) Act
and all other related statutory obligations such as provident fund, family pension,
gratuity, ESI, leave salary, Workmens Compensation Act etc and all other obligations as
enforced by the Government from time to time. The contractor may be directed in
writing or orally specifically in this behalf his obligations for compliance, which he will
be required to comply with. In case of his failing to comply, he shall be liable for penalty
and other actions including termination of contract as may be deemed fit at the
discretion of the Owner.
43.4.0 The contractor on monthly basis shall provide a consolidated record in a file of all the
salary payments/statutory deductions/proof of necessary contribution towards PF/ESIC
and all the other records as per the provision of EPF/ESIC Act to IOCL.
44.1.0 The contractor's special attention is drawn to the recent regulation of imposition of
Sales Tax on composite works contract by certain State Governments. In case such Sales
Tax is already in vogue, the offer of the tenderer shall be deemed to include such Sales
Tax. The tenderer shall get their names registered under Sales Tax Authority of the State
Government concerned. Recoveries as per requirements of Sales Tax department shall
be effected from the bills payable to the contractors.
45.1.0 The contractor shall indemnify and keep indemnified the owner and its employees /
representatives against all actions, proceedings, claims, costs and expenses whatsoever
in respect of or arising out of any failure or default by the contractor in due
performance of his obligations under this contract.
45.2.0 In further to provisions of clause 8.5.0.0 of GCC, the Contractor shall undertake to
provide comprehensive accident insurance coverage in respect of every employee
employed by him for carrying out Owners job. Contractor shall satisfy the Owner of the
same within the time prescribed by the Owner but before the actual commencement of
the job awarded to him.

from entering the premises of work, if the owner feels that the said person is an undesirable

I/We shall not sublet the work to any agency without prior approval of the Engineer-In-Charge.

damage under workmans compensation and/or any other law in respect of personal injury to
or death of any labourer, whomsoever arising out of or in the course of or caused by the
execution of the work or any accident in the job site.
I/We further agree to be solely liable for any or all such claims.
I/We understand that the Earnest Money shall be refunded in case my/our tender is not

PREAMBLE
1. This preamble is an integral part of the Schedule of Rates and any definition and explanation
given herein shall have as much force as though they are incorporated into the description of
the items themselves in the Schedule of Rates.
2. Unless otherwise specifically stated in the contract, all items under the contract shall be
covered and paid for in accordance with the items and relative rates mentioned in the
Schedule of Rates.
3. The rates indicated against each item in the Schedule of Rates shall be for the complete works
involved in execution of the item including all labor, materials tools, tackles, transportation
etc.
4. The expressions used in the Schedule of Rates are only selected abbreviations desired to give
a general indication of the work covered by the item, and it is intended that each item shall
encompass the entire work and operations involved in and relative to the performance of
work as envisaged in terms of the contract documents and shall include all operations
auxiliary, ancillary or incidental to or in connection therewith and all other matters, risks and
costs whatsoever provided for under the Schedule of Rates. It is, therefore, necessary that the
Contractor should read and construe the Schedule of Rates with reference to the contract
document as a whole for a proper description undertaking of the work(s), responsibilities,
duties, obligations and liabilities covered by each item of the Schedule of Rates on the
understanding that items in the Schedule of Rates cover the entire work under the contract
split under different heads for the purpose of convenience in computing payment due to the
Contractor and enabling the Contractor to quote.
5. Without prejudice to any other right(s) the Owner may have under the Contract, the Owner
reserves the right to operate any and all items of work appearing in the Schedule of Rates.

Dear Sirs,
Having examined the Tender Documents consisting of short Tender Notice, General Instructions to Tenderers,
General Conditions of Contract, Special Instructions to Tenderers, Special Conditions of Contract,
Specifications, Plans (Exhibits NIL to NIL), Drawings (Exhibits NIL to NIL), Time Schedule, Form of Contract,
Form of Tender, Form of Schedule of Rates, and Corrigendum(s)/ Addendum(s) to the Tender Documents, and
having understood the provisions of the said Tender Documents and having thoroughly studied the
requirements of Indian Oil Corporation Ltd. relative to the work tendered for in connection with the Annual
Maintenance Contract of Emerson make PAC units installed at KSPL, Kot and having conducted a thorough
study of the job site(s) involved, the site conditions, soil conditions, the climatic conditions, labour, power,
water, material and equipment availability, the transport and communication facilities, the availability and
suitability of borrow areas, the availability of land for right of way and temporary office accommodation and
quarters and all other facilities and things whatsoever necessary for or relative to the formulation of the
tender or the performance of work, I/we hereby submit my/our tender offer for the performance of
proposed work in accordance with the terms and conditions and within the time mentioned in the Tender
Documents. Within in the time mentioned in the bid documents at the rate(s) quoted by me/us in the
accompanying schedule of rates based on the forms of schedule(s) of rates within the tender documents and
arrived at a total contract value of rupees (as indicated in the price bid) based on an application of rates
tendered in the accompanying schedule(s) of rates to relative quantities indicated in the form of schedule(s) of
rates forming part of the tender documents.
If the work or any part thereof is awarded to me/us, I/ We undertake to perform the work in accordance
with the Contract Documents as defined in the Form of Contract forming part of the Tender Documents and
accept the terms and conditions of Contract as laid down therein and undertake within 10 (ten) days of receipt
of acceptance of Tender to pay to and/or deposit with the Accounts Officer, WRPL, Sendra, Indian Oil
Corporation Ltd. (Pipelines Division) a sum which together with the amount of earnest money deposited by
me/us in terms hereof, shall make 2% (two and one-half percent) of total contract value as specified in
the Acceptance of Tender for the purpose of security deposit, by any one or more of the modes of payments
specified in this behalf in the General Conditions of Contract, and to commence work at each job site(s)
involved within 10 (ten) days of handing over the job site or any part thereof to me/us, and to sign the formal
Contract in the terms of the form of contract forming part of Tender Documents, within 10 (ten) days of receipt
of Letter of Acceptance from and on behalf of Indian Oil Corporation Ltd., in this behalf failing which Indian
Oil Corporation Ltd., shall be at liberty, without reference to me/us and without prejudice to any of its
rights or remedies, to terminate the Contract and/or to forfeit the earnest money deposited in terms hereof.
In consideration of the sum of Rupee 1/- (Rupee one only) paid to me/us by Indian Oil Corporation Ltd., by
adjustment in the price of Tender Documents, I/We further undertake to keep my/our this tender offer open
for a period of not less than 4 (four) months from the scheduled date of opening of Tenders as specified in

3) The price bid shall be submitted online in BOQ format only. The rates in schedule of
Rates are to be filled up in designated cells of BOQ.
4) Complete contents of the Price Bid/ SOR shall be made available in the un-priced

there in the priced part of offer.
5) Bidders are requested to submit the Price Bid in the above format only and Bidder
shall sign & stamp all the pages of the Price Bid. Any change in the format may result
in summary rejection of the offer without any reference whatsoever to the bidder.
6) It is to be ensured that rates against each SOR item have been quoted and no row/
