A Guide To Resentencing
& Reclassificaon

PROPOSITION 64: OVERVIEW


OnNovember8,2016,CaliforniavoterspassedProposi on64(Prop.64)intolaw.Prop.64
legalizesthepossession,transport,purchase,consump onandsharingofuptooneounceof
marijuanaanduptoeightgramsofmarijuanaconcentratesforadultsaged21andolder.Adults
mayalsogrowuptosixplantsathome.Theballotmeasurealsoprovidesforastrictsystemto
regulateandtaxthenonmedicaluseofmarijuana,whichwillnotbeginun l2018.

Prop.64alsoreducesoreliminatescriminalpenal esformostmarijuanaoenses,inaddi on
totheconductitlegalizes.Buildingonthetransforma veworkofProp.47,whichpassedin
2014,Prop.64providesamechanismforpeoplewithpriorqualifyingmarijuanaconvic onsto
pe onacourttohavetheirconvic onsreducedordismissed.

Thepurposeofthisguideistoprovideinforma onabouttherequirementsandprocedurefor
seekingresentencingandreclassifica onofqualifyingconvic onsforpeoplewhohavealready
completedtheirsentence.Althoughana orneyisnotrequiredforreclassifica on,itisalways
usefultogethelpfromana orneytoensuretheProp.64processiscompletedaccurately.

TYPES OF RELIEF AVAILABLE


Thecriminalpenaltychangesapplytopendingandfuturechargesandpastconvic ons.The
changeswentintoeectonNovember9,2016,thedaya ertheelec on.Peoplewhoare
currentlyservingsentencesorwhohavecompletedtheirsentencesforaProp.64qualifying
oensecanbenefitbyapplyingtoacourtforrelieftoreduceordismisstheirpriorconvic on.
Prop.64createdanewlaw,HealthandSafetyCode11361.8,tofacilitatethisprocess.The
lawmodelstheonecreatedbyProp.47,withafewdierencesthatarenotedinaboxbelow.

Personswhoarecurrentlyservingasentenceinprisonorcountyjail,orwhoareonproba on,
postreleasecommunitysupervision,orparole,maype onthesuperiorcourtfor
resentencing. Thecourtmustresentencethepe oner,unlessthecourtdeterminesthatthe
pe onerisanunreasonableriskofdangertopublicsafety.AsusedinProp.64,
unreasonablerisktopublicsafetyhasthesamemeaningasitdoesinProp.47.Inother
words,ape onerisonlyanunreasonableriskofdangertopublicsafetyiftheyareatriskof
commi ngasuperstrikeasdefinedinPenalCode667(e)(2)(C)(iv).Ifresentenced,the
pe onerwillbeorderedtoserveoneyearonparoleorpostreleasecommunitysupervision,
unlessthecourt,initsdiscre on,releasesthepe onerfromthisrequirement.

Personswhohavecompletedtheirsentencesandarenolongerincustodyorundersupervision
maype onthesuperiorcourtforreclassificaon.Somecourtsalsorefertothisprocessas
redesigna on.Whenevalua ngape onforreclassifica on,thecourtmakesno
determina onaboutrisktopublicsafetyandhasnodiscre ontowithholdresentencing.
Instead,aslongasape onerwasconvictedofanoensechangedbyProp.64,thecourtmust
reclassifytheconvic on.

QUALIFYING OFFENSES AND ELIGIBILITY


Prop.64amendedthepenal esforfourcriminaloenses:1

Possession of marijuana or concentrated marijuana (H&S Code 11357)


Culvaon of marijuana (H&S Code 11358)
Possession with intent to sell marijuana (H&S Code 11359)
Sales or transport of marijuana (H&S Code 11360)

Thenewpenalty(i.e.misdemeanor,infrac on,ordismissal)a achedtoeachoensewill


dependonthespecificoense.Forexample,someoensesbecameoutrightlegal(suchas
possessionofupto28.5gramsofmarijuanaorupto8gramsofconcentratedmarijuana)and
someoensesthatwerereducedtomisdemeanors(suchassalesofmarijuana).See
AppendicesAandBorhowspecificoensesareaectedbyProp.64.


ELIGIBILITY.
Anypersonwithapriorconvic onforoneofthefouroenseslistedabovemayapplyfor
reclassifica on. Prop.64doesnotdisqualifyape onerfromresentencingorreclassifica on
becauseofanypar cularpriorcriminaloense,suchasasuperstrike.Inotherwords,aslong
asthepe onerwas(1)convictedofanoenselistedabove,(2)isservingorcompleteda
sentenceforoneofthoseoenses,and(3)wouldhavebeenguiltyofalesseroenseunder
Prop.64,thepe oneriseligible.IftheDistrictA orneyobjectstoresentencingforany
reason,theymustprovethepe onerineligiblebyclearandconvincingevidence.

SPECIAL NOTE FOR NONCITIZENS:

admissionofuseorpossessionofmarijuanaisadangerfornonci zens.Immigra on
ocersareincreasinglyaskingnonci zensiftheyhaveeverusedmarijuana,especiallyin
statesthathavelegalizedmarijuana.Anonci zenshouldrefrainfromadmi nguseto
anyimmigra onocial.Forpurposesofresentencing,trytosecureanorderthat
specifiesthatthepriorconvic onisreducedordismissedbecauseitislegallyinvalidas
H&SCode11361.8requires.TheresentencingreliefinProp.64mightnotbeaccepted
forimmigra onpurposes,sononci zensshouldconsiderotherformsofpostconvic on
reliefaswell.

STEP 1. GET A COPY OF THE RAP SHEET


AcopyofaRAPsheet,orcriminalrecord,isneededtodetermineeligibility.Iftheapplicant
onlyhasconvic onsfromonecounty,theycanvisitthecourtwheretheconvic onoccurredto
obtaintheirrecord.Ifthepersonhasmul pleconvic onsfromdierentcoun es,theymust
obtainacopyoftheirrecordfromeachcourtwhereaconvic onoccurred.Alterna vely,they
canobtaintheircompleteCaliforniaRAPsheetfromtheDepartmentofJus cebyfillingoutan
applica onandvisi ngaLiveScanproviderwhowillfingerprintthemandsubmittheirrequest
toDOJ.(Visitwww.oag.ca.gov/fingerprints/loca onstoobtainalistofloca onsbycounty.)The
resultswillbemailedtotheapplicant.ThereisafeechargedbybothDOJ($25)andtheLive
Scanprovider($1525),butapersonmayqualifyforawaiverfromtheDOJfeewithproofof
indigence.SeeAppendixCforastepbystepguidetoobtainingDOJRAPsheets.

STEP 2. COMPLETE PETITION FOR RECLASSIFICATION


AlthoughmanycourtshavenotyetadoptedafinalizedprocessforProp.64,mostcourtswill
likelyuseauniformform,whichcanbeobtainedfromtheclerkofcourt(orcountywebsite)
wheretheconvic ontookplace.Alistofformsusedbyeachcountywillbeprovidedat
www.myprop64.orgastheyareadoptedandmadeavailable.Acopyoftheformsproposedby
JudicialCouncilforbothadultsandjuvenilesarea achedasAppendicesDandE.2While
theseformsareop onal,CaliforniaRulesofCourtrequirecourtstoacceptthisformevenifthe
courthascreateditsownform.Completetheform,includingcheckingtheboxfor
reclassifica onordismissal.

3. SERVE COPY OF PETITION AND FILE RECLASSIFICATION PACKET


Inmostcoun es,aProofofServiceformwillalsoneedtobecompletedthatindicatesaperson
18andolder,besidestheapplicant,mailedorpersonallydeliveredacopyoftheapplica onto
theDistrictA orneysoce.TheJudicialCouncilformincludesaProofofServiceform.A
separatereclassifica onpacketmayneedtobesubmi edforeachconvic ondependingon
thecounty.Somecoun esallowanapplicanttoapplytoreclassifymul pleconvic onsonone
form.Thepacketwillcontaintheapplica onandtheProofofService.Maketwocopiesofeach
packetforatotalofthreepackets:(1)originalpackettobefiledwiththecourt;(2)onecopyto
bemailedtotheDistrictA orney;and(3)onecopyforyourrecords.Filinginstruc onsmaybe
slightlydierentforjuvenilepe ons.

STEP 4. WAIT FOR APPROVAL


Ajudgewillreviewthepe ononceitisfiledtomakesuretheapplicantqualifiesfor
reclassifica on.Sincetherearenodisqualifyingconvic ons,ajudgemustreclassifythe
convic oniftheapplicantwasconvictedofaqualifyingoense.However,ajudgewillneedto
determinehowtheconvic onshouldbereclassifiedaccordingtothelawtoaninfrac onora
misdemeanorortodismisstheconvic onen rely.TheburdenisontheDistrictA orneyto
provebyclearandconvincingevidencethatape onerisineligible.Ahearingisgenerallynot
necessary,butitispossibleahearingmaybeneededtodeterminewhethertheamountof
marijuanafallsunderacertainthresholdthatchangesthepenaltye.g.whetherthemarijuana
weighedmorethan28.5gramsorwhethermorethansixplantswerecul vatedorifthe
DistrictA orneyobjectstothepe onforanyreason.Inmostcoun es,theapplicantwillbe
no fiedbymailoncethecourthasrecordedthechangetotheconvic on.Somecoun esmay
requirethepersontoreturntocourttolearnthestatusofthepe on.Besuretocheckwith
theclerkwhenthepe onisfiledhowthepe onerwillbeno fied.

2.TheproposedJudicialCouncilformsrequirethepe onertoassertfactstoestablish
eligibilityforresentencingorreclassifica on.Forexample,inordertocompletetheform,a
pe onermuststatetheirageatthe meoftheoense,theamountofmarijuanathe
pe onerpossessed(orcul vated),andthetypeofmarijuanapossessed.Theseforms,as
proposed,placetheburdenonthepe onerinsteadofontheDistrictA orneyasthelaw

RECORD REVIEW
(Live Scan)

California Penal Code sections 11120 through 11127 afford a person an opportunity to obtain a copy of his or her record, if
any, contained in the files of the California Department of Justices (DOJ) Bureau of Criminal Information and Analysis
(BCIA). Pursuant to California Penal Code section 11121 an individual who submits for a record review may refute any
erroneous or inaccurate information contained therein. Pursuant to California Penal Code section 11124, the purpose of a
record review is to provide an individual or designee indicated on the background check request with a copy of the individuals
record or notice of a no record existence.

The applicant may use the information received to answer questions regarding past criminal history, or to complete an
application or questionnaire. Pursuant to California Penal Code sections 11125, 11142, and 11143 this process is not to be used
to obtain a copy of criminal history information to furnish to a person or agency for purposes such as certification,
employment, licensing, immigration, or visa. A violation of these sections is a misdemeanor.

The DOJ will only mail a response to the applicant and to the designee as identified by the applicant on the BCIA
8016RR form.
