COMES NOW, the State, through the undersigned trial prosecutor, unto
this Honorable Court, most respectfully submits its Comments/Objections to the
Formal Offer of Evidence for Accused Anuar M. Gabinul, to wit:

The State admits the existence of Exhibits 1-GABINUL; 2-GABINUL;

3-GABINUL and 4-GABINUL. The State, however, by way of comment, notes
that said Exhibit 1-GABINUL was secured thru delayed registration based
solely on the information supplied by said Anuar Maalup Gabinul only on
December 7, 2005; that while it may be true that his complete name as claimed
by accused is ANUAR M. GABINUL, and that it was under the name Gong-
gong that he was arrested, there is no question that his identity as having
participated in the execution of the crime for which he is charged was already
established by the identification made by victim Faisal Binasing. Definitely, no
perpetrator of a crime would introduce himself to the victim by his true and
complete name.

The State admits the existence of Exhibits 5-GABINUL; 6-GABINUL,

7-GABINUL; 8-GABINUL and 9-GABINUL, as they all would prove the fact
that herein accused was a resident of Sumisip, Basilan, and that it was not
physically impossible for him to be in the Municipality of Lantawan, Basilan,
where the aforecited crime was committed since both municipalities are just
adjacent to each other.
