AFFIDAVIT OF ADVERSE CLAIM

We, OSIAS M. BIBAS JR., married, of legal age, and a resident of 2523 Pasig Line St.,
Sta. Ana, Manila and ROSE ANN M. BIBAS, single, of legal age and a resident of 2523
Pasig Line St., Sta. Ana, Manila under oath, duly depose and state that:

We are co-owners, as heirs, of that parcel of land containing an area of FORTY EIGHT
SQUARE METERS (48) Square Meters, more or less, located at 2523 Pasigline St.,
Sta. Ana, Manila, under Transfer Certificate of Title No. 002-2014003628 of the Registry
of Deeds for Manila, and registered under the name only of ROZEL M. BIBAS, and a
parcel of land located at Municipality of Mansalay, Province of Mindoro with TCT No.T-
83298 containing an area of TWENTY THOUSAND (20,000) SQ. METERS more or
less.

The said lone registered owner of the subject property is the husband of our late mother,
Ma. Lily M. Bibas, the latter having died on June 10, 2007 at our residence located at
2523 Pasig Line St., Sta. Ana, Manila. Attached is a photocopy of her Certificate of
Death, as Annex A.

The above properties used to be part of that parcel of land covered by TCT No. 249946
of the same Register of Deeds for Manila containing a total area of FORTY EIGHT ( 48 )
Square Meters, more or less, located at 2523 Pasig line St., Sta. Ana Manila, registered
under the name of OSIAS B. BIBAS married to MA. LILY M. BIBAS. The truth of the
matter being that this particular property was a conjugal property of the said spouses.

WE, who are all children of the deceased BIBAS, are co-owners of the subject
subdivided property based on our natural and legal right to inherit from our deceased
parents.

All of us, the heirs of the deceased Ma. Lily M. Bibas, have not executed an extra-judicial
partition or settlement of the estate of our deceased mother. Also, we would like to stress
that our mother died without leaving a will or testament.

It was OSIAS B. BIBAS, my father, who alone caused the property to be transferred
under his name married to ROZEL M. BIBAS and the latter Are now the registered
owners of that parcel of land with an area of FORTY EIGHT (48 ) square meters, more or
less, under TCT No. 002-2013002571 also of the Registry of Deeds for Manila.

The transferred right over real properties above-stated were actually without our
participation.

Last March 14, 2014, we were able to annotate an Adverse Claim in TCT No.
2013002571 with Entry No. 2014002431 as annex A (Joint Affidavit of Adverse
Claim) but the said annotation was cancelled without our consent or participation.

It must be stressed that a case for partition of the estate is pending before the Regional
Trial Court, Branch 26 of Manila entitled In the Matter of the Petition for Settlement of
the Intestate Estate of Osias Bibas and docketed as Spec. Pro. No. 14131713. Rozel
Bibas is a respondent / oppositor and is actively participating in the proceedings of this
case.
Moreover, the cancellation of adverse claim submitted by Rozel Bibas which allegedly
declared our approval to transfer the title of the subject property from Osias Bibas to her
name is a falsified document and our signatures therein were forged.

We are executing this sworn statement in order to attest to the truth of the foregoing facts
for all legal intents and purposes and more particularly to support our request for
the annotation of an adverse claim over the parcel of land described herein.
